It is easy to miss the point, which is: Jon Gruden sent a private e-mail to a friend at a time when he was not in the league in any capacity. The e-mail was sent over 10 years ago. This case is not even close. Gruden is 100% right and I think he will win his lawsuit. Goodell may be within his rights to investigate the owner of the Washington Commanders. But in the course of that investigation, if he finds an email from a private citizen (Gruden) who is known to have nothing to do with the NFL investigation, Goodell can't release that information to the public. He knows that it will end Gruden's career in the NFL, so it is malicious and libelous. Who does Goodell think he is? Inspector Clouseau? The FBI?

Goodell figured that Jon Gruden would have been so ashamed of the emails that he would quietly resign and never fight back. The fact that the NFL tried so hard to get this case resolved far away from a PUBLIC ( via paying Gruden a few million bucks to be quiet and to go away) COURTROOM setting shows you how guilty the NFL feels about this.
They don’t feel guilty, they just know fully well that they’ve broken the law, again.
I’m not sure it’s about them being shamed or feeling guilty with Gruden, it’s more along the lines of other emails containing incriminating or more socially unacceptable emails that will come out in discovery and bury the league.
Goodell is a prick and needs to resign. This is the very minimum that must take place.

I know someone that worked for an NFL team front office and he told me some players mess around with cheerleaders, chefs, trainers and some at the front office as well and most are married. I bet there’s a lot of dirt in those emails.

Van Atta's analysis misses one factor - hubris by the League and the Commissioner: the belief that 1) they are so big and powerful that no one sane would dare to take them to the mat, 2) Gruden wants to be in the club and therefore will quietly take his "punishment" for fear that "burning it all down" would ruin his long-term desire to be back in the club. But strength of conviction does not work that way - Gruden believes the League was underhanded, wants his reputation back, and so he's not going away quietly.
