      Its Benami Transactions (Prohibition) Act, 1988 and it prohibits benami transactions so it seems this is a bad advice unless u can clarify

      True but don’t blindly give the authority to your spouse as well. It’s all fine till you don’t experience anything and God forbid anyone does but in the end if things go bad it’s the paperwork and proof that counts. Speaking from experience, I bought a flat with my own hard earned money however there was a pushback from his family to have the flat in my name so I agreed to it. Fast forward couple of years and I got to know flat is sold me & my kids were left with nothing. I am now reeling from all that but also regret that why didn’t hv my paperwork correct. If I had a side agreement or any proof I cud have claimed the property. Sorry for the long response but don’t want anyone to get into that emotional trap and lose their hard earned money. Be smart as world is no more for emotional people.

Medical and Judiciary are the two dangerously blood sucking areas lies ahead of every Indian even younger gens now, earlier only adult used to get sucked by there. Escaping from it is what probably going to make them more stronger, they sow more fear in masses. The very approach of most people is just come out of Courts and people see those who are fighting in courts as stupids and less practical ones. This attitude gives more strength to those establishments.

      If you think taking care of a home and children isn’t work then your insane!! I worked in the upper corporate world for almost 15 years and before that simply worked 2 to 3 jobs from the time I was 15 years old until I got promoted into that upper corporate world at age 24 years old. And I’ll tell you now, cooking, cleaning, shopping, raising our kids and basically being a slave, maid, chauffeur and everything else on a 24/7 schedule is wayyyyyyyyyyyyyyyy more work than when I was working anywhere from 65-120+ work weeks!!
      So yea, the husband should be taking care of her for a set number of years afterwards since you as the man wouldn’t have that ability to work without that woman being next to you doing literally everything else, which is a lot more than just working one damn job and then coming home and not doing shit! Foh!!!

    I'm a med student, I'm not married and I've zero idea about the topic he's talking about, but to be fair, when there's a divorce or separation and if the wife is a homemaker (doesn't work outside and takes care of home and kids) then it's only fair that she gets half of the property/money owned by the husband during their marriage, not talking about the cases which might include infidelity or abuse feom the wife's side. Otherwise it's basically like the husband got enough of her, enjoyed her free services and now that he's bored, he is kicking her off to the streets with no way of income. I've seen this happen many times. Indian judiciary system is a big big joke.

      There is something called matrimonial alimony and in the first place "Divorce" does not happen so easily, it is granted by the court when there is a proper reason and for your knowledge even if the wife is accused of adultery, you will be granted divorce but you have submit your income certificates and valuation and alimony to wife will granted even you are the victim. ( I know higher income ones are asked to pay alimony but for women can divert the cases ).
      PS: you didn't need to tell you are medical students, if you know nothing about something just don't say it as a excuse to comment illogical things on other fields.

    I want to ask one logical question. There are many Indian families where when the couple got married both husband and wife were were earning but the wife left the job and to take care of the family. Now she becomes unpaid servant of the family. This also she does out of love but realises ten years later that she can neither get a decent job norr has any bank balance. I think she deserves equal share in the property and bank balance of husband.

He has to prove himself innocent and possibly lose everything in the process. The law, the public, the media, everyone in social media will always be on your side just because you're female. A female employee is kind of timebomb. You don't know when she'd explode with a false case. I'm not the only one with this thinking. A growing number of companies are hiring men more. If you don't like it, kindly make the laws gender neutral. You can see it's hurting normal women more.

    It is good that men in comments section are deciding not to marry. It's just suffering when people get married then regret. As a woman I support the idea of not marrying.
    Once married there's no turning back. Life changes completely especially of a woman. The concept of marriage needs to be not forced on people. Some people may want it but marriage is not for everyone and it's best if people (unless they deeply desire it and are very mature) don't get married.
    There's nothing wrong in remaining single. I've been terrified of marriage since childhood myself. It's ok to be single or to just live with friends. I believe in found family.

    One of my relative resigned his Govt. job and became an IT professional just because property can't be made in his own name.. after some 10 years or so his wife giving him so heavenly treatment now he is living far here n there like a gipsy pg, room, lodge etc and substandard life and taking lotta care so that property should not get occupied totally by her. for the last one year jobless as well.

      If you fear divorce, alimony so much don't get married. Earn well, live well. Marry someone who would agree to settle scores outside the court. You have to give some property in one way or another in most cases. (Except only if you have solid proof of her cheating/ beating your mother/ threatening you with fake charges).       A person in India gains *immovable* property in two ways -
      1. Self acquired property i.e. the property he/she purchases by his/her own income.
      2. Inherited Property i.e the property he/she acquires either because his/her father died without making will and after equally dividing among siblings, he/she got the share OR his/her father died after making will and he/she got the portion of property as written in the will.
      With respect to Point 1, in India women contribution to paid work force is at around mere 20%. Majority of women are either underpaid or working unpaid in their own houses like most of our mothers. They have no considerable savings in their own name to purchase an immovable property. Most of them don't have a Bank account in their own name. This is where this Lower rate for registration comes into picture that if the husband goes to purchase an immovable property, to reduce the registration fee burden, he might want to own the property with his wife because to enable him to work and earn money outside, the wife works inside the house.
      With respect to Point 2, before 2005, a woman had no claim in her father's property. It is only after 2005, the Court recognised that a daughter too has a right to share in the Father's property just like the sons. Even when this right is present, women like our mothers, Buaas, Maasis are being made to sign "Relinquishment Deed" whereby they give up their own birth right in the share of Father's property. They lose their right in their own Father's property and upon his death, they don't get a share and this is a cause for concern for legislature.
      The Will culture is still in its nascent stage and not many elderly make wills before dying. Even if they do, let's be honest, nobody wants to leave lands, houses to daughtes who are eventually going to marry and go to a different family taking that land and house with them. This is still the prevalent thinking.
      So, all in all women ownership of immovable property is poor in India.
      Summary - Ground reality matters behind policies.

    I live in Europe for many years. Here if a man buys property then only his name will be on the papers.
    If wife's name should be on the property then she's has to show her own income and pay the premium 50% every month.
    India must change also. Women do not marry are not under 18 anymore with no education and work. The women have to produce equal in order to be 50% partners.
    Men are safe here. Indi must save these men, too.

    All those saying buy it in your parents name, this is a legit case I've seen -
    Elder son moved to a different city as he had a transferable job. He was our neighbour for some time. He bought a property in his native place with his own hard earned salary but in his mother's name. I believe that was his way to honour her mother. When his mother was admitted to hospital, his mother wrote a will and asked the property to be transferred to the Younger son upon her death as he was the one taking care of her all these years 😭😅 Anyway, she did not pass away that time but our neighbour ultimately had to file a case against her because he realised upon retirement, he and his family will not have a place to stay.

    I am woman. I have my own home. Now me and husband will take home together. Both will pay emis. Stay in nuclear family. Men and their family should not treat women as free ki maid. And problems will be solved. Both should earn. Both should do housework. And mainly live separately from both parents. Major chutiyapa is patriarchy. Not marriage.

    Loool, have you ever seen a woman put most of her working wealth into properties while the husband actually owns those properties? I’ve seen plenty of these types. Don’t know what their intention is or it’s an ego problem. Would advise you to do a video for naive women as well.

    What if the house is solely owned by a husband on loan. He is able to buy that house and pay that loan because there is an alternative income source from the wife who runs the house. What is here for wife post divorce then?
