Seems to me that the use of discretionary "may" as opposed to mandatory/compulsory "shall", leave a grey area and some interpretational wiggle room. I am fully cognizant of the proviso and stipulation of Section 3 of the Fourteenth Amendment. However, what was the original intent? For whom was it intended? Being president of The United States is the highest office in the land. Isn't it logical to think that the framers would have begun with the highest of office of the land to be so disqualified? 🤔 So let's examine Section 3, quote: "No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any state, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof But Congress may by a vote of two-thirds of each House, remove such disability." End quote. So, why begin with " Senator or Representative in Congress or Elector of President or Vice- president"? Why the conspicuous omission of "President" to be subject to disqualification?🤔 I get it that this interpretation presupposes that the offices of President and Vice-president are omitted and can be interpreted as not being subject to the law; however it's also a dangerous precedent to read into laws things that have not been expressed nor implied by the framers. Also, what's the criteria for determining "shall have engaged in insurrection...."? Is conviction in a criminal court of law or conviction upon impeachment prerequisite to such disqualification?🤔 The grey areas in Section 3 of the Fourteenth Amendment are broad and wide.
