This reminds me a lot of the Napster era and all of the legal battles from Metallica and other record labels to shut them down. While most musicians agreed that it was theft, I recall Trent Reznor in an interview making a point about how these people that were downloading songs were never going to buy any of the albums that they were downloading even if Napster didn't exist. It was in reference to the same type of hypothetical that you mentioned on how Nintendo lost a potential $11.4 million in game sales. I don't think that they lost even $100k in game sales because people who pirate will always pirate and will just move onto something else to keep them entertained. I'm sure that Nintendo has greatly outspent any lost profits in legal fees by now.

Nintendo has done the full court press against people being able to backup their own games, and playing their own dumps in an emulator, claiming, prior to the current copy protection scheme, that it was illegal. Since it wasn't illegal then, and Nintendo were lying about it, I think it's safe to assume it isn't now and they're still lying about it. But you can do whatever you want when you have millions of dollars to litigate people into oblivion. It's a shame a company as horrible as Nintendo isn't actually losing money. They clearly have vastly too much of it.
The problem is the USA! The USA does not have a fair and citizen centered court system, they only care about corporations and rich people! Why did it not occurre to you yet, that this only happens in the USA, but not in Europe or anywhere else in the world? Because other countries have real freedom, democracy and care about their people! Nintendo has no problem picking on the small fries legally, but they dont seem to even want to send a courtesy letter to Amazon to just remove those retro consoles.
Oddly enough, this case doesn't just show how crazy far Nintendo goes but also that they violate privacy in some way, which is really poorly protected anyway and especially when people share personal data online. For the sake of the system's initial success I hope it getting hacked and emulated takes a while, on the other hand I'd laugh real hard if the Super Switch gets emulated within a week at most.
My guess why suddenly Nintendo seems to be going scorched earth is 1) The new switch hardware isn't going to be meaningfully different enough from the OG switch. They know emulation for it was going to be a trivial exercise for existing and future Switch emulators to expand themselves into. Think how Dolphin does both Gamecube and Wii emulation all in one. Mission accomplished on this front, all switch emulation development is dead for the time being. 2) They plan to continue to expand the NSO subscription emulation and continue to keep adding "expansion" packs to it's yearly/monthly cost. Since most old emulation is trivial and playing wack-a-mole with rom sites is a waste of time, they are trying to destroy emulation legally (except for them of course). If anyone thinks this isn't possible due to precedent oh boy oh boy have you met the US court system in the last 10 years? It's laughably and comically pro-corporate and no longer has any issue over turning precedent. If they get this in front of the 5th circuit for instance, emulation is about as good as dead.

Not to mention, I intentionally make it look like I'm emulating it when I'm not, doing stuff like turning off the backgrounds and including the boot ups of games on Capcom Fighting Collection

These loss numbers are ridiculous. As a kid I pirated GBA games (which was legal in my country at the time). This "loss" is not money they would have gained if I didn't pirate those games because I didn't have any money to spend. I haven’t been liking Nintendo’s Behavior lately. There game quality started to go down and I was able to find more bugs and glitches that ruined the game experience. In addition recent updates made the switch operating system laggy as hell. I also see that Nintendo is bullying and suing normal people including PalWorld. To me to it’s just out right insanity. Yes they have the right but it’s completely unethical and immoral. Honestly I think it’s time we boycott Nintendo and encourage our kids to do the same. If I decide to have a family I will make sure Nintendo doesn’t get a cent from me. Instead I would build a gaming pc which I did recently and never went back to underpowered hardware and unethical practices by Nintendo.

I haven’t been liking Nintendo’s Behavior lately. There game quality started to go down and I was able to find more bugs and glitches that ruined the game experience. In addition recent updates made the switch operating system laggy as hell.
I also see that Nintendo is bullying and suing normal people including PalWorld. To me to it’s just out right insanity. Yes they have the right but it’s completely unethical and immoral.
Honestly I think it’s time we boycott Nintendo and encourage our kids to do the same. If I decide to have a family I will make sure Nintendo doesn’t get a cent from me.
Instead I would build a gaming pc which I did recently and never went back to underpowered hardware and unethical practices by Nintendo.
That’s what always happens when Nintendo gets too successful
