That would be on a case to case basis, neither the prosecutor nor the judge may tell that the defendant’s silence means they are admitting their guilt. If a defendant does take the stand, which is the case with Ms. Ong, they are said to have waived their right to to self incrimination to not testify, and they must answer all questions within the rules of evidence that the attorneys or judge may have in place, thus the contempt of court as she is disrupting the legal process in the courtroom.

Suggestion: Subpoena her everyday to attend the hearing, ask her one question and if she refuses to answer ignore her for the rest of the hearing. Dahil wala pa sila matibay na evidence. si Alice Guo nga walang court case enough to issue a hold departure order. Kangaroo court lang ang Senate at HOR. Worst they can do is contempt----detain. Yun lang. If you open your mouth as hearing ng seante or HOR, yan pa gagamitin sayo sa pag file ng case. so bakit mo naman gagawin yun. Does nobody see the blatant violation of the Philippine Constitution, regarding the right to remain silent? We should remember what the House of Representative did. Anybody who is under oath can invoke the right to self incrimination in threat of crime such as PERJURY.

What is your basis? Again the right to remain silent applies only to custodial investigation. This is a House hearing in aid of legislation. Although the right to be self-incrimination may be invoked here, to be incriminating there should be a identifiable crime and the witness is probably guilty of. @@ManilaNoir I believe the right to remain silent and the right against self incrimination is the same, and because she was under oath, there is a possibility for her to commit the crime of PERJURY. Therefore she may invoke the right against self incrimination. Also if one is to invoke such right, all inquiries should stop and not be pressured in any court. Just like what happened in the congress, and because nobody objected to this action, and they even continued to pressure her with contempt of court, the congress had violated her constitutional right.
@@ManilaNoir Don't get it wrong though, there is a proper venue for this, and i believe that the prosecutors can solve the issues involved in POGO. But it is dangerous when such a respectable and powerful institution such as the congress is willing to violate constitutional rights.

These hearings are not a proper venue to talk. If indeed they have a case against her, file a court case---but obviously wala sila strong evidence so they force her to talk in the hope of getting something to use against her in court.

She is being prepared by her lawyer not to spill any beans in the senate. The constitution has given everyone the right to remain silent. It is up to someone to use that right or to throw it out. You may have an opinion against it, but this constitutional right can only be overridden by a court. And no, the legislative body has no power to override it.

The constitution has given everyone the right to remain silent to protect from self incrimination. It is up to someone to use that right or to throw it out. Your line of thinking takes out the presumption of innocence unless proven guilty by a competent court. It is against her interest to talk and spill out the beans while doing so.
