    To me, the worst one was the Alice one, when an artist made an illustration (inspired by the books nonetheless, not the movie Disney made) of Alice painting the roses, and Disney just took it and stamped in purses and without even asking the original artist

      Wait WHAT?!?! Were they fairly recent? Because I remember Alice Loungefly purses came out and it was the ONLY time IN MY LIFE that I wanted a Disney themed ANYTHING. They sold out and disappeared before I could get one but, if this is the artist you speak of, I will no longer feel regret as much as I will plain outrage…

      @@TheHoneycomb5 Disney doesn’t own fanart of their characters. If I draw a doodle of Mickey Mouse it’s still my art. I can’t sell it because Mickey Mouse is not my intellectual property, but it’s not their right to grab my fanart to sell because my fanart is not their artistic property. In order to sell my fanart of Mickey Mouse, they’d have to get my consent.

    Again?!? Didn't Disney do this at least once before? Could have sworn I saw a video on that.
    On that note, due to the way the legal system in the US is set up it is even less likely, admitting wrong doing actually causes a lot more problems then it solves. It's why most companies or politicians never really do. Yeah, it is a system that punishes you for being a mature adult.

    i remember viria, she was a fan artist who made art for several fandoms. rick riordan, the author of percy jackson, liked her fanart so much that they reached out to her and got it to be official art. that’s how it should be done.

    Someone once told me that when you work for Disney, the company gets to keep the rights to whatever art you draw/create on your free time. God forbid you draw using any program/devices from work on your break at work or had to take devices home to finish work.

    Most times I sell fan art prints at cons and I don't get into any legal trouble, but I do need to have the correct paperwork, like for taxes and permits. Most times the fanart is of stuff I'm a big fan off and want to sell on top of that. I know selling fanart is a big gray area. But I feel most times making and selling fan art can be a gateway into people supporting your own original work. Especially if they like the your artstyle. Most of the money I make goes back into the cost it took make the prints and support my own personal projects.

      @@EEEEEEEEEEEEEEEEEEE3EEEEEEEEEE I sell my own fanart that I make of characters that I like. These are usually from big companies like disney, for example some fanart I did of Big Hero Six. I still sell fanart, but it's not as often because I was able to get a comfortable size of people that support my own original work. So now along with less fanart I can show off my own original projects. And even with the legality of fan art, most companies don't go out and target fanart, even when it's sold, because most times the profits made by the individual artist don't even put a scratch on them.
      But everything varies and this has always been a pretty hot and polarizing topic in the art community. With people landing on two sides of you shouldn't sell or you should. I grew up going to cons were lots of fanart was and has been sold. I honestly wouldn't mind and even love to see Mohammed Agbadi make a video on this topic.

      @@lumintroII when an artist sells the fanart, it doesn't mean they proclaim to be the owner of the character. You can legally sell fan merch without permission of the author if you don't claim copyright.
      And also: what about fans who live in a countries you cannot easily get an official merch without exteremely high price tag? F.e., I'm a citizen of a country where it's really hard to get official svsss novel merch (esp. this Chinese BL novel has the lack of official merch itself), the only official merch I can get in my country is two donghua figures (without ordering it on foreign site and praying it will come to you safe and sound) and bless you don't know how much these figures cost😓😓
      And what's better for a citizen like me who is the most of the country (and the most of our population are poor or poor-middle class) to do? To do a 5-day research to find these donghua figures and go in debts to buy them OR easily find some cool artist who sells amazing postcards, stickers, pins etc. with my fandom for much lower price? You already know the answer.

      @@lumintroII So you believe if the fanartist sells the fanart, they sell not their works but the author's who did the character. How you can steal something if you don't claim copyright and creating it by YOUR own hands? I don't understand it. Maybe, you has the point the og author doesn't make a profit from a fancontent but trust me, it's actually not. The author ALWAYS gets a profit from the fan content and the biggest profit of it are: recognizability and popularity. Why do you think Genshin became so recognizable? Because enthusiactic creators promoted the game with their fan content. If the fan content is strong in the fandom, it'll give the story a good popularity. Without fan content, the story, unfortunately, will be easy forgotten forever. I'm so glad some people still do fan content of the unpopular stories which are forgotten by the society. And you believe it's more "ethical" for fan creators to spend their time, sources and even money to create a fan content for free? As I said, it's still legal if you don't claim copyright.

    Regarding selling fanart and such:
    You can copyright a brand, an image, a name, etc, but not a concept. Even if a piece of fanart is inspired by disney, a girl with a long blonde braid and a blue dress cannot easily be proven to be Elsa. That's the reason fashion companies can release very similar garments.

      There’s a reason why Disney is so notorious on copyright strikes; most of the other sources of fanarts like games, comics or cartoons coexist in the same sphere, you see them side-by-side at artist alleys on every con. Disney, as a soulless corporation, will not look at the community of creative fans as a positive because all they care is $$$.

      @@biazacha but it's a matter of power and small creators being unable to entangle in a legal battle against a titan. The law would usually side with the creators. Copyright would be printing official art to sell as posters. Fanart would only touch on trademarks, and only if they're explicitly using the names and logos.

    I feel like every artist needs to have some weird marking on their art if it’s sculptors traditional artist on paper and stuff so you and other people can identify it. Make it where it’s no standing out but it kinda blends in and only you know so you can catch the people stealing it.
    This is so messed up that’s why I didn’t trust the Adobe x Billie Eilish bc of stuff like this. It’s crazy.

    If you work for Disney, their standard contract states they own all IP of EVERYTHING YOU MAKE during the time period you are employed by them, regardless of what it is, who it's for, and whether it has anything at all to do with the project... if any portion of this was done while he was working on that UP model then Disney does actually own it.
    A side effect of this contract they make you sign to work with them is that there is actual, Disney-owned, OFFICIAL R34 ART of every single Disney property ever made. Because when Disney will claim the ownership of every single thing you work on, why work on any of your stuff you want to keep? So Disney workers make tons of Disney related stuff, and a LOT of it is NSFW art. Which means Disney, per their contract, owns. And is therefore official Disney work.
    Doesn't change the fact that the guy who stole it tried to pass it off as his own, and Disney has likely put a boot up his ass, but there is a possibility that they do actually own the statue.

    Something similar to this happened to Sasha Kawaii Cat when she made fanart of a female version of Steven Universe last year. CN decided to use her work for an ad without her permission. I think they settled it eventually. It is quite baffling and sad that these companies are allowed to take fan art and claim it as their own, yet have no issue coming at artists who promote and sell fan made work

    Hey, the title of this video is a little confusing. When I clicked on it, I thought it was going to be about the team members that specifically worked on Encanto getting into trouble, but this is a story about a completely different part of Disney, and I feel like that makes it a little misleading. The people who are considered the "creators" of Encanto" aren't the same as the Disney merchandise department, much less the part of merchandising that handles the more artistic stuff that's sold in the parks and on the website. There's got to be a better way to word that that's more clear while also being catchy (I'm assuming you worded it this way to be catchy, but correct me if I'm wrong). Because this is a really interesting story to hear, and we should have a conversation about it.
    Forgive my tangential train of thought here, but this is something worth thinking about. Disney is less a creator and more of a platform these days. When you look back at the older Disney works and films, the team who made them differed for sure, but it was a lot of the same people all working on the same stuff within their respective eras. Now, with the company having the rights to so many properties, as well as having so many different teams, it feels very different. When I look at some of the stuff produced by Disney these days, I don't think of it as being produced by "Disney," there are actual names attached. Gravity Falls may be licensed by Disney, but that's the creation of Alex Hirsch. The Owl House may be on Disney Plus, but that's created by Dana Terrace. Encanto may be a Disney movie, but it had a lot of people, old and new, that were a part of it. The big name I associate with it is Lin Manuel Miranda, and while none of these creators are responsible for the entirety of the creation, they are a major part of it. Their names are the ones that come to mind, Disney is just the one holding the purse. And I'm not alone, there are a lot of people who think about it this way nowadays, which is both good for those individual creators and not so good for Disney if they get into some disagreements. Some fans are much more willing to rally behind a small, hard-working individual than a massive corporation. I dunno, I just feel like your phrasing makes the wrong team look bad here, and the party who's actually in the wrong should be the one pointed to in the title of the video.

    German artist here: So selling fanart on cons here is a grey area. Most cons will have rules, that a booth can have fanart up to a certain percentage. Another thing is: When the anime boom first swapped over Germany it often took a lot of time before new manga/animes were available and they internet wasn't yet, what it is today. So instead of fanart, artists made OCs and own stuff in manga style, shared it online and sold it on cons. Therefore original artwork is dominant here on most cons and having like 50% or more fanart on the booth as a private seller is a NoNo. But still fanart is ofc a gateway for artists to draw in people. Especially Pokemon is always a winner.

    I was there when this stuff went down and so many shifty people were taking Disney's side. I actually had a class on copyright and he wasn't the one that broke it but Disney. If he made profits off it THEN I can see people taking Disney's side. Then some said "well he put it in the public" and that grinds my gears, had to tell them several times that the copyright he put on was one that made it where anyone can use but can not use to make money.

      He was selling 3d prints of Disney's characters and this was not legal. He shouldn't do it. I am not on Disney's side, to me they are an evil company. But the irony is there: He stole from Disney and made profit from it and then Disney stole his design.

    Regarding fanart prints and merch sold online and at conventions...in all technicality it isn't legal and the artist can get in trouble at any point. But usually major corporations don't care enough to go after some rando artist making 'pocket change'. It's just not worth it to them. Worst that happens usually is the work being quietly 'delisted' on the site selling it with no other penalty to the artist. This isn't the case for EVERY IP and there are some exceptions.
    For instance, I've heard of Sanrio being aggressively protective of their IP and convention artists getting in actual legal trouble if they get caught selling anything with those characters. You can draw fanart all you want but selling is off limits.
    Also, mass production will get corp attention. They don't care if you're making prints, charms, etc because it's a drop in the bucket. But if you are producing your work on a scale comparable to legit merchandise they shut that down because you stop being 'free advertising' and start cutting into what they believe are their profits.
    While you can't reach out to major corporations and ask 'hey can I sell my fanart of your stuff', a lot of indie games encourage it (as long as you dont use their official logo or mass produce). In most instances, it's viewed as free advertising and keeping the product alive. Also companies will look at fanart and if they like what they see, might even reach out to the artist and hire them for official products.
    In this case, since Disney has already hired this man once before...I really think they should compensate him and apologize. I'm surprised they haven't made some attempt to keep him quiet and pretend this hasn't happened on all fronts.

    In regards to [selling] fan art, the short answer is it's not legal. When someone creates a character, they hold creative and intellectual rights over that character. But it's a little complicated. Most companies see fan art as a good thing as more people are talking about and advertising their product, and many will not be bothered by independent artists selling their fan art (So long as they make it themselves) because to quash an artist can backlash into losing fans. However, some other companies can see fan art being sold as taking away customers thus will want to stop it.
    On the flip side, Styles can't be trade marked or copywritten, so if you want to make your own character in the style of something else, say draw yourself as a disney princess, that is 100% legal so long as you are not calling it "A Disney Princess" because the term "Disney Princess" IS trademarked.
    Edit for clarity, this is in regards to SELLING the art, or making money off it in some way. Fan art for personal use, gifts, or general enjoyment is fine. Sorry for skipping over that part.

      No, fan art itself is fine and protected completely by fair use and derivative works. The only issue is selling it, which is directly illegal without permission, people get away with it because they do it against major brands and franchises that don't care anymore.
      There are a lot of indie stuff that allows monetized fanart, though.

    It’s sucks too that this manager tried to claim they designed it and they have worked there so long, it makes you wonder what they did to get that job in the first place. And what they teach their staff to do.

    Neopets used to do this, back in their heyday. There were several times they were caught (not to mention all the times they weren't) stealing fan art from user's pages and then using it as official artwork on their page. Even when they were confronted, they said that they owned the legal rights to the characters, so it was theirs anyway (Their logical error, not mine.). Considering how much bigger Disney is, I doubt they'll do anything more.

      Had someone in a Discord server I'm in trace some art of mine that id posted literally like.... A day prior. They weren't selling it or anything and just said smthn like "trying to practice a lil" or something to that extent. I immediately recognized my own style and jokingly posted an image of my own piece overlayed on top of "theirs" with a lower opacity and I commented "damn that looks kinda familiar...". I basically had to hold the rest of the server in that channel back from unleashing ultimate mayhem on them. I genuinely just said something like "I'm gonna assume you're younger or something, or just don't have much experience with this stuff yet. Art tracing is almost always seen as incredibly distasteful and even worthy of condemnation. You admit you traced my art and that you'd done it for practice. Many artists arent okay with that, but you're lucky I'm the one you trifled with, because I'm actually hella chill. You gotta ask the artist man, for me I'll almost always be okay with it so long as I'm credited as the "original" base artwork and the piece isn't being sold. You can't just be doing this without asking or crediting when sharing it though, that's really not cool man." I was honestly honored to have had someone go "yes, this is the art I favor and wish to practice with", but they gotta know how to do it properly

      The “original” artist would have no basis for a lawsuit since their artwork was literally a copy of something from an earlier Disney work. I feel like no one that is commenting on this video is even watching it.
      The guy created Disney fan art based on a statue from a Disney movie, and then got mad when Disney sold the same statue that looks exactly like the one that was originally designed BY DISNEY IN THE FIRST PLACE.

    as a first-year game graphics production student at a school that also teaches 3D animation, this is absolutely disgusting. if anyone is caught stealing artwork from the internet, they are immediately expelled and blacklisted in the industry as well (whether or not we're talking games or films) so they will never find a job
    you are allowed to take inspiration like in the style or workflow, or the way the artist uses colours or shapes to portray an idea, since we do need to learn how to effectively use different styles in our work so we are able to adjust to a particular art style our companies might have later on. copying, however, is never allowed. we take this incredibly seriously, because it's a matter that has to be discussed as such
    it irks me that these big studios are able to get away with exploiting other artist's works without facing any consequences. alumni from my university have found their way into big studios such as pixar, disney and others of course, but i sure hope they would never do something like this
    learning these skills takes an incredible amount of time, effort and dedication. you would think that if an artist working at disney didn't have enough time or anything like that to finish something (which is why they could potentially steal something, to hit a deadline), disney has a big enough budget to hire more people and make sure their work isn't stolen. very disappointing

    It is disgusting that this still continues to happen. Where fan made works are stolen/plagiarized and then the ones responsible profit and pretend that they made it. This reminds me of another recent instance of this happening with a Nintendo e-shop game called Beach Boys. That Thoma fanart was stolen and recolored it to use as the main cover art and re-colored Grandblue official beach sprites were used in the game. This game is still on the Nintendo e-shop for 4.99.

    Copyright in relation to fanart is important to understand as an artist. Fanart still uses someone else's intellectual property and is therefore illegal to profit from. Most people are not taken to court for it because a) it's usually not worth the effort to pursue and b) at least some companies who own the intellectual property fanart is being made from see that fanart being shared could ultimately lead to more profits for them as well if it gets more fans more into their IP or at least they don't want to get a bad rep with fans whether or not they are actually okay with them profiting from their work. They're not at all obligated legally or ethically to be okay with other people profiting from their work even with something as innocently labelled as fanart.
    It does not become public property just because it is popular.
    The IP is still owned by the original creator or whoever else has legally been given the rights to it, which opens debate about whether the owner of the IP has rights over the fanart. To some extent, yes, in that the content is still their IP even if in some other style or scenario. However for profit and reproduction? Generally, probably no, if it has been created in a way that adds your own intellectual property to it. Fanart is not entirely yours and not entirely theirs. So, generally they should not be allowed to claim credit for or use fanart made by other people. However as the original IP is theirs, I wouldn't be surprised if a judge ruled in their favour over such a matter. I would imagine the IP owner could still use the fanart as inspiration within their IP, but they could not recreate or reproduce or sell the fanart in the exact form of the fan artist. So what disney did here is definitely wrong and they probably did it knowing they're rich enough to get away with it with any legal proceedings. The fanart creator was arguably also in the wrong, but I think to a much smaller degree. He did the right thing not selling it, however disney would probably still be within their rights to be upset he was making something created from their IP available to everyone for free. I think the most likely reality is unless explicitly stated otherwise, no one should be profiting from fanart, either the artist who made it or the person who owns the original IP.
    Making and sharing fanart may well usually fall under fair use, but profiting from it does not. They may be big companies with more money than the individual artist, but that doesn't make the artist justified to look at themselves as robin hood, somehow rectified of their crime simply because they're poor and the people they're stealing from aren't; without permission, profiting from fanart is stealing, regardless of how successful the person you're stealing from is.
    It can be tempting to use it. To see if we can get a small slice of the pie someone else has prepared and cooked. But it is definitely not fair.
    Educate yourselves on copyright laws, artists, before you consider selling it.

      To add, there are narrow avenues in which you can legally profit from fanart, when the rights are legally obtained. For instance, redbubble has the rights to sell merchandise with fanart from some franchises they've got agreements with. They make it very clear which franchises they have those agreements with and when those agreements change. You're unlikely to make much money from it as redbubble takes most of it anyway and of course some will go to the owner of the IP, however unless you have direct rights yourself it's the only way to legally make money off your fanart, to go through another company/person who has obtained those rights (and the rights to extend them to you in specific context such as selling through their store) and they will have a copy of the terms and conditions of that agreement and how it affects you.
      I know there's a lot of artists who make money off fanart without permission, who've even built a name for themselves for it and who have fans of their own who love it and want them to continue and hate the idea that it's not allowed, however even though you're unlikely to get prosecuted for it, it is still theft and it is still illegal and immoral. We hate seeing art from artists we know and admire being stolen. We should extend the same sympathy to artists who happen to work with bigger companies too.
      Unpopular opinion probably, but it needs to be said. Too many artists claim ignorance on copyright or simply refuse to educate themselves on it because they think they may get away with it easier by being able to say they didn't know. It's your responsibility to learn.
      If you wanna make fanart just to show people, just to share your appreciation, that's great, but if you want to make money off your art then put the time and effort into making your own original stuff and building your own audience for it.

    I remember this happened last October with Cartoon Network. They traced fanart of Nora Universe (gender-bent Steven Universe) for a Halloween tweet and it blew up within a few hours of it being posted as many replies called them out for their blatant theft, complete with evidence of similarities between the two and how the original fanart was posted on Tumblr several _years_ prior.

    The topic of fan art being sold is a tricky thing to understand cause alot of artist myself included go to conventions and events and sell fan art, and merchandise (buttons, pins, shirts, etc.) that they have drawn or designed of popular shows or games, comics, etc and I have yet to run into a problem I guess because it has to deal with the artstyle you work with cause that's how alot of artist make their living by making and selling product they design of things they love not all artist sell fanart I'm aware but some do solely sell fanart of characters and designs so it's a difficult answer here cause I've never ran into problems before but that doesn't mean others havent or have

      @@ohshinoyoku like I said some artist dont even sell fanart and sell their own characters or designs but some like myself have realized that fanart is more likely to sell then your own original character because people will know it more and be drawn to it my sister once sold nothing but her OCs when she first started and it didnt do well she had to adjust to her audience and now she sells more fanart and merchandise along with getting her own designs brought into light so alot of artist use the method of selling fanart to get people attention and a fanbase once they feel more confident that their work will sell they start to bring out their own OCs and designs I started out small with selling fanart and grew so this year I'm starting to release my own OC designs as prints or keychains or even my mascot I use as merch so it depends on the artist and what they're trying to get recognized I cant speak for every artist but this has been my experience as an artist trying to sell at conventions

    I would just like to point out that this model is under a creative commons license. This specific variation of the license (CC BY-NC 4.0) that means you may use the art (without permission i believe too) BUT you must give appropriate credit, and you are not allowed to use the product for commercial purposes. Disney broke both of these rules, which means that theyve broken copyright law and the dude that made the art can hold them accountable!!

    When I was new to the internet I would use artwork from other artists for my own Facebook page at the time. I didn't realize what I was doing was rude and wrong untell my sister told me that it was wrong that was when i realized that I should not be doing I then started to do traceing and. I eventually got fed up with that so I just started drawing th things on my own becouse of thoes experiences. I have become a better artest and person you live you leirn.     These days people are just too lazy to give credit to people who appreciate and enjoy their work. Like how much money would Disney lose if they collaborated with this talented and already well-known artist? It's a no-brainer that those people in charge of the product were just too lazy and lacked consideration in doing their jobs.
    Despite being a part of my childhood I'm slowly losing my respect for the company and people who do these stunts.

    While it is legal to create fan art, distributing and selling it is illegal (copyright infringement) and may invoke copyright lawsuits. While most creators will not go after every fan art creator with a lawsuit, it is important to know you're breaking the law by selling an idea that isn't original.

    Speaking of those art reposter instagrams, I actually had my art stolen by one and was notified by someone that followed me. Apparently this one had done it to many and didn’t even bother messaging for permission or crediting. Fortunately enough, they were reported so much that Instagram had suspended them.
    This is what made me scared to post my art on instagram for a few years after that.
    Sad, that Disney would do this to artists who are literally their backing in everything they put out.

    Sadly, I think Disney are in fact legally allowed to do this. I've seen statements on webpages of other large production companies that say they as the copyright holder can legally take control of any fan art and do with it as they please as if they were the creator of the piece. Of course, most of the time they don't actually follow through on this...

    If any of y'all are familiar with 5 nights at Freddy's, a similar thing happened a couple years ago where the creator of the franchise used fanart in promotional work mistaking it as their own. Game Theorists have a great video on it that goes into detail on what happened

    I think when it comes to the selling fanart thing, Disney in particular has been very aggressive in taking down fan merch sold for profits.
    Some companies are more lax in the sale of fan merch, since picking off people essentially selling about 100-200 pieces (posters/prints may have more numbers) of merch at specific times isn't going to be worth the effort. It tends to be up to advertising for them, you making a twitter or tumblr post about your next stock would usually let you get off without much issue (not too sure about advertising fan merch via youtube). Disney, for all of them being a multi billion dollar company, loves to snipe down fan merch that is being sold no matter the size of the artist.
    Hell it's very annoying to get disney to approve on using their ips for charity without them trying to take a chunk of the money

    Asian fandoms usually sell fan art merch but only for the production cost, it has a name but i can remember it lol basically they don’t make profits and do it for the love of the fandom

    okay I get the little marks being exactly the same, but didn’t he make the mini model from the statue that Disney did own and design already in their park?? If you make a model of their model and then they also make a model of your model which was of their model, isnt that just a model of their model?? i’m kinda confused tbh

    First off artists deserve credit however legally disney or any company has every right to do whatever they want with derivative works people make. Technically it is all infringement of copyright so it doesn't have the same protections under the law that original work does. It is wrong they did that but legally that is the risk with making fanart and publishing it. The artist did not deserve to get his work stolen and made into a product so morally disney is in the wrong

    I can't believe it. That's ridiculous . I really think Disney needs to own up and apologize and fire that person who stole his artwork,cause that is just not cool at all! So o hope disney at least apologizes and pay him for his time and effort maybe give him a few hundred bucks or something like that to compensate for their stupidity. And if o were the artist I might think about take them to court and during them.

    edit: fanart generally comes under Fair Use laws, and companies that come down on it are blacklisted in the art community extremely fast. it's why Ken Penders' character have next to no fanart, his opinions aside; he's an absolute beartrap.

      If companies are blacklisted for coming down on fanart that makes the fan artists profit then honestly screw the parts of the art community doing that. It's extremely hypocritical. We hate other people stealing our work, taking credit for it, profiting from it, etc. To think it's justified doing it to a big company just cause they have more money of their creation is popular is ridiculous. It's just willful ignorance to justify greed and laziness. Don't steal and don't cancel people for calling people out for stealing from them.
