Is there any plan of attack when the debt collector said they use another third party collection agency that specializes in the timeshare industry that actually holds the outstanding debt? In other words, the collection agency seeking payment does not actually hold the debt, another one they use does. Neither of them has shown proof of a debt owed, just a copy of a signed contract.
I don't completely understand your question, but timeshares are different from most of the debt we talk about. It's worth your while to speak with a lawyer who specializes in timeshare exits.
Hello! Am I understanding that if the debit collector has not sent us a letter stating the debit, BUT has called us many times trying to communicate with us, could they be breaking the law?? We have been summoned twice, which the first time we paid, so we didn't go to court...we were scared living in a small town. Then the second one came and we involved a lawyer and the total was reduced than stated. We paid in payments and we thought that was it.....Oh no! The same debit collector, Quad Corp., has now been trying to call us since the end of May and our lawyer found out from Quad Corp.'s lawyer that we owe more....which we have no idea what it is!! WE have not received a letter of any kind from the get go!! Our lawyer asked us to find other guidance in this matter....he's too busy and he normally doesn't deal with this. We now will send this validation and verification letter, so we can be shown what this is about. I'm wondering if they could be sued by not sending a letter to us??? The first time it was a summons to court....nothing by mail at all! The second time, again, nothing by mail, except being summoned. That's when we had a friend, who is a lawyer, to help us. If it's not your debt, they're breaking the law. If it's really your debt, but they're using the wrong social, they MAY be breaking the law unless you gave someone the wrong information.
A creditor has sent a "debt" of $660 to a law firm. They've contacted me today. They are using the new form to allow for me to dispute. This is in MD. The issue is the service the creditor says I owe money for is a service I did NOT agree to. They claim I owe this money for cryo-storage for some viable human embryos that were "spares" when my partner and I used the creditor's fertility clinic services. I explicitly requested all extra material be destroyed once we had a viable pregnancy/birth. The birth in question was in April 2018. They claim I owe storage fees from last year (I think it's just last year). I never signed any agreement to store anything. I specifically signed something stating they were to destroy all material. Thank you for sharing. I responded to your other comment, and the gist of my response is that whether you owe that debt depends on the contract you signed with the storage facility. For example, they may have had a cancellation process that you agreed to but didn’t use.
The debt collector is responsible if they are collecting amounts that you don’t owe. Usually this is priced into the deal with the original creditor when they acquire the right to collect.

It’s for my state taxes in Michigan. It’s for an old credit card debt. In 2019 they attempted to seize my car but at the time my car was 16 years old and the tow guy called me (while I was in ICU) and said he wasn’t going to seize it. After that it was charged off. Fast forward to 2022 and I received notification from the state of Michigan my state refund was going to the debt collector. Not sure what I can do since I’m on SSDI. Help please!
We've never sen that here in Florida. You almost certainly need to speak to a Michigan lawyer who defends debt collection. I don't have anyone like that on my list right now.

But what do you do if the verification that they send is still wrong? I have a debt collector who will only send me an account statement from my previous apartments but the charges are not correct and I told them I needed a itemization of the individual charges and they haven't sent that what should I do I'm in NC.
We don't practice in NC but if the "verification" includes false statements that overstate the charges the debt collectors may be violating federal law. Landlord/tenant cases can be very tough and you should speak to a lawyer in NC who handles that type of case.

What *should* happen is nothing, if the person who stays was never on the account. It is possible that the creditor may confuse the two people, and pursue the wrong person for the debt. That could require a lawyer to sort out.

The trick to Portfolio (you mentioned them in your other comment) is finding out how they broke the la in your case-if they did, most lawyers won't charge you anything up front to help you. They'll get paid by the other side.
Do you want to know how to stop them? First step, tell me whether they are calling you on the phone, writing you letters, or communicating with you in some other way.
You can send them a cease and desist letter in writing demanding they stop contacting you. That should stop it. If they are reporting “old debt“ on your credit report, you have a right to demand that anything more than seven years old be deleted from your credit report. You send that letter to the credit bureau directly.

I don't, either. Look to your contract. If they're trying to collect money from you that you don't owe, they might be breaching that contract.

If it's not your debt, they're breaking the law. If it's really your debt, but they're using the wrong social, they MAY be breaking the law unless you gave someone the wrong information.

It never hurts to try. You can always negotiate.

Black's is a good start. Always know the legal meaning of the words in your court papers.
