Maya Kowalski sobs as verdict is reached in trial

- After eight weeks of arguments and testimony, jurors have reached a verdict in the $220 million case against Johns Hopkins All Children’s Hospital that was the premise of the Netflix documentary ‘Take Care of Maya.’
In 2016, at just 10 years old, Maya Kowalski was admitted to Johns Hopkins All Children's Hospital for severe pain and was removed from the custody of her parents after staff accused them of "medical abuse." Her mother, Beata Kowalski, hung herself in her garage on Jan. 7, 2016, after going months without seeing her due to the medical abuse allegations, according to the family's attorney, Greg Anderson.

Dearest Beata, you can rest now. Your name has been cleared and justice has finally been given. Rest in Peace Fierce Momma!!
Also, because of a precedent being set, it will be much more difficult for the state to overstep and destroy another family. The mother has saved other families with her sacrifice, by shining a light so bright on this miscarriage of power, that hopefully, it won’t ever happen again. ❤️❤️❤️💔💔💔

I’m curious as to why I haven’t heard about any criminal charges in this case. Someone needs to be held accountable. Not just financially but in a criminal court.
They released criminal charges after the civil trial finally ended a couple weeks ago. The judge lowered the award amount by 47.5 million but stopped the hospitals attorneys from being able to appeal.

THE OLD SOCIAL WORKER WHO WAS GROOMING HER FOR WHAT SOUNDS LIKE CHILD TRAFFICKING. NAKED PICTURES. KISSING. SITTING ON THE LAP AND BEING THE ONLY PERSON SHE COULD TALK TO.
One of the problems is also they the lady (Sally Smith) had a 10-15 minute interview with the dad before taking away custody because they said the mom had whatever gypsy roses mom had. Without any evidence. Just word. There was even evidence that she didn’t have it!
Let's not forget it is because of Beatas determination and refusal to sign the liability form that they were able to sue. All of those families that felt forced to sign it to get their kids back are also celebrating with them as they were also wronged by this hospital and by Sally Smith. Beatas intelligence, due diligence, bravery, and love for her children made this all happen. I’m not usually a big proponent of these massive dollar amount lawsuits because I know the public winds up paying in the long run in higher costs, but if there was ever a family that deserved to win and win big it is this one. How do you ever give that girl her mother back? And the judge that denied the mother a hug in the court room should be disbarred and sued along with this corrupt hospital.
Agree with not a fan of lawsuits but this family was brutally treated by the hospital so proud of the jury decisions. I just watched his on netflix and it wrecked my heart what happened
Plus with CRPS she’ll likely have more medical bills in the future, as well as therapy appointments for her mental health after all she’s been through, all that is expensive. (Not to mention the hospital charged for their treatments of CRPS even while saying she didn’t have it)
Indeed. This won't be paid by any of the offenders, and nothing will change. Johns Hopkins will probably appeal the damages until its whittled down to $1,459 in total damages.
@@andrewb386 someone told me that punitive damages were limited in Florida and the hospital would probably get a big reduction in the lawsuit.
That broke my heart and then when the mother unalives herself, I just lost it. No amount of money can ever bring this woman back but just hearing the jury rule the hospital was at fault is somewhat a relief. And FCK Sally and Catthi, and that POS Judge who refused her mother a hug.

The hospital did not off her mother. She did it herself. She’s weak minded and selfish. That should not have been taken into account in the lawsuit. Anyone weak enough to actually “finish the job” would have done it eventually anyway for whatever reason they dream up in their inbred head. Maya should be way more pissed at her own mother than anyone else. How selfish do you have to be to do such a thing!?? Many attorneys work on contingency (meaning they are only paid if they win). They WILL take your case for free. The problem is you have to have a very strong case for lawyers to invest years of his time to your case. They will also usually be working towards a quick settlement with the hospital. Very understandably, the lawyers don’t want to work the many years it takes for the trial and the appeals while not being paid a dime and with the risk they will never be paid.
They opened the door for the other families. And Mr Anderson paid out of his own pocket for the experts he brought in except for Dr Cochoran, who did it for free. I watched caring for Maya today on Netflix in the UK and I cried throughout the whole documentary. The systematic injustice Maya and her family went through that led to her mother’s death was unbelievable brutal. I have heard a lot as a psychotherapist but I totally went to piece over this family’s pain and helplessness. The tragic loss that would’ve been avoided if those so called specialists really cared, instead they were so consumed with power and being right at all cost. What was so sad was that even when they were proven wrong, there was no admission of wrongdoing or apology just a long trail of devastation and suffering, families destroyed by a system that was supposed to protect their children. It was so cruel and heartbreaking. I pray Maya, her brother Kyle and their father Jack will finally find some peace in their hearts after the long process it took for them to seek justice. May Beata’s soul rest in peace ❤️🙏
SO WHO THE FUCK GOING TO JAIL.
You're rigjht, but what's happening in the UK is far far worse - preventing parents from taking their terminally sick children for promising experimental treatment outside the UK, AND now they even put gag orders on such parents to prevent them talking to media or anyone else about the situation. Even the 16 year old girl who made it plain... put it in writing...before she went unconscious that if she were to become unconscious she would want her parents to try every possible means including experimental treatment, to heal her. The UK judges gagged the parents and pulled the plug on her. Not even to save cost for NHS because the parents had raised the money to take her to Canada. Then the laws against praying around abortion centres and trying to prosecute a person who was praying silently for praying... y'all are living under a growing dictatorship/control state and don't quite realize it yet...
At least the Johns Hopkins situation is restricted to that hospital. In the UK, extreme forms of this sort of behaviour are now standard practice, legalised and enforced by the judiciary.

I agree 100%! I was an EMT prior to becoming a CCRN credentialed critical care RN and psych nurse. The trauma this hospital and MSW caused to Maya (and her family) is beyond devastating. These kids will never completely heal and Maya's need for ongoing treatment most likely will be needed for the remainder of her life. My daughter is special needs and lost her daddy as a ten year old, so I know just how much losing a parent at that age affects them. The fact that this hospital and employees/associates caused her mother to take such drastic actions so Maya could return to her family instead of become a ward of the state is deplorable. Im hesitant to comment, but as a child psychologist of 30+ years, I am disgusted and heart sick. Clearly, the professionals were excited by the exotic nature of a munchausen by proxy diagnosis and their egos kept them from actually learning about the disorder. In addition, they don’t seem to understand chronic pain or children. Or parents for that matter. Because the mom was insistent they assumed she was, instead of trying to understand a momma bear who was terrified for her daughter and who has witnessed the medical community fail her daughter over and over. It is also not unusual for little one to complain more to one parent than another, especially they feel safer with one parent or one parent is more validating or nurturing. It does not mean there is a munchausen scenario.
God there is so much to say, but I guess in the end, these professionals let their egos and sense of self righteousness dictate how to treat a child. That is a dangerous dangerous game. They should never work with children.
❤
Allow me to add something to that.
I'm in Eastern Europe and I know how things work around here.
Here we have a health care system that still isn't completely cured of the post-Communist diseases of being underpaid, highly bureaucratic, centralized and often lacking or disregarding proper procedures.
I have no specific information on Poland, but I do on Romania.
Here, underpaid and disrespected doctors, nurses often tend to become bitter and disrespectful themselves, they sometimes treat patients not as human beings but as work pieces that arrive on a conveyor belt, an unnecessary nuisance.
So parents, relatives of patients know that if they want proper care they need to be extremely assertive and - unfortunately - break the law too. They have to kick in doors, to slam their fist on tables, to swear, yell, threaten with powerful acquaintances if they can, and also to bribe the personnel. If you want clean bed sheets, make sure to line the pockets of the nurse, that's how it goes, it's an open secret.
I think that medical personnel in the West need to be at least mildly educated on some cultural differences that they seem to have no idea about (or to often dismiss due to anti-immigrant bias).
Beata came from this world, and as soon as she hit that invisible wall, she thought she knew what it was and following her maternal instinct she reacted the only way her cultural background told her to do. Of course, the doctors, nurses saw this as a Karen being unreasonable, aggressive, rude. It was a culture clash involved here.
It's not the first, nor the last case. I personally know a case in Sweden, where an Asian woman was forcibly taken to a mental institution after she tore down the wallpaper in her home. Turns out, the wallpaper was red and in her culture red means misfortune. There was some language barrier too, but really nobody cared to ask her why she did what she did, they just jumped to the conclusion that she's crazy.
A little sensitivity towards these issues could go a long way.
Sorry for being this long, but although I lived for a while in the USA I'm not an American, I cannot do anything to fix this. But you are a child psychologist, maybe you can make some steps to change attitudes, if nowhere else, at least in your immediate environment.
Thanks for your attention!

And I think if you were to write him, he would be very interested in ensuring that our healthcare, government and law enforcement were more educated on this topic…for the betterment of all concerned.

They should never work with patients of any age.
In addition, Munchausens by proxy is not a recognised medical condition in any diagnostic manuals or resources, primarily due to its lack of definition (there isn't a way to define it that doesn't also define basically all other forms of abuse, in which case its a behaviour, not a disease) and also because of situations precisely like the one we watched unfold. It's also not accepted as a means of prosecution because of how murky it gets. It's a label that has no benefit other than colloquial use to describe a specific nature of abuse and for abuse survivors to communicate what they went through. In all other contexts, it runs the risk of destroying lives as medical professionals and courts of law use it to withdraw care from disabled people and criminalise desperate parents for being stressed and advocating for their kids (literally, those are some of the supposed signs of MBP).
Is abuse via making a person sick and subjecting them to medical interventions a thing? Absolutely. Is it a specific pathology? Evidence wouldn't support that idea at this stage. Is it a good idea to treat it as a specific pathology by looking for "signs" using vague, inconsistent criteria that people who don't have "MBP" would meet? Absolutely fucking not.
This awful scenario is what happens when we prematurely legitimise a label that hasn't yet been defined in a legal or clinical sense. These doctors were so irresponsible in using that label.
I think you're spot on about the doctors feeling excited by the elusive, dramatic label of MBP and that they lack a sufficient understanding of trauma and stress. So much of the harm caused here was due to prejudice and a lack of compassion on the parts of medical professionals, and a total lack of basic training in understanding the psychology of chronic illness and disability. I feel like hospitals need psychologists on board if for nothing else than to get other healthcare professionals to stay in line.
Maya and Kyle sobbing uncontrollably is ripping my heart out:( Bless both of you!
A mother gave up her life. The anguish will never end. In another video the arrogance and contempt and plain inhumanity openly displayed by the doctors warrants that there medical licences be revoked and some should certainly have a prison sentence. We are with the Kowalski family all the way and are glad that Justice has been served but tragically too late,
For sure. I also say revoke their licenses.

In respect of Beata, I feel completely compelled to give ALL patients more...more grace and compassion when my job seems mundane and unnoticed. I can ALWAYS improve and have seen terrible treatment of patients. I will encourage others to do better with kindness and honest direction...with this family on my heart. @@arizonalady7569 Not for minors, as Maya was a minor she couldn't consent to leave AMA because she was deemed ineligible for consent. A parent/guardian would have to consent for her to leave AMA which Beata and Jack were immediately disqualified for after a child abuse investigation opened up. So the only person who would have consented to allow her to leave AMA was the social worker in charge of her case who molested Maya while having custody of her so unlikely she would let her victim walk out of the hospital when she had unfettered access where she was.
This situation made it impossible for Maya to escape or do anything to defend herself against the actual abuse at the hospital even though she repeatedly asked to go home and see her parents.

The attending physician bypassed all the bs and took him right to surgery while everyone else stood there with their mouths open. We’d never met a more caring medical professional in our lives nor have experienced such care since.
As someone who has been dealing with chronic tonsil infections for two years, sometimes becoming severe, I appreciate you fighting for your child. Yes, I agree. Go justice!
The medical industry isn’t corrupt. For-profit health *insurance* is corrupt. For-profit healthcare systems are corrupt. The pharmaceutical *Industry* is corrupt. Some of the for-profit healthcare education school systems are (financially) corrupt. The vast majority of providers are not. The vast majority of us are under-paid (while others are unreasonably over-paid) and we’re just doing our jobs and doing it well. This situation is awful and they didn’t deserve it, but Munchaussen (sp) is a real thing and signs of it need to be looked for. But meanwhile whether you believe a child is really sick or in pain or not, you do NOT treat her roughly and cause more pain **because you could be wrong and she could be fragile and in pain**. That was just inconsiderate and stupid clinical decision making. And that’s a main reason this hospital should pay up. The fact that they CAN pay up 200+ million dollars shows their for-profit system is corrupt. But the doctors/nurses don’t have a lot of (financial) power. They’re just trying to do their jobs. It’s the executives and administrators and maybe CPS who allowed this to turn in to what it’s become, and killed her mother.
