When Luke "lost" his lightsaber, it was still literally, physically in his clenched fist, therefore never leaving his possession. If someone removed it from his hand, they would be stealing it.
From my perspective, it will always be Anakin's lightsaber because it is a historical artifact. If a museum is currently in ownership of George Washington's Sword, it's still refered to as George Washington's Sword. That was his sword, regardless of who currently owns it. Whoever is in possession of that lightsaber owns "Anakin's Lightsaber".
Legally Anikan Skywalker is not dead until the end of episode 6. Changing your name isn't a legal death. Meaning Obi-wan STOLE Anikan's lightsaber and then gave it to Luke. At this point in time it is still Darth Vader's property until it is salvaged and the appropriate amount of time has passed for legal transfer of unclaimed property. Make those corrections and then take into account known laws of the old republic, the empire, and the new republic and you will have a complete record of ownership.

The issue with this is that we have to take star wars lore into consideration, which means that the lightsaber, no matter who has it, still belongs to the being who imbued it with the force. Just because a person uses it doesn't mean it belongs to them since we've seen in multiple stories that a person who takes a lightsaber from, say, a sith tomb, could be possessed by the sith spirit since the lightsaber is imbued with apart of the spirit. Its why Luke's lightsaber was never Anakins, it was the green lightsaber he himself built, and I'd like to point out something else, a very important detail that people tend to ignore where even in the OT, it was considered Anakin's lightsaber, and that's when Obi Wan gave the lightsaber to Luke, where he said "This is your fathers ligthsaber." Right there, it shows that, even though Kinobe had possession of it, he still considered it Anakins since that's the ideology of the Jedi. So because of these, I have to say it has always been and will always be Anakins lightsaber, and that, until Rey builds her own, she technically doesn't have an actual lightsaber of her own.

Also, based on law, it would not be Rey's lightsaber. He must have forgotten that in episode 6, We see Anakin come back to his senses and "kill" the emperor. With that, we see that Anakin was never really dead, therefore, Obi Wan stole it on Mustufar, giving his act as guardian until Luke came of age no legal justification. Therefore, It was never Luke's, and never "lost" by its owner, leaving it to still be the possession of Anakin Skywalker.
Technically Luke owned two sabers for a short period of time. Anakin's old saber and his new green one, assuming he constructed his new saber in at least 3 months.

The mistake in the video is to assume that Darth Vader and Anakin are 2 different persons. What explanation would have made sense is that Anakin was pronounced dead not long after he fully became Darth Vader (with his armor) so that Vader's real identity would stay hidden. Actually, you're wrong. Anakin was a Jedi, which meant living a celibate life,no wife and no children. And since the Jedi Order worked as an important part of the Republic, legally his wife and children weren't allowed to own the lightsaber, because at the eyes of the law, their marriage doesn't exist.
Actually the republic and the Jedi order were different entities, this is why order 66 could have happened. Neither side owned the other. Also Jedi didn’t have to be celibate. And in a sense this is a similar law about how being a sith wasn’t illegal. Under the republics rule, which I believe all Jedi were citizens of the republic, it is of course legal to have children and be married. Under the Jedi’s rule, u cannot. When Anakin fought Obi-Wan he was no longer Anakin, he was Darth Vader, therefore as the video states, he is not in ownership of the lightsaber.
I'd argue the same effect happens though but through everyone's favorite moisture farmer, Uncle Lars. Think about it - he's the last legal relative surviving Anakin so HE gets the lightsaber and, knowing who Obi Wan is, allows him to be the guardian of the saber until Luke comes of age, legally. Figured I'd chip in my 2 cents (not saying its the right answer just what I go by). A youngling has to complete their first lightsaber before becoming a full Jedi. As we know (From Clone Wars which is cannon) to select their Crystal the younglings must enter a crystal cave on the planet of Ilum and the crystal will call to them, then they must overcome their biggest weakness to retrieve their crystal and leave the cave. Taking this into consideration, WHO would have retrieved the crystal embedded in the saber in question.......It would be Anakin. Anakin overcame the trial of the crystal cave, exited with his crystal and therefore constructed the saber using his earned crystal. Now is it true that Rey and Luke "Possessed" the saber at some point yes. But as we see, they also constructed their own sabers which we can assume were done so after retrieving their own Crystals, overcoming their own obstacles, and completing their first builds. So here is how I conclude; Luke and Rey were "younglings" or "Padawans" at most (using Jedi terms of rank) while using Anakin's Saber, and during that time they learned, trained, and used it but given the owner of the CRYSTAL that powered it has a connection with Anakin, it is Anakin's saber who was the only true JEDI to use it. You can let your son or daughter drive your car while they are learning but if you own the TITLE to the car, they may use/possess the car at times, but until they own the title it is yours. Saber = Car, Crystal = Title. Thats all I got.

While Rey may be the owner of the lightsaber, it is not "Rey's Lightsaber." Anakin bonded with the Kyber crystal and built it himself, therefore it is Anakin's. Luke uses it in the OT but even then, it is not "his", as we see him with his own custom green lightsaber in Return of the Jedi. He bonded with that green Kyber crystal and built the lightsaber, thus making it "Luke's Lightsaber." I know this video was made before Rise of Skywalker, but especially now after it came out and we see what eventually happens with Rey, we know the lightsaber mentioned in the video is not "hers," as she is seen with her own custom yellow lightsaber in the end.

This made me think that if Anakin bonded with that Kyber crystal, it may have Dark Side energies in it as Anakin did. So can they then be transferred over to someone else? Is this why the goodhearted Luke eventually entertains the thought of killing Ben. Is this why Rey struggles to balance the Force in herself. Can an object of such import physically alter its possessor so much that one would lock it away for years (as Obi-Wan and Maz did). Just something to think about.

Technically, that's not Rey's. Each owner had a different iteration of the lightsaber. The model you're holding looks like it's from Revenge of the Sith, meaning in the time period represented, that's modeled after Anakin's. But if you really want to get truly technical, that lightsaber is yours.
first off how the heck do people say that luke had it longer? anakin had it the whole of clone wars, up until the end of ROTS. second, obiwan clearly says to luke when giving him the lightsaber "It was your father's lightsaber" not "its your new lightsaber, it used to be your fathers". third, rey has no claim to it whatsoever just because shes some rando who has force abilities. The one you're holding is Rey's because it has a gold clamp card and the short nose. It'd be Luke's if it had the silver or bubble clamp card, no grip screws or the long nose. It'd be Anakin's if it was thinner and had knurling around the center grip

Legally Anikan Skywalker is not dead until the end of episode 6. Changing your name isn't a legal death. Meaning Obi-wan STOLE Anikan's lightsaber and then gave it to Luke. At this point in time it is still Darth Vader's property until it is salvaged and the appropriate amount of time has passed for legal transfer of unclaimed property.

The issue with this is that we have to take star wars lore into consideration, which means that the lightsaber, no matter who has it, still belongs to the being who imbued it with the force. Just because a person uses it doesn't mean it belongs to them since we've seen in multiple stories that a person who takes a lightsaber from, say, a sith tomb, could be possessed by the sith spirit since the lightsaber is imbued with apart of the spirit. Its why Luke's lightsaber was never Anakins, it was the green lightsaber he himself built, and I'd like to point out something else, a very important detail that people tend to ignore where even in the OT, it was considered Anakin's lightsaber, and that's when Obi Wan gave the lightsaber to Luke, where he said "This is your fathers ligthsaber." Right there, it shows that, even though Kinobe had possession of it, he still considered it Anakins since that's the ideology of the Jedi. So because of these, I have to say it has always been and will always be Anakins lightsaber, and that, until Rey builds her own, she technically doesn't have an actual lightsaber of her own.

Also, based on law, it would not be Rey's lightsaber. He must have forgotten that in episode 6, We see Anakin come back to his senses and "kill" the emperor. With that, we see that Anakin was never really dead, therefore, Obi Wan stole it on Mustufar, giving his act as guardian until Luke came of age no legal justification. Therefore, It was never Luke's, and never "lost" by its owner, leaving it to still be the possession of Anakin Skywalker.

Actually, you're wrong. Anakin was a Jedi, which meant living a celibate life,no wife and no children. And since the Jedi Order worked as an important part of the Republic, legally his wife and children weren't allowed to own the lightsaber, because at the eyes of the law, their marriage doesn't exist.

Actually the republic and the Jedi order were different entities, this is why order 66 could have happened. Neither side owned the other. Also Jedi didn’t have to be celibate. And in a sense this is a similar law about how being a sith wasn’t illegal. Under the republics rule, which I believe all Jedi were citizens of the republic, it is of course legal to have children and be married. Under the Jedi’s rule, u cannot. When Anakin fought Obi-Wan he was no longer Anakin, he was Darth Vader, therefore as the video states, he is not in ownership of the lightsaber.
He also was no longer a Jedi, but a citizen of the republic, but still, Anakin was murdered by Vader, and Vader can attest to that
I'd argue the same effect happens though but through everyone's favorite moisture farmer, Uncle Lars. Think about it - he's the last legal relative surviving Anakin so HE gets the lightsaber and, knowing who Obi Wan is, allows him to be the guardian of the saber until Luke comes of age, legally. So actually it is the whole Skylar family lightsaber now. It this is my theory, it is still Anakins lightsaber because he is technically not dead because he learned the path to immortality and he is still living in with the force. So according to legal terms, he never actually intended to gift it to anyone meaning that it is still anakins.

Figured I'd chip in my 2 cents (not saying its the right answer just what I go by). A youngling has to complete their first lightsaber before becoming a full Jedi. As we know (From Clone Wars which is cannon) to select their Crystal the younglings must enter a crystal cave on the planet of Ilum and the crystal will call to them, then they must overcome their biggest weakness to retrieve their crystal and leave the cave. Taking this into consideration, WHO would have retrieved the crystal embedded in the saber in question.......It would be Anakin. Anakin overcame the trial of the crystal cave, exited with his crystal and therefore constructed the saber using his earned crystal. Now is it true that Rey and Luke "Possessed" the saber at some point yes. But as we see, they also constructed their own sabers which we can assume were done so after retrieving their own Crystals, overcoming their own obstacles, and completing their first builds. So here is how I conclude; Luke and Rey were "younglings" or "Padawans" at most (using Jedi terms of rank) while using Anakin's Saber, and during that time they learned, trained, and used it but given the owner of the CRYSTAL that powered it has a connection with Anakin, it is Anakin's saber who was the only true JEDI to use it. You can let your son or daughter drive your car while they are learning but if you own the TITLE to the car, they may use/possess the car at times, but until they own the title it is yours. Saber = Car, Crystal = Title. Thats all I got.

I mean yeah. Technically it was never really handed down to anyone and it was stolen property. If we get legal speak going, Anakin never legally transferred ownership of the saber to Obi-Wan. Obi-Wan committed aggravated assault causing bodily dismemberment, and then proceeded to loot Anakins lightsaber which he then kept for years before illegally handing it off to Luke. So unless FG Anakin rightfully gave possession of the lightsaber to Rey at some point, he is still the legal owner of the lightsaber and Rey is just using stolen property.

While Rey may be the owner of the lightsaber, it is not "Rey's Lightsaber." Anakin bonded with the Kyber crystal and built it himself, therefore it is Anakin's. Luke uses it in the OT but even then, it is not "his", as we see him with his own custom green lightsaber in Return of the Jedi. He bonded with that green Kyber crystal and built the lightsaber, thus making it "Luke's Lightsaber." I know this video was made before Rise of Skywalker, but especially now after it came out and we see what eventually happens with Rey, we know the lightsaber mentioned in the video is not "hers," as she is seen with her own custom yellow lightsaber in the end.

Technically, that's not Rey's. Each owner had a different iteration of the lightsaber. The model you're holding looks like it's from Revenge of the Sith, meaning in the time period represented, that's modeled after Anakin's. But if you really want to get truly technical, that lightsaber is yours.
first off how the heck do people say that luke had it longer? anakin had it the whole of clone wars, up until the end of ROTS. second, obiwan clearly says to luke when giving him the lightsaber "It was your father's lightsaber" not "its your new lightsaber, it used to be your fathers". third, rey has no claim to it whatsoever just because shes some rando who has force abilities. (i still hold she is NOT a skywalker and will never change my mind)

The one you're holding is Rey's because it has a gold clamp card and the short nose. It'd be Luke's if it had the silver or bubble clamp card, no grip screws or the long nose. It'd be Anakin's if it was thinner and had knurling around the center grip
