    Thanks for these videos. I'm starting the process and while the VA claims to help with the process, its like asking the IRS to help file taxes. Its one thing to have a diagnosis with something and another to file with the VA about it; there is a good, better and best way and I think part 9 of this video was the most helpful and I'm starting this process today. Again, thanks so much for this information that you didn't have to provide but have for those of us who need it.

    My big hang up and I can’t get a definitive answer from people, but you as a lawyer could possibly help.
    It’s people with PTSD and depression and the big “S” word.
    I have thought about the S word many times, but I’ve managed to power through it.
    Now here’s the big dilemma. My golfing or bass fishing or whatever is going to the range and target shooting and trying to get a better score each time constantly challenging myself.
    But now sitting in the room with a C&P examiner, and I’ve already related about the S word and now I mentioning firearms.
    Where does the red flag laws or policies or whatever the hell they are, where does it go with that?

      Hey brother, you're not alone and I've been where you're at before. In my experience I've talked to the VA therapists about this exact thing and they can't touch your g*ns unless you've explicitly stated you're going to "S" yourself or hurt someone else. I 100% get the anxiety that comes with talking to therapists and the subsequent "they're coming for my g*ns," but a CMP examiner would have to have some explicit and exigent reasons to make a red flag or emergency order on medical grounds to a judge for you to be in that situation.     Why the hell do vets have to go through this crap? 13 vet’s committed suicide every single day today.

      We agree. These exams can be quite difficult on veterans - especially the mental health. The suicide rate is quite disturbing amongst veterans. I really hope something favorable is demonstrated from current research on atypical treatments such as psilocybin.
      The VA is currently researching psilocybin as a treatment for mental health conditions like PTSD and depression, but it is not yet offered as a standard treatment.       @@VADisabilityGroup I work for the VA. It’s not about treating with drugs, it’s about treating them with respect. No veteran should have to fight for his benefits. It should be automatic but the criminals in congress do not and have never cared about us.

    You mentioned; Writing a statement? Is this separate from a Symptom Log? Also it is valid even if I start today. I was denied on my knees, ankles, and back. I was Infantry for twenty-eight years, and was told no connection. Even though I have lots of pain and stiffness and issues walking downstairs. I am currently waiting for my Call and C&P appointment. Anyway Thanks and very informative.

      Yes, the written statement is separate from the symptom log. Definitely do both. It is valid at whatever point you start it. It's better to start now than tomorrow, but demonstrating severe symptoms is important so that once you potentially obtain service connection the severity of symptoms will already be established. I hope that makes sense.
      28 years as an infantryman. That's intense. It's discouraging to see folks with such service be denied. If applicable, try to attribute your musculoskeletal injuries (knee, back, neck, ankle, feet, etc) to combat service. The evidentiary burden is far less if you allege an injury stems from combat.

      The benefit of the doubt doctrine for VA disability is codified in 38 CFR § 3.102. This regulation states that when there is an approximate balance of positive and negative evidence regarding service origin, degree of disability, or any other point, the doubt will be resolved in favor of the claimant.
      This means that if the evidence presented in a veteran's disability claim is roughly equal in support and opposition, the VA is required to decide in favor of the veteran. The benefit of the doubt doctrine is a fundamental principle in VA law and reflects the VA's commitment to providing benefits to those who have served.
      Here are some key points about the benefit of the doubt doctrine:
      Equal balance: The doctrine applies when the evidence is in approximate balance, meaning there is roughly equal evidence supporting and opposing the claim.
      Reasonable doubt: The doubt must be reasonable, not based on mere speculation or remote possibility.
      All aspects of the claim: The doctrine applies to all aspects of a disability claim, including service connection, the degree of disability, and effective dates.
      Consistent policy: It is a long-standing and consistently applied policy of the VA to administer the law under a broad interpretation, giving veterans the benefit of the doubt.

      For joint examinations and opinions, a chiropractor should be good. For systemic diseases involving organs and cancers, the VA lends more probative weight to MDs, DOs, NPs, PAs.

      @@VADisabilityGroup Yes sir! Thank you. I left the army in the fall of 1989. Starting 1990 I began to see a chiropractor close to me for my neck, back, shoulders and knees. He treated me a regular basis until he retired in the mid 2000s. I went back to his old practice in 2022 (now run by someone else) but was informed that they did not keep records over ten years old. I finally found my old chiropractor online and he still remembers me. I mentioned my filing with the VA and for a nexus letter. He told me to call him.next week. Hope this works out. Would a nexus letter even withput and records help? Thank you once again

      Yes, a nexus letter should definitely help. It would be helpful if he states he treated you for an extended period of time. That the older records aren’t available shouldn’t be an issue if he states he treated you.

      @@VADisabilityGroup what about getting diagnosed by a Nurse Practitioner at a urgent care for PTSD? is that a legitmate diagnosis for a va claim? im considering it because my family doctor is booked until October and urgent cares accept walk ins

    i dont agree with rating all mental conditions the same. if someone was sexually assaulted and has ptsd from a combat situation. they should be able to claim both. How is that not just basic common sense?

      Yeah, this gets tricky. The regulations prohibit more than one mental health condition being separately compensated. What you usually see is service connection for 2 conditions lumped together. This is because the professionals struggle to separate mental health symptoms.
      It's unfortunate, but we don't foresee this changing.
