You need to notify USCIS that your wife's I-130 is already approved and ask them to expedite your daughter's case.
I have been documentary completed on April 2023. PD is also current (EB-2 NIW). Do you know how long it might take to get the Interview Letter (US Embassy Frankfurt Germany)?

Something does not sound right. He should not be able to sponsor you if he does not have his own green card, unless you are a derivative on his case.

hello Audra, thanks for your info! Question regarding F2B: If there are two persons. Both of them's PD are current. PersonA's PD is half year earlier than personB while personB's DQ date is one year earlier than personA. Who will get the interview first?

Great reference info. We've been documentarly qualified and complete since Aug 2021for an EB1 in Canada and we're still waiting. I hope your time reference replicates in my case. The means we should have the interview in June of 2023 🙏🏻

First check to see if your visa is available. If it is, then it would not hurt to contact the NVC.

We got documentarily qualified in January 2024. Waited until May 30 2024. And found out that our file was never submitted from NVC to the US embassy yet. Is that normal? Or should we expect to wait until next year? We appreciate your kind advice. God bless you.
That does not make sense to me. Once the case is documentarily qualified the NVC should notify the Embassy. Is your visa not available?
@@AudraDoyleImmigrationLawyer I am not sure what is going on really. When we reached out to the US embassy they said that the NVC hasn't forwarded the file yet. I was told that it was a normal process when the US embassy doesn't have enough room for more interview schedule. Then when the US embassy has more capacity to accept more interview, they will ask the NVC to send more over. And my CEAC status says, currently at NVC..
@@CJRey-e3x Got it, so they did contact the Embassy and the Embassy knows that your case is ready for an interview. They are doing the correct thing. They hold the file until the time of the interview.

Hi, thank you for the video. I received a message from NVC saying "please submit every 2022 W-2, 1099, and Schedule form" for my joint sponsor. My joint sponsor only has w2 and does not have 1099. I already uploaded w-2 but what do I do for 1099. Can I just ignore this if he doesn't have it?

It depends on the Embassy backlogs. You may need to file a mandamus lawsuit.

What do you mean welcome letter? Is it from the NVC? They may not ask you to pay the fee until the visa is available. Please go review the visa bulletin.

I would count on at least 1 year and maybe 2. No idea - you can fight them on it or get a new one. Good luck with your case!

Both. You must be DQ and priority date will likely be available or close to available at the time of the interview.

I’m glad I came across your video. My husbands case was transferred to Islamabad embassy last yr. His case has been documentary qualified. It’s been 4 months. I email Pakistan embassy and they said they don’t have his case there. Does it mean that NVC has never transferred his case or they don’t have documentation? his case number is from Islamabad.

Islamabad is one of the slowest Embassies. Also check to see if your priority date is available on the Visa Bulletin.

They sometimes conduct interviews even if the PD is not current, then wait for a current PD to approve the visa.

It may be that many cases are available for an interview but the Embassy does not have appointment times available. Even if you are documentarily qualified plus the priority date is available, the Embassy must have available appointment times. You may need to file a mandamus lawsuit if you want action on your case.

What if someones marital status change after DQ but its not updated in your home country database? Should one go for F4 immigrant visa interview? Would they know?

Unless there is a life and death emergency I do not think they are going to expedite your visa interview. My most recent client's case took 2 years! :(

We have received a interview date for his visa and I was checking on CEAC I filled out the I-864 and submitted my irs transcript and it said everything was accepted and now it says I’m missing the I-184ez and my W-2 and tax statement. Im doing this whole process on my own and I need help. Do I fill out the I-184ez and submit the other documents they are asking?

I would follow all instructions asap. They may ask for these documents at the interview.

I have a question regarding NVC one-year contact requirement. Is this the maximum time we have to submit our case to NVC for final review or is this just for contacting NVC? The NVC is not in control of your interview date, it is the Embassy in Manila.

My question is in June 2022 I got two messages in the same time the first one say 'this case does not meet the minimum income requirement to sponsor intending immigrant. To avoid delays an additional Affidavit of support form I-864 from joint sponsor may be submitted . The consular officer will make a decision regarding this requirement at the time of interview .' And the second one is 'Documentarily qualified '. What should I do? Thank you .
It is your choice. For my clients I would tell them to get a joint sponsor.

She needs to send the NVC a letter explaining that she does not work.

Good for you! Was it for an immigrant visa interview at the proper consulate? If so, hopefully that will work for you. Normally the consulate will tell you when it is time to schedule the interview.

I don't have info about those - check out chatrooms that are about those two Embassies and compare. Also look at nonimmigrant wait times, that is another clue.

You could get an interview at any moment. Who is handling this for you? Some noise needs to be made about you aging out.

My father has been documentarily qualified since May 2021, and we have been receiving the same email every month ever since which states that my father is documentarily qualified. We live in the Philippines, is it possible that my father's visa has been misplaced or neglected at the embassy?
Nope maybe he is not current on the visa bulletin which category and what is priority date
@@johnvykens4585 His father is probably his immediate relative which makes him not subject to the visa bulletin, so the likely reason is that they are behind schedule like many other Embassies.

If they only send welcome letter through email Can we download and bring that letter for interview or we need to wait for hard copy of welcome letter. Which address they send us letter?

You won't get a welcome letter, it will be an interview notice when the Embassy has a spot available. Usually for my clients it comes by e-mail.

Why can't something legally done to go after these embassies. They are destroying family life's some die before they come. This is not one bit fair. We paid our money we need our spouses

My husband's case is DQ'ed as of dec 2022. I was told it could take another 12 to 18 months. I really need him here sooner. Am losing 2 months a yr of work as a physician to visit. Sucks.

You're welcome! Yes, it should put you ahead of those who have later priority dates. However, I cannot guarantee that the Embassy is organizing its interviews that way. I hope that it is.
