Lol deposit koi wapas nhi karta chahe koi bhi pg ho. Bahut sara PG hai bangalore me jo company ka nhi hai wo accha hota hai.
Even house owner are worse in blr...my landlady also didnt return the security deposit after my tenure completed...she charged me more 10k bucks...literary nobody helps..

You can try Arbitration or consumer courts
here is a general process you can follow to initiate arbitration or file a case in a consumer court for the non-return of a security deposit by a landlord or landlady:
1. Review the Rental Agreement
Before taking legal action, the first step is to thoroughly review the terms of your rental agreement. Look for clauses related to the security deposit, such as:
The amount of security deposit paid.
Conditions under which the deposit will be refunded.
Any deductions that the landlord is allowed to make.
The timeframe within which the deposit should be returned after vacating the premises.
If the agreement contains an arbitration clause, this will require you to resolve the dispute through arbitration before approaching any court. If no such clause exists, you may proceed to consumer court.
2. Send a Legal Notice
A legal notice is a formal communication sent to the landlord or landlady demanding the return of the security deposit. Here’s what you should do:
Draft a legal notice: Outline the facts, including the amount of the security deposit, the date you vacated the property, and the landlord’s failure to return the deposit despite requests.
Include a deadline (typically 15-30 days) for the landlord to return the deposit or face legal action.
Send the notice via registered post or courier with an acknowledgment to maintain proof of delivery.
This step is crucial, as it establishes that you attempted to resolve the matter without litigation, which will work in your favor in any legal proceeding.
3. Filing in Consumer Court (if there is no arbitration clause)
If the legal notice does not yield a satisfactory response, and there is no arbitration clause in your agreement, you can file a complaint in a consumer court. The non-return of a security deposit is considered a deficiency of service under the Consumer Protection Act, 2019.
Steps to File a Case in Consumer Court:
Draft a Consumer Complaint: The complaint should include:
Details of the rental agreement and the security deposit.
A narrative of how the landlord has not fulfilled their obligation to return the deposit.
Attach all supporting documents such as the rental agreement, payment receipts, communication records, legal notice, and acknowledgment of its receipt.
The specific relief you are seeking (i.e., the return of the deposit along with any interest or compensation for harassment).
Jurisdiction: File the complaint in the appropriate Consumer Dispute Redressal Forum based on the value of the claim:
District Consumer Forum: If the value of the security deposit is up to ₹1 crore.
State Commission: If the value of the deposit exceeds ₹1 crore but is below ₹10 crore.
National Consumer Disputes Redressal Commission (NCDRC): For cases involving more than ₹10 crore.
Submit the Complaint: Submit your complaint along with an affidavit verifying the facts, copies of all documents, and the prescribed court fee. Fees are based on the amount claimed and vary for different forums.
Hearing: The consumer court will issue a notice to the landlord and schedule hearings. You will have the opportunity to present your case, and the landlord will be asked to respond.
Final Order: The consumer court will pass an order based on the facts and evidence presented. If the order is in your favor, the court may direct the landlord to return the security deposit along with compensation for mental harassment, legal costs, or interest.
4. Arbitration (if an arbitration clause exists)
If the rental agreement contains an arbitration clause, you must follow the arbitration process as specified in the agreement. Here’s how you can proceed:
Appoint an Arbitrator: Depending on the clause, an arbitrator may be appointed either mutually by both parties or through a court if the parties cannot agree.
Notice of Arbitration: Send a formal notice to the landlord invoking arbitration and requesting the return of the security deposit.
Arbitration Proceedings: The arbitrator will conduct the proceedings, allowing both parties to present evidence and arguments. The arbitrator will pass an award, which is binding on both parties.
Enforcement of Arbitration Award: If the landlord fails to comply with the arbitrator's award, you can approach the court under Section 36 of the Arbitration and Conciliation Act, 1996, to enforce the award like a court decree.
5. Remedies and Compensation
In both arbitration and consumer court proceedings, you can claim:
Return of the security deposit.
Interest on the deposit for the period of delay.
Compensation for mental harassment, inconvenience, or financial loss.
Legal costs incurred during the process.
6. Timeline
Consumer Court: Typically takes 6 months to 2 years for resolution, depending on the forum and complexity of the case.
Arbitration: The timeframe depends on the arbitrator and the cooperation of both parties, but it is generally faster than litigation.
Before initiating any legal process, it is always advisable to consult with a lawyer specializing in consumer disputes or arbitration to guide you through the specific requirements and procedures. I recommend sending a well-drafted legal notice initially, which often results in a quick resolution. Should that fail, you have the option of pursuing arbitration or consumer court action, depending on the agreement.

We were staying in Colive Jordan and it was the worst decision we ever made…. Room was filled with bed bugs and when we asked for room change we were not informed that we would be charged even for their unhygienic service…less than half of our deposit was given back…never ever go for colive

File a FIR in police station against the owner for not returning the deposit , believe me it works . Best would be through lawyer but you can raise it by yourself as well .
@@betweencephapirin Firstly Police said they will not file FIR and said go to consumer court and one inspector said its theirs business they will charge whatever they want.
Try filing a FIR for ANYTHING in Bangalore. Even if you provide evidence and FIR won't be filed.

Same is the case in kashmir. Police force is useless. They refuse to file FIR unless there is murder lol. It is getting very difficult to be a gentle person day by day. We have to be a little direct and clever beforehand. At worst , let this be a lesson to you - which costed you this much money.

Similar issue happened with me, Nestaway charged unreasonable deduction before refunding my Deposit. ₹500 for Light Bulb, ₹5000 for Geyser repairs, ₹6000 for cleaning which they don't do, and many other charges.
Bangalore people are most Corrupt people in India.

It's very bad to generalize the whole city for just one incident. Scammers are all over the country not only in Bangalore. There are scammers even in your hometown city and that doesn't make all the people in your hometown corrupt
Sad reality of Bengaluru. Whether it is your landlord, pg owners, auto & cab drivers, police, etc everyone thinks that people are making unlimited money in IT so they just want to loot you as much as possible. And if you're from other state and can't speak Kannada then god help you.

I lived in CoLive for about a year in 2018. The whole operation was definitely shady even back then! Food was shit. Power kept tripping. I lost my laptop's charger once and it literally shorted in a way where black smoke came out of it. Washing machine was never maintained. The care taker was the so called property manager. The whole experience was shit. I have heard better stories from people who have lived/living in Zolostays.
Even speaking to the then CEO Suresh with issues did not help. No wonder the whole operation is crap.
Who is behind these kind of mastermind scams,company owner only.

Banglore police takes annual fees/hafta as protection fees from everyone who has probable reasons to get comolained.
I lived there 14 years back and my north indian friends used to give annual fee/hafta to local cops for annual protection , cops only knew that my frinds were doing smthing wrong, but my friends had privileged authority to do whatever they wished to do, while their main work was scamming ppl for admission in clgs , but as they had paid money to cops, they were able to beat any1 .
Other group of friends were active in betting and were protected by local cops even from STF (special task force) .
Well sis whole world is same, i am no criminal but i have long research in this grey economy.
Please stay away from banglore asap.

Most of these PGs are run by the Reddy Community, and most of these guys are Unscrupulous .
I know of a Builder, Rajashekhar Reddy in Bellendur, Green Glen lay Out, who makes atleast 45 lacs every year , by not returning Tenants Deposits. Multiple law suits against him, still no Action. Just imagine, all that Free Money.
Money is their only God, and Making Money their only Motive.

Send a legal notice, in civil matters police can't do much...file a FIR for cheating only then they might interfere...but as your issue is civil in nature police cant do much

we are running gents PG for a bit time in Bangalore, people who comes to us leaving co-live , they often tell like this that they are not getting back the deposit, but what we do is we tell the person to cut the deposit money from the last months payment and pay the remain, even some people cant serve the notice period for emergency , we can understand and give back their deposit. (the rent we charge is also included every thing and if any thing we need to charge extra we write it on paper agreement, without that nothing! )
Empathy and honesty is a necessary thing. I hope you get back your Deposit.
Just focus on building your career and forget these injustice. The system is corrupt and moral values are forgotten. No point fighting. Consider it a petty loss and move on. Hope you buy an apartment soon.

@@roninr8199 I visit court frequently for multiple civil and criminal case. I understand the system deeply. At the beginning I was like you too. In this sisters case, the other party will say her security deposit was reclaimed against damages to the property and she will face a civil defamation case, which will be strongly in their favor because she used the brand name in social media. And even if her complaint is recorded, the file be closed without any action. Trust me, not worth her time & money. On the flip side, if all the occupants of the said PG becomes one party, there are some hopes. But there should be some acceptable evidence, which I don't think is productive.

See you have to hire a lawyer to take this matter in court and again you have to pay a lot to lawyer and then hearings after hearings in the court. You may get justice after 10years. This is the loop hole in the system.

I had same issue with colive. They returned half of my deposit. Since then i stopped getting in any of these branded pgs. They charge you hefty and will take a huge cut from ur deposit or worse won't return it. Local pgs are good and they charge less. It's just you have to do ur research.

i have personally stayed in local pgs that are not branded like colive,stanza,etc. they charge a bit high but there is no harassment of such.i have stayed near kadubesanahalli. Better to stay in such local pgs rather than high end branded pgs

Sister this problem is not with just one PG but almost entire kannada landlords are same. I did my college from bangalore 2007-2010 and stayed in 3 different flats in that period. All the landlords deducted 1 months of deposit when I left their flat without any reason. For ex. In one flat I stayed for 2 years and the day I entered its paint was already quite old. But when I left the landlord deducted 1 month rent as painting charge. When I protested he said that I had given you a newly painted flat. He did the same with the person who used to stay in that flat before me. Can't do anything 😢😢
Making their home as rental home is business and it should be their lookout to do the maintenance tenant already paying enough rent to live there.This is kind of fraud only they want free money in the name of maintenance whoever vacate.

Similarly others who are aggrieved like this case must make their grievance public & more and more people should come out and by word of mouth suggest not to check into such shady outlets & ensure that nobody patronises such outlets & very soon they will be forced to down their shutters for want of customers. This is the only way to discipline such unfair owners of such places.

Simple thing is. Just don't pay the last few months and tell the owner to adjust in security deposit. You have to be extra intelligent in these types of matter.
No no it's not simple it's very complicated they will send goons if you don't pay rent and they don't allow to deduct your deposit as rent I know it happens in North India but bangalore has some different rule to loot people,maintenance cost 1k is fine but they want 12k 15k 25k that too from every Tenant who vacate in a month or two.
Please defame Bangalore as much as possible so that all people leave this city and it will be peaceful like in 90's.

I was thinking of selling my flat, putting that money into stock market and gold for good returns and moving into a rented apartment. Your video has opened my eyes. There is no respect for tenants in India as India is a status driven society. People look down on tenants and look up on owners. So sad.. I think I will just keep my flat. I have been hearing lot of complaints lately about Bangalore from my friends who are there for a job.
means its organised... its the hate for north indians..... thats gooing on.... now its evolved... they want their people only in jobs in their region.... they dont know north indians also contributed to their growth.... anyways... it would be good when we see companies coming to north india now.

Yeah that is another issue for that also police will say go to court.
You need to deal with reputed PG dear. We also take token amount and block the bed for that much days. Suppose we take 3000rs tocken and daily charge is 300 then we block the bed for 10 days and in between you have to come.

Thanks for sharing these things. Its hard to go through these type of situation. Same things happen to me while I stay in one of the PG in bangalore where for no reason they cut Rs. 500 from the deposit money. That time I was not that much confident as well as was hurry for some work, So, not able to do much. But yes now i support anyone who come in my contact about these type of issue. I share this video to others so, that others will not fall in this trap.

Same happened with me in Gurgaon.
They tried to scare me , but i vacated the PG without informing them.
Nobody gets secutity Deposit, Police wont help as they are corrupted by the PG Owners.
Don't be scared and give money. They can't do anything , they will just scare.
For anybody going to PG in the future. Dont give last month rent , adjust it from deposit, because they will not give deposit.
Once you give money. They will not give back.
PLEASE THINK THRICE BEFORE giving your money to anybody.
In todays age once the money is gone its very hard to recover.

This nothing short of a horror story. Thankfully my experience wasn't anywhere near this bad. The pg i lived in was a 3bhk apartment 2 people shared a bedroom but facilities were fine and we received our deposits back. Hope it goes well for others too.

I, too, have very bad experience setting up business in Bangalore, left the state for good and settled in Uttar Pradesh which is too good for setting up business, people are humble, government body and police system actually work here.

They are generating false invoice, electric charges without bill Or individual meters, similar water charges, water tanker charges where not a single tanker came. Food charges including gst where as they say food is complementary.
Food is so bad that we find cockroaches in it, typically risk to health. Our 3 care taker left in past 4 months due to dengue.
Central government has waived off gst on PG/hostel accommodation from jun'24 but still these people charges.

Guys I stayed in Bangalore for 15 years. Very warm people. But now Bangalore has become very bad especially for north Indian. I'm telling this being from Hyderabad. It's better to distribute jobs and IT to different locations so everyone can be happy. Now Bangalore is no more Cosmopolitan. Also, this lady should have rented a home directly.

Before moving to blr, I was considering colive as the pictures were squeaky clean and nice on their property postings. But once I visited some of them they were totally opposite. The whole building had a negative, dungeon kind of vibe. I feel more safer with my neighbors in gated apartments or builder apartments. The rooms were super messy, smell of smoke, alcohol, dimly lit areas. Any one looking for cleaner and safer environment I would urge not to go for such options. Also to mention, I remember it was around 10 pm, and the tenants were still waiting for their dinner to arrive. Hoping OP gets some resolution to her problem.

Different charges for everyone. Different rent. Different set of rules depending on your geographical background. No safety for females, managers are never responsible and never take things up. Shameless bunch of goons. Probelms are never resolved. No power back up, no internet stability. Parking issues. Plus the government has also aided them by including the new gst policies for hostels and pgs from this year.
If i complaint, they straightaway tell me ,"if you don't like u can leave!" .
I have seen multiple complaints on consumer court which aren't escalated. Their main office is in Marathahalli but being a working professional I do not get the time to visit and also thanks to BLR traffic.
They have people in their pockets, the police the people in power etc. that is the only thing that justifies their Audacity

Commissioner Dayanand has given written notice to police to not interfere in civil matters. They'll always tell you to go to court. 100% police and real estate rowdies are hand in glove, they get monthly payment.

First take care of your safety. Always record any interactions with these ppl. Never talk to them alone. Document everything. Atleast try n convince the police to file a PCR and give you an acknowledgement. Threaten the police that you'll go to the Mahila rakshane if they don't. Don't feel safe because of all the internet support you're getting... No one will come to help you.
Request all colive victim to share this video and linkedin details in respective Colive whatsup group. So matter gets higlited more to get attention from gov. authorities.

Police act of 1860 needs to be repealed and new police act should be drafted. Indian police system is neither good for public nor good for police themselves. It doesn't serve the public (surprise surprise - Britishers designed it) it is bad for police officers too. Instead of solving public issues they are busy doing politicians work. And there is no division or meaningful specialization. Same police handles criminal, civil, security etc... Everything is handled by the same police.

First and foremost u shd u learn to read the agreement correctly before signing on it think what you are signing up for. the agreement made by owners will obviously befit them not you. what ever charges are there the interest on them will all be mentioned in the agreement if you blindly sign on it this is what happens. being educated and falling for such tricks is foolish downright. now making sobbing videos is more pathetic. I request everyone to stand up and question before signing on the agreement discuss each and every point negotiate at every point get the agreement balanced. if u cannot do it then you are at the mercy of the PG owner. Since everything is documented especially the charges police cannot do anything. People partying in other rooms are akin to neighbor partying police wont bother about it they are concerned about law and other not occasional parties of individuals unless it can cause law and other issues. For that you shd form a group of people thinking like you and oppose it yourself. Being at fault at every step and crying is very bad.

This is something highly common in most PGs. My team members are living in PGs. And before joining, juniors ask us about accommodation and I always mention to them that you should forget the deposit if you choose PG.
The same thing is in the Pune and Hyderabad location.
Never fall under these things when you are in a growing/learning state. Let them do whatever they want.
