      Why would they go after scalpers? They get their money. They do not give one single flying f*ck what happens afterwards. People need to understand that these companies are not their friends. The relationship is purely transactional.

    This reminds me a lot of the Napster era and all of the legal battles from Metallica and other record labels to shut them down. While most musicians agreed that it was theft, I recall Trent Reznor in an interview making a point about how these people that were downloading songs were never going to buy any of the albums that they were downloading even if Napster didn't exist. It was in reference to the same type of hypothetical that you mentioned on how Nintendo lost a potential $11.4 million in game sales. I don't think that they lost even $100k in game sales because people who pirate will always pirate and will just move onto something else to keep them entertained. I'm sure that Nintendo has greatly outspent any lost profits in legal fees by now.

      Yeah, I haven't purchased any of their stuff in years (how could I anyway? Their games are EXPENSIVE and never go on discount), but all this stuff happening just reinforces my decision.
      But sadly, you're correct: kids don't care, they don't even spend their own money (it's always their parents) so 1% means nothing. This is so sad considering I did use to love Nintendo in my early days. Nowadays I can't stand them. Too bad.

    Nintendo is trying to scare us. I react to fear differently than most people. It encourages me double down on whatever it is I was doing. Not that I was doing anything, but that may be because of my upbringing that I am this way.

    Nintendo has done the full court press against people being able to backup their own games, and playing their own dumps in an emulator, claiming, prior to the current copy protection scheme, that it was illegal. Since it wasn't illegal then, and Nintendo were lying about it, I think it's safe to assume it isn't now and they're still lying about it. But you can do whatever you want when you have millions of dollars to litigate people into oblivion.
    It's a shame a company as horrible as Nintendo isn't actually losing money. They clearly have vastly too much of it.

      The USA does not have a fair and citizen centered court system, they only care about corporations and rich people!
      Why did it not occurre to you yet, that this only happens in the USA, but not in Europe or anywhere else in the world?
      Because other countries have real freedom, democracy and care about their people!
      It is such a hypocrisy how Americans talk about freedom, when they live in the by far most unfree first world country of them all.
      Americans are held down by the corporations with horrible public education and the gatekeeping of higher education behind insane college fees!
      Stand up, you are enabling Nintendo to do stuff like that with your Oligarchy!

    Oddly enough, this case doesn't just show how crazy far Nintendo goes but also that they violate privacy in some way, which is really poorly protected anyway and especially when people share personal data online.
    For the sake of the system's initial success I hope it getting hacked and emulated takes a while, on the other hand I'd laugh real hard if the Super Switch gets emulated within a week at most.

    My guess why suddenly Nintendo seems to be going scorched earth is 1) The new switch hardware isn't going to be meaningfully different enough from the OG switch. They know emulation for it was going to be a trivial exercise for existing and future Switch emulators to expand themselves into. Think how Dolphin does both Gamecube and Wii emulation all in one. Mission accomplished on this front, all switch emulation development is dead for the time being.
    2) They plan to continue to expand the NSO subscription emulation and continue to keep adding "expansion" packs to it's yearly/monthly cost. Since most old emulation is trivial and playing wack-a-mole with rom sites is a waste of time, they are trying to destroy emulation legally (except for them of course). If anyone thinks this isn't possible due to precedent oh boy oh boy have you met the US court system in the last 10 years? It's laughably and comically pro-corporate and no longer has any issue over turning precedent. If they get this in front of the 5th circuit for instance, emulation is about as good as dead.

Some of the old games played on my channel were played using Street Fighter 30th Anniversary Collection, Capcom Arcade Stadium, and Capcom Fighting Collection had usage of an emulator in it (as all three compilations use emulators). Nintendo can claim I'm playing games illegally all they want, but when these are the official rereleases of those games, that means they have zero ground to claim I'm using a emulator on their product. Not to mention, I intentionally make it look like I'm emulating it when I'm not, doing stuff like turning off the backgrounds and including the boot ups of games on Capcom Fighting Collection

      Nintendo has always been like this. They sued Atari multiple times, U.S. rental businesses/Blockbuster, Tengen, etc.
      They should change their logo to a Mario pointing angrily saying "I'll sue you!!!"

    These loss numbers are ridiculous.
    As a kid I pirated GBA games (which was legal in my country at the time). This "loss" is not money they would have gained if I didn't pirate those games because I didn't have any money to spend.
    They even gained money from me pirating back then because that made me a Nintendo fan, which meant I bought Nintendo stuff when I became an adult and did have money.

      I think youre mixed between nintendo emulation and jailbreak. What happened first was the jailbreaking using tegra method found on Nvidia Shield(its mere months after Nintendo release) . The emulation scene itself coming after that and not after a couple of years where its practically usable for casual. i remember Mvg talked about Yuzu when its still in command prompt form that help him test some game he port to switch before transfering ti the real switch

    I’m conflicted. People should definitely stop selling pirated software especially new games. It’s one thing to pirate games; I’ll typically look the other way. Selling pirated copies for profit though? You’re just putting a target on your back.
    Additionally and I suppose more relevantly to this channel, this draws unwanted attention to the preservation side of gaming that I actually care more about. Nintendo doesn’t like emulation, but it looks the other way far more often than not. Its line in the sand seems to be new/still commercially available Switch games especially making a profit on them. Just stop doing that. The last thing I want to see is this crusade acting as a gateway to coming after FPGA core developers.

    It all makes sense why Nintendo is going Hardcore on Switch pirates I think that they don't care about people emulating there retro games and yes I tried to play Switch games on the emulator but I did it legally by downloading pinball fx3 witch is free where and I knowest that the game was encrypted and you have to have the right key no key no emulation

    Good news. A certain emulator variant of one of the recently shut down emulators is on a software host well away from the US.
    I will be vague with the above paragraph because I'm sure the Ninblow feckers are reading the comments under your videos. I won't give them an easy time.
    Will they bother setting up a legal battle in the origin of that software host? Who knows?

    I haven’t been liking Nintendo’s Behavior lately. There game quality started to go down and I was able to find more bugs and glitches that ruined the game experience. In addition recent updates made the switch operating system laggy as hell.
    I also see that Nintendo is bullying and suing normal people including PalWorld. To me to it’s just out right insanity. Yes they have the right but it’s completely unethical and immoral.
    Honestly I think it’s time we boycott Nintendo and encourage our kids to do the same. If I decide to have a family I will make sure Nintendo doesn’t get a cent from me.
    Instead I would build a gaming pc which I did recently and never went back to underpowered hardware and unethical practices by Nintendo.

    They are also attacking smaller devs and claiming patents. None good for gamers or gamers. They can get away. Cause they know people will toss money at them at the drop of a shiny new trailer

    The emulators got pulled because they were selling/leaking games online early to their community which isnt lawful and they got caught. They were also doing other shady practices
