I cancelled last night and didn't get charged the £75 termination fee. I simply typed the following in the chat and copy pasted it to any of their responses. "Close my account and do not charge the termination fee as it wasn't clear when I signed up there would be one. I don't want any offers of free months, just close my account." I got bumped to a manager and he closed my account and confirmed i will not be charged any more.
But, we shouldn't have to do that. THEY need to fix that shit and we have no obligation to change for their bullshit tactics.
if you accept the free months, it locks you into an annual sub and if you cancel that before the year, you get fined a fee

Adobe is not only not sorry but they keep pushing very unfair terms of use.
Nowhere does it says that the license you grant them applies ONLY to the specified cases.
That means Adobe can give any other reason to use your work in any way they want and there is nothing in the terms to say otherwise.
Sure, you have one person saying in the video “we can’t use it commercially” etc, but show me where is that written in the agreement. It isn’t.
And what good is my ownership of my work if corporation like this has a full right to do anything it likes with my work?
What benefit it is to me to be the owner if I have no control on how my work is used?

You need my permission for specific use cases that are fundamental to the mechanics of the software and cloud services. Sure! Ask specifically for that and I will grant it.

25+ year user, loved you until you went subscription, hated you since but put up with you. The other day I finally cancelled, your problems are wayyy bigger than these TOS. I've spent 30-40K on Adobe over the years at the various studios I was in, you're welcome, but you won't get a penny more, only save from here imo is a perpetual license option with locally ran software not having to be connected to the internet or sending any data as a default opting me into bs.

Not a good sign when in a relationship someone responsible for a decision send you a lawyer to clarify you some stuff.
Did you explicitly ask photographers who submitted images to Adobe Stock for their permission to use their images to train your AI that will ultimately make them redundant? Did you offer to pay them for using their images to train your AI? If not, why not?
Maybe you can search on google. There's a faq with this exactly questions.
For anyone curious - The answers are:
No - They only even told them after the model had already been trained.
Kinda - They paid some, and it was a pittance. So little in fact they lowered their payout terms significantly for a while so people could get even that.
And because they gave themselves the permission to - They used the same "improve our services" clause they mention in this video in the stock agreement, to claim they had the legal rights to it all. They made no mention of intent to even pay anyone, anything at all, until there was backlash.
Just canceled my adobe subscription and still use their software but form an old friend :) blocking them from accessing my internet connection. I don't want to send my data to a company that want to replace me with AI, I love what I do and I view myself doing exactly that 40 more years from now . If Adobe dosen''t come with other update that says clear they where wrong with this terms update and will remove it, I will not start again my subscription

Probably they'll leave you off the hook right now if you cancel prematurely. Just contact them via chat and tell them to.
If they won't - i would consider pressing legal charges - if they are being sued now by the government, chances are that you will go through with it.

It was so obvious that the ToS said "you own the right to your content, but you give us permission to use them however we want, no strings attached."
And then, you clearly held users files hostage by stating "if you don't agree to the new terms you can't access your files anymore"
What assurance do we have that this won't happen again in the future?

Videos like this will not help resolve the situation. We are dealing with a situation where customer dissatisfaction has accumulated for years, and now a critical mass of discontent has arisen. The situation with the new parts of the agreement was just the last straw. Therefore, the wave of abandonment of Adobe products will increase. This could be prevented by giving people the choice of buying a permanent license with limited updates or a subscription. Until Adobe returns permanent licenses and until there is a process of quick unsubscribing without loss, the company's problems will only increase.

Yes, this is much clearer, now we have trust in you after giving a few EXAMPLES of some of the updated terms. Sheesh. Nothing has been cleared and haven't given confidence in your "limited" license, still far too broad. You also said you don't use it for generative AI, but that's just one aspect of machine learning, which you have mentioned in your terms. The license you want us to accept still seems like you have rights to NDA-protected material. You say you don't track any files stored locally, but what's to say you don't track it whilst we are working on such material? Ambiguity in your favour, not happy with it.
After the backlash from the community, it seems like you wanted to re-word your terms, not change them. It's like "we are sorry you users don't understand our updated terms, let's dumb it down for you without changing the terms. We will give you examples on how our sublicense works that will win you over, but truthfully, we are still using your works for our benefit, not yours." - meaning they are not listening to creatives and their customers, they are doubling down on their terms. Personally, I won't be renewing, and I don't think I'll ever come back. I'm not sure you will win back others as well with this disappointing video you've put out.

Sometimes as a photographer I lose a client and I never know why they go with another photographer. The situation for Adobe in this matter is completely opposite of that. Your users (such as myself) are not happy at all with the TOS and how it all has been handled. I have been using Adobe Photoshop since 1999. My yearly subscription is up on the 22nd. I have cancelled my renewal and cancelled my subscription to Adobe Premier. Unfortunately corporations in their bid to make shareholders happy and generate profits is very much shooting yourself in your own foot in this case. You have good competition out there which is much lower in cost and without all of the headaches. There will be people at the top who lose their jobs over this. Sounds like the decision makers are suffering from group think and they will pay because of it.
I dnt understand why companies do this to themselves. I mean are they backward or did they find this new idea good? Or why do they want to shoot themselves in the knee ? I really don't get what's going on right now.

Switching to Affinity, Davicni, Krita and Blender - that can do the job as well, are not subscription based.
And by now - they even surpass you by far in running stable AND run on Linux.

The exampe to need a license to publish to youtube sounds bogus to me. That would be like Apple saying they get rights because I have a MacBook. That example made no sense. So are you saying since I created a video with Premiere Pro and publishied to UA-cam you now have a license?
if you share the video through frame IO for example, yes - that does require a license because it's technically performing the video publically. And shocker: youtube has the exact same terms in their TOU: "By providing Content to the Service, you grant to UA-cam a worldwide, non-exclusive, royalty-free, sublicensable and transferable license to use that Content (including to reproduce, distribute, prepare derivative works, display and perform it) in connection with the Service and UA-cam’s (and its successors’ and Affiliates’) business, including for the purpose of promoting and redistributing part or all of the Service."
When you publish DIRECTLY from Premiere to UA-cam, you are giving them the license to port that work from PP to YT. If you export and then manually upload to YT, then it doesn't apply. If Apple has a way (maybe they do in FinalCut?) of going from the app to UA-cam, then they have the same licensing. Though it would be via the user agreement on FCP and not via your MacBook Pro.

I have a question for you regarding the nude photography I occasionally do.
Who decides for you that it is good or bad. I'm not talking about photos of children, I'm talking about photos taken with consenting adult models. I'm sorry, but I'm going to have to ask you. Which trains the AI to accept or reject our photos at Adobe. A Democrat, a Republican, a religious fanatic, an atheist, etc. You see, it can go very far. When we send a lawyer to explain the things of life in photography, we have a serious problem.

You're cute. Why is there "sublicensable" aspect to that required license? You don't need that for content moderation. It's simple as that.
Btw "We don't train generative models on your content." Yeah. Two problems here: The lack of past tense. (So you probably did train it on user data at some point.) and the word "We". Even with this excuse the T&C still grants you the full rights to outsource the training part to a company outside of Adobe and license them your user's content thanks to that aforementioned sublicensability. 🙃

Nutzer auszuspionieren. Überdies schreibt Adobe ihnen vor, was sie zu tun und zu lassen haben. Adobe ist aber nicht mein Kindermädchen! Schon gar nicht möchte ich, dass meine privaten Bilder von irgendwelchen Hanseln begutachtet oder genutzt werden. Auch nicht von KI! Aktfotographie ist ein legales fotographisches Genre. Auf Aktfotos sind Personen abgebildet, die dem Fotographen (!) für den abgebildeten Körper eine Lizenz gewähren. Diese hat zunächst niemand anzusehen, ausser der Fotograph und das Model. Adobe betreibt mit seinem Ausspionieren die reinste Persönlichkeitsverletzung und greift in intimste Bereiche ein.
Man stelle sich mal vor, Makita baut Kameras in ihre Akkuschrauber ein, um zu überprüfen, was man damit macht! Und wenn man etwas macht, was MAKITA nicht gefällt, dann funktioniert der Akkuschrauber nicht mehr. Das ist doch schizophren!
Und was machen die ganzen Programme, die nach beenden eines Adobe Programmes immer noch hartnäckig weiterlaufen und ins Internet konnektieren??

Jessica, there is no need to talk like it's a Sesame Street. This is not "easier" to understand. Readability metrics were not the issue.
There are no words to describe Adobe any longer. When I'm done with the next project, I'm done with Adobe. The alternatives are now good enough and in some important ways better. Saying that as a cert. Adobe expert since 1998. When even the US government sues Adobe because they're mistreating and exploiting people like phishing call centers in India, it doesn't matter any longer what they say and what they do. By paying them, you're rewarding sociopaths who think they deserve to be able to steal from you because they think they're smarter than you.

the language was not an issue. We get that we pay good money to use Adobe apps and it forced their costumers to agree to a ToU that let Adobe acess personal files for whatever reason they see fit and potentially use it to "improve their products" (we know it's AI).
Funny thing that you have to opt-out also directly on Photoshop app, which means it's not only cloud files that Adobe seems to has acess.
Costumers couldn't even uninstall the apps or acess their clouds without agreeing first. That's very predatory.

I have been a customer for 6 years but no anymore, just unsubscribed and deleted my account. I loved working in photoshop and even looked forward to finally be able to afford it when I was a teenager and was glad to be able to use when I got my first job, but now I will look into another software. I do not give you a license to MY work. I dont care what things you claim you are going to use it for, especially because we can never check if you are actually not using it for training AI and then selling that product. Believing that you are not stealing requires the customer to have trust in the company and I cant trust this company. Adobe has zero respect or consideration for its customers, I can only pray that there is someone out there with a conscience to make products that artists can use.

Give examples for early termination. Ex: If you sign up for annual plan, you are given a discount. Say you license Adobe CC for $52/monthly and you cancel in 6 months. You can do that with a cancellation fee of $xx (based on difference per month of $yy).
2. Dispense with endless/frustrations passed around support escalation attempting to talk you out of cancelling.
3. Reduce the 2-system installation limit (Microsoft Office and TecSmith Camtasia are subscription with no # of install limits.

between those news therms and your law suit for abuse fee or the difficulty to terminate a subscription, i think you have a lot to learn.
It doesn’t matter what you say now. The TOS is pretty clear about the supposed rights you’re giving yourself over user created content. You can’t just write in the "contract" that you can do something, but then just promise you won’t 🤦♂️

Hey Jessica fellow lawyer here you don't make terms like these even in your drems because first you are charging your coustomers with a clearly predatory pricing and then you introduce these bs terms if Adobe is an intellectual property and does not tolerate pirating it's software then how come you think Adobe's new terms aren't doing the same a crime is a crime no matter who commits it if a consumer is creating anything Adobe's software then it gives you no right to maliciously use it better not talk about owning it

@@Adobe so as far as i understand this if anything on say LR or Portfolio IS NOT made public its not scanned or reviewed correct. I share groups of photos via LR app but by invite and none are posted to the general public. In Portfolio its password protected and again not publicly posted so it not scanned or used ? Yes ? My work is covered by NDAs with film studios. I dont think they would like it if your looking at their copyrighted IP.
