- When I moved into this quiet suburban neighborhood, I had no idea what I was getting into. The house was perfect-secluded enough to offer some privacy, but still close enough to town for convenience. I loved the idea of having a backyard where I could just relax after a long workday. So, naturally, I decided to build a pool. It wasn’t some fancy resort pool, just something modest and practical-enough for a summer swim or a weekend barbecue with friends. I was doing pretty well for myself, and a pool felt like the perfect way to make the most of the property. It was an easy decision. I had a few contractors come out, and within a few months, I had a pool that was everything I had hoped for. The neighbors were friendly enough, and no one seemed to mind. For months, I enjoyed the privacy of my backyard pool, swimming alone or hosting family and friends for small gatherings. Everything was going smoothly until one afternoon when I was lounging by the pool, enjoying the warm sun, when I heard a knock on my back door.
I wasn’t expecting anyone, so I hesitated before walking over to answer it. When I opened the door, there was a man in a dark blue uniform standing on the porch. He had a badge on his chest, and a radio attached to his belt. I figured he was some sort of security officer, but I didn’t think much of it. “Can I help you?” I asked. He looked at me with an almost bored expression. “You’re in violation of HOA rules,” he said flatly. “HOA rules?” I asked, a little confused. I hadn’t signed anything with an HOA when I bought the house, nor had anyone mentioned anything about an HOA. “The pool you have here,” he continued...
HO's Anonymous. I used to live under an HOA and they were extremely oppressive so I sold my house and bought Country Property with NO Rules or Deed Restrictions, I even have mineral rights. Now life is good, and I heard the residents of the area I lived in had enough and closed down the HOA and filed lawsuits against those in the HOA that were basically Dictators. Several went to Prison...A happy ending!
HOA security guards have no arrest powers.
HOS cop is trespassing - have him arrested.

since when does an HOA have a police force sanctioned by the local gov. or state? Yeah take agent and HOA to court
No HOA in the US has has any legal power outside of contract law (which allows them to sue) By making the threat that the can arrest over bylaws they are representing themselves as a law enforcement agency which is a crime. HOA's also have a duty to notify members of the bylaws before their taking affect.
can the HOA or police arrest people for breaking rules that aren't laws? seems highily illegal to me.
Sue the estate agent for non-disclosure!
Also check if she's got connections to the HOA or an agreement with the board to NOT reveal whether a property is part of the HOA.

They have no authority to arrest people who don’t have a membership or a member with the HOA.
Call the real police, charge them with trespassing.
They don't have any authority to arrest anyone as they aren't official police or sheriff's department! They can be arrested themselves as impersonating police is a crime!
HOAs should be against the law.

When an HOA tries to overreach, you lawyer up ASAP.
Always remember, as long as you haven't signed any membership papers they have no power over you what-so-ever.
And they can't be a "small print part of the purchase contract", they MUST be seperate and clear, they might be a requirement to buy the property, but must still be CLEARLY LAID OUT.
HOA members should have the right to resign membership at any time.
They're not true law enforcement. They don't have the authority to ARREST ANYONE
If they overreach their authority i recommend getting a lawyer &, document EVERY INTERACTION
If she doesn't know whether or not the house is part of the HOA or not then she's not a very good real estate agent.
And she and her company are liable under disclosure

HOA cops have no authority to detain, arrest, or otherwise do anything, regardless of member or non member. Lawsuit and major damages are going to be a PowerBall win!! If you didn't do your due diligence prior to buying a property to determine if there is a democrat association, you're in for trouble.
I hate the worthless HOAs. They are only there to scam money from the unsuspecting home owner. 😠😠😠

First, I'd never want to purchase in an HOA area. Second, if this situation happened to me I'd definitely been pretty hateful to them face to face at my first meeting. Backing down to Those Kind of People is not an option. Sometimes treating people horribly is the best thing to do. Yes, i would have gotten a lawyer immediately. Just that I'd never cowar down to those worthless fools. They'd get a lot of hate mail from me as well. When the HOA Officer handed the notice with his stupid smile I'd reply with "Thanks Stupid, i appreciate that! Makes a fool like you feel good! Huh boy?" Thankfully, i never bought in an HOA area. I purchased my Granny's home and have been restoring it. B
Shouldn't he have gone back to his solicitor? This was something that was missed and he didn't know.
Every community has rules about pools,you have to have a fence around your pool ,it's an insurance rule on your home owners policy that protect your house from lawsuiits from someone who got hurt swimming in your pool .
Sorry those HOA rules sound like serious overeach and I would like to know where they got the idea that they could arrest people for non compliance.

This is Australia Calling, my question to all this is why do you have LOCAL GOVERNMENT if this HOA has so much power. To me it sounds like a BODY CORPORATE on STEROIDS ( which here in Australia is a commercially ran and looks after all the common property areas of units, duplexes, town house complexes and gated communities.
Not that sort of shite thing that dictates what you can and cannot have or do, what colour scheme you can have etc. If you want to keep the value or improve the value than the last thing you want is some self interested dictatorship of self interest group dictating how when and the time you must wipe your arse regardless.
This is LOCAL AND STATE GOVERNMENT THAT HANDLE THIS AND NOT SOME BUNCH OF SELF INTEREST ZELOTS DICTATING AS TO HOW YOU SHOULD LIVE. IF THEY ARE RUNNING THE SHOW THEN I WOULD NOT RECOGNISE ANYTHING TO DO WITH LOCAL GOVERNMENT. INCLUDING ANY MONETARY CHARGES AND TAXES.
