India's opposition leader Rahul Gandhi was sentenced to jail after being convicted of defaming Prime Minister Narendra Modi in March.
Now, the Supreme Court has suspended his conviction.
Which could pave the way for the the Congress party chief to make a political comeback.
But this case is prompting questions about India's judicial system, and the state of its democracy.

Although few people, especially the spokesperson of opposition parties & famous journalists, do criticize Mr. Modi openly on news channel debates and social media platforms, they do it a grave risk of getting arrested by ED and CBI. Take Mr. Vinod Dua as an example who was slapped with sedition charges by people of ruling party and had to fight his way back against this. Another example was when BBC's documentary on Mr. Modi was banned and their offices in Mumbai & Delhi was raided by ED or CBI.
2. Even those news channels that allow such criticism are almost non-existent today.
3. Famous news anchors who were critical of the government, such as Ravish Kumar, and many others have been forced out of their news channel to open UA-cam channels.
4. As far as common people are concerned, we are scared of posting any criticism of the government on sites such as Twitter because if it gets traction and starts trending, an FIR will be filed by some supporter / member of the ruling party. And unlike opposition, common person does not have the wealth and resources to take on the state in the judiciary. I am even scared of writing this comment here. I would perhaps delete this after some time.
In short, there is freedom of speech, but there is no guarantee of freedom after speech!

The misuse of independent organization like ED,CBI,NIA,IT is quite evident. Also they are passing bills without debates in the parliament in a very strange manner. They have introduced electoral bonds to hide their transactions, now they are bringing in the Data protection law to make RTI inaccessible to common people. BJP has a complete control on the Indian Media, which even you wouldn't disagree with. (media is called the fourth pilllar of Democracy).
