The formula only works with the vertical height of the cone. If given the slope height of the cone, you have to work out the vertical height by solving the trigonometry of the triangle to find the vertical height.
Fun fact: there are no visual or geometric proofs that explain WHY the volume of a cone is 1/3 the volume of a cylinder without bringing in calculus or by saying “because I said it was 1/3”

A very practical lesson would be to find the volume of cones that have some amount of area on the small end. IE a cone with 4cm base and 1cm tip.
