I think the analogy for the government should be: if our nation was in a conventional war, it would be everyone's free speech to critique the engagement or performance in the war, but transmitting the location of troops or security statuses of bases is unprotected speech even though they are both communications that come from the same political thought or preference.
The tiktok lawyer argued they are a publisher which would remove their protection under 230. Being banned would be better for them over the avalanche of lawsuits that could be filed.

A: There is precedent for protection from this flip flopping, where it’s been decided it would violate due process. So maybe it’s feasible that Trump could just propose this, and Bytedance would continue operating, even with Congress’s law in place. -The current law states divestment must happen by Jan 19th, so Sotomayor (I believe) pointed out that if it were effectively up to the President, what happens on Jan 19th would be a violation, taken before an admin could effect a “we’re not enforcing this law” policy. (which makes them vulnerable to any civil violations, cuz this fact would be an extremely strong case to win against them) -also, the statute of limitations on this violation of this law would be 5 years, meaning the next administration could feasibly prosecute ByteDance for the violation (especially due to being committed on Jan 19th which is before the next admin)
How is an algorithm considered speach? The law does not affect the users free speach, the only thing affected is that they might not be able to use the parent companies algorithm. Thats a pice of technologie. IFthe worry was that forign chips in self driven cars could be used by the chinese governments to assassinate ppl, and then there was a law that no parts of the car can be made by companies that are owned by chinese companies, then it woulndt affect anyone speach. @@falconeshieldNo, in using both, with several accounts on each with different scrolling habits, the TikTok algorithm is *much* less toxic. Reels is by far the worst. Significantly more rage bait, toxic comments and videos, and bald face favoritism for the Trump empire. Setting keyword and hashtag filters on Reels is wholly ineffective. YT shorts are better but it’s obvious that the algorithm there is by far the least sophisticated. It constantly shows repeated videos and ushers you into narrow rabbit holes. TikTok can put you into rabbit holes but the whole user experience is significantly less negative and toxic overall. Racisim, misogyny, and misandry is not encouraged and political content doesn’t spread as fast. The algorithms between these platforms is very different. TikTok was by far the least toxic and most sophisticated.

TikTok isn't just an algorithm. They could just operate TikTok without the algorithm and use other ways to show content until the matter is resolved. Incurring losses isn't the same as inhibiting free speech. We've had social media before expensive content algorithms. The attorney's argument is even weaker. He's given up on insisting that the company would struggle to operate, he's essentially only saying they might incur losses and not satisfy their clients overseas if they don't use the algorithm. Well guess what, if you're owned by someone who's under investigation, you might not be able to access their business. That's not a freedom of speech issue, it's exactly the thing Steven said when he talked about streamer gear from a foreign supplier. And the whole thing doesn't make sense from the start. Are they protected as Americans and can say what they want, or are they owned by ByteDance, a legally charged foreign entity, and legally bound to do what ByteDance tells them to do? -The current law states divestment must happen by Jan 19th, so Sotomayor (I believe) pointed out that if it were effectively up to the President, what happens on Jan 19th would be a violation, taken before an admin could effect a “we’re not enforcing this law” policy. (which makes them vulnerable to any civil violations, cuz this fact would be an extremely strong case to win against them)
-also, the statute of limitations on this violation of this law would be 5 years, meaning the next administration could feasibly prosecute ByteDance for the violation (especially due to being committed on Jan 19th which is before the next admin)

How is an algorithm considered speach? The law does not affect the users free speach, the only thing affected is that they might not be able to use the parent companies algorithm. Thats a pice of technologie. IFthe worry was that forign chips in self driven cars could be used by the chinese governments to assassinate ppl, and then there was a law that no parts of the car can be made by companies that are owned by chinese companies, then it woulndt affect anyone speach. This ban isnt about what is said on the platform, but with which technologie it gets currated.
Also it wouldnt be enough to just disclose the content because the individual content creators are not the propaganda peaces, the fear is that the piece of technologie aka the algorithm is beeing used to artifically boost opinions, which themselves are not influenced by forign entities, to influence public perception of topics.
Most pieces of technolgie have government regulation. be it in the US or the EU. US may be less so than the EU. Noone complains that formulars for drugs need to be checked to ashure your health, but apps that influence mental health and information on this leven are free from scrutiny? noone complains that cars need to have savegards like seatbelt or airbags to protect their consumers and that manufactures need to proove they have them, but software ist completly unregulated?

@@falconeshieldNo, in using both, with several accounts on each with different scrolling habits, the TikTok algorithm is *much* less toxic.
Reels is by far the worst. Significantly more rage bait, toxic comments and videos, and bald face favoritism for the Trump empire. Setting keyword and hashtag filters on Reels is wholly ineffective.
YT shorts are better but it’s obvious that the algorithm there is by far the least sophisticated. It constantly shows repeated videos and ushers you into narrow rabbit holes.
TikTok can put you into rabbit holes but the whole user experience is significantly less negative and toxic overall. Racisim, misogyny, and misandry is not encouraged and political content doesn’t spread as fast.
The algorithms between these platforms is very different. TikTok was by far the least toxic and most sophisticated.

He's eating up the attorney's claim that TikTok can't operate if ByteDance doesn't operate their software engineering centered around the algorithm. This doesn't hold. TikTok isn't just an algorithm. They could just operate TikTok without the algorithm and use other ways to show content until the matter is resolved. Incurring losses isn't the same as inhibiting free speech. We've had social media before expensive content algorithms.
The attorney's argument is even weaker. He's given up on insisting that the company would struggle to operate, he's essentially only saying they might incur losses and not satisfy their clients overseas if they don't use the algorithm. Well guess what, if you're owned by someone who's under investigation, you might not be able to access their business. That's not a freedom of speech issue, it's exactly the thing Steven said when he talked about streamer gear from a foreign supplier.
And the whole thing doesn't make sense from the start. Are they protected as Americans and can say what they want, or are they owned by ByteDance, a legally charged foreign entity, and legally bound to do what ByteDance tells them to do? How is restricting that restricting an American's freedom of speech? It's not the American's speech, it's the Chinese speech that the American is obligated to distribute.

@secretzpt176 Not really. It's a part of their popularity. At this point all they need is the most basic user-interest-categorisation to replace it. Their success consists of their userbase using the platform as a social media community. The means of content distribution are secondary.
