I couldn't believe it when she was on the stand and said "That's why I wrote the op ed" in response to a question about Johnny Depp. While it seemed fairly obvious to most people that the piece was about him, the fact that his name was never specifically mentioned allowed her to maintain a tiny bit of plausible deniability, but when she came right out and said it, she removed all doubt. That wasn't the only time she damaged case with her testimony. She was truly her own worst enemy.
Did Elaine really say that when there was motions in limine to prevent that from coming out to the jury??? Or if she did say it was it because Amber Heard already slipped it out to the jury beforehand?

No, she’s cunning and crafty and weasel-y. Amber on the stand said she “spent” 6 mil, not that she “paid” 6 mil. She knew we would interpret it as paid, but technically, she DID *spend* 6 mil, so she can always defend herself against lying if directly questioned. Also, she can say that she didn’t know if the insurance would stop paying her bills, and so she couldn’t/can’t donate the money because she might need it for legal bills in the future if, as she put it, “Johnny won’t stop suing me.” Also another statement that can argued as technically true. She intentionally misled, but she didn’t “technically” lie, she’s a slithering snake.

The suspension bond is ALWAYS OPTIONAL according to the Virginia code (section 8.01-676.1 subsection C). The misunderstood is because the hearing transcript is missing 5 pages, so she's missing context.

Judges in Virginia CAN NOT impose mandatory suspension bonds, that means IF the party wants to suspend the judgment, THEN the judge says how much is the bond, interests, etc. So AH can appeal WITHOUT the suspension bond if she choses to do so.

Part 2 of 2 : NYM is correct to point out how Pamela/Travelers accepted a 'passive role' in the case management and let Amber's lawyers run wild. (Real Claims Professionals call this 'abandoning the case to counsel.') They also shut-out McEvoy and excluded him from participation, so he withdrew in November 2020. Did NYM fail to provide Amber a defense? Not really. They paid McEvoy. While Travelers chose to pay for a bunch of clowns (which the world saw in action during the televised trial). After McEvoy dropped-out, NYM offered Travelers 50% of (reasonable) independent counsel costs, eff. 11-20-20. Travelers 'ACKNOWLEDGED' the offer, but did NOT accept those terms. (It wanted more.) Since, there was no meeting of the minds, there was no binding agreement. There can be NO breach of contract. Travelers wanted NYM to also pay 50% for the preceding time period (from date of tender to 11-20-20). NYM is correct to challenge the outrageous defense costs that Travelers unilaterally allowed. Remember Pamela's RoR ltr, wherein she 'huffed and puffed' that Travelers will only pay customary rates for competent, local counsel? Then, she doesn't enforce this rule. A money hungry 'shark-feeding frenzy' ensued. Pamela allegedly agreed on 6-10-20 to allowed them to bill at their usual, inflated rates, but put a 'cap' at $2.5M for services up to 'Post-trial motions'. By Feb. 2021, (one-year before the trial started in April 2022) the $2.5M was exhausted (spent). Pamela didn't have the balls to say, 'Well, too bad Elaine. Guess you have to work for free from now on.' By 5-18-21, spineless Pamela strikes a new deal. No more $ cap. But, now you have to bill at our reduced, customary rates. By 3-25-22 Travelers paid in excess of $5M and the trial didn't start yet. Was it necessary for Amber to rent a $22k/month estate in VA during the trial? Who actually paid for it? Did Team Depp do the same? Nope. They stayed at a nice hotel. Apparently, not good enough for Amber. And, Pamela needs to be fired or demoted. She spent $8M in defense costs, when Travelers only had a $500k exposure. (That's 16x more than their policy limit.)

Not "always". My daughter's insurance paid quite well after Hurricane Katrina, and when a tree fell on my car they couldn't have been better. And I'm very much a nobody.
Well, the jury can be told that if they believe someone has lied on the stand once, it can be asserted everything they said was a lie. So, the punishment usually comes in the form of the verdict. Perjury is a more complicated charge than just proving a witness lied under oath.

$10,971,000 suspension bond + additional legal fees. Appeals fail more often than not. If AH supposedly can't afford to pay the $8,350,000 judgement, how is she going to afford to appeal?
The judgment against AH is the $10 million, plus $350,000 punitive. The Judgment in favor of AH against JD for that $2 million is it's very own distinct judgment. Important detail. The parties didn't come to any agreement prior to filing their respective Notices of Appeal. The Court does not offset judgments. AH is stuck.
Only if a DA thinks it's worth pursuing her for perjury. And most DAs don't think it is worth pursuing unless there is very compelling evidence to prove the perjury, such as video evidence.
Is the tax man likely to come knocking. I seem to recall she specifically did not want JD to get the write off advantage so it begs the question if she may have declared that she donated. I don't know how it works but anything is probable with AH at this point.

AH didn’t miss the deadline to post her appeal Bond & neither did JD. She hasn’t put up a suspension Bond that stops JD coming after his $10.03 million ( don’t know about JD ) under Virginia Law a suspension bond is not compulsory in a civil case & it didn’t go down in the final judgment.

There are some jurisdictions where you can't, and that if you *do*, it will nullify your policy. From a personal point of view everything seems to have backfired on AH. I feel sorry for her in the fact that Johnny moved on, she's burnt bridges, being vile framing someone she had manipulated into a marriage for cash. Consequences - now Australia is coming, the UK might reopen, Insurance suing her, run out of cash, Studios cancelling her, globally humiliated, rich musk keeping a great distance, if she is wise APOLOGIZE to Depp privately and maybe even in public take responsibility for your actions and say young people do not follow my path I messed up big time and have leant to start telling the truth and be kind to people. I believe that “New York Marine” and “General Insurance Company” are underwriters collectively referred to as “ProSight Specialty Group”. I find this law suit absolutely fascinating as I used to work with insurance. I would LOVE to read the policies in full! I am also curious about the fact that Travelers paid more than their policy limits and if this will make equitable contribution tricky. They may end up getting a lot less than they anticipate (if it were to be awarded at all considering the “intentional” part. SO interesting …

Emily - I am totally law nerding out. My background is in insurance coverage and case law and I am in California so I knew exactly what you were talking about. So my thoughts...I am curious if Travelers will fund the appeal bond.. Surely AH and Elaine are asking/demanding Travelers to fund it. But Travelers probably (almost certainly) has the same basis to seek declaratory relief against AH as NY Marine / ProSight does (the jury's findings support the same "intentional acts"exclusion is found in most liability policies.) I will be curious to see if Travelers files for declaratory relief against AH. In the end, I think NY Marine will win its countersuit against Travelers - it did enough to comply with the spirit of providing "independent counsel" under California law. I also think most homeowners and general liability policies would have sufficient intentional acts exclusionary language to get a DJ and get out of covering AH based on the jury findings. .
Assuming it is true that the Travelers policy is an HMP policy, Travelers will not fund the appeal bond since the HMP policy has a limit significantly less than $10 million.
Question: Since AH did not pay the $7 million to charities according to divorce (which were scheduled by date & broken up into in $350,000 payments on schedule according to legal docs) when her reason for WANTING Johnny to make a full one-time payment and FORCED him into paying her the entire amount, then never paid it according to schedule (and unlike she said in trial, Elon's payments DID count according to schedule on legal docs), is there any way she can be sued or charged legally for all of that? For breaking agreement between her & Johnny and/or agreement with charities?
She did it to add credibility for her claims about Johnny. The Uk Judge mentioned Amber’s donations in his slander case against the tabloid that printed her abuse claims as a matter of fact in his decision to deny Johnny’s defamation claim.

No, she’s cunning and crafty and weasel-y. Amber on the stand said she “spent” 6 mil, not that she “paid” 6 mil. She knew we would interpret it as paid, but technically, she DID *spend* 6 mil, so she can always defend herself against lying if directly questioned.
Also, she can say that she didn’t know if the insurance would stop paying her bills, and so she couldn’t/can’t donate the money because she might need it for legal bills in the future if, as she put it, “Johnny won’t stop suing me.” Also another statement that can argued as technically true. She intentionally misled, but she didn’t “technically” lie, she’s a slithering snake.

NYM is correct to point out how Pamela/Travelers accepted a 'passive role' in the case management and let Amber's lawyers run wild. (Real Claims Professionals call this 'abandoning the case to counsel.')
They also shut-out McEvoy and excluded him from participation, so he withdrew in November 2020.
Did NYM fail to provide Amber a defense? Not really. They paid McEvoy.
While Travelers chose to pay for a bunch of clowns (which the world saw in action during the televised trial).
After McEvoy dropped-out, NYM offered Travelers 50% of (reasonable) independent counsel costs, eff. 11-20-20.
Travelers 'ACKNOWLEDGED' the offer, but did NOT accept those terms. (It wanted more.)
Since, there was no meeting of the minds, there was no binding agreement. There can be NO breach of contract.
Travelers wanted NYM to also pay 50% for the preceding time period (from date of tender to 11-20-20).
NYM is correct to challenge the outrageous defense costs that Travelers unilaterally allowed.
Remember Pamela's RoR ltr, wherein she 'huffed and puffed' that Travelers will only pay customary rates for competent, local counsel? Then, she doesn't enforce this rule. A money hungry 'shark-feeding frenzy' ensued.
Pamela allegedly agreed on 6-10-20 to allowed them to bill at their usual, inflated rates, but put a 'cap' at $2.5M for services up to 'Post-trial motions'. By Feb. 2021, (one-year before the trial started in April 2022) the $2.5M was exhausted (spent). Pamela didn't have the balls to say, 'Well, too bad Elaine. Guess you have to work for free from now on.'
By 5-18-21, spineless Pamela strikes a new deal. No more $ cap. But, now you have to bill at our reduced, customary rates. By 3-25-22 Travelers paid in excess of $5M and the trial didn't start yet.
Was it necessary for Amber to rent a $22k/month estate in VA during the trial? Who actually paid for it?
Did Team Depp do the same? Nope. They stayed at a nice hotel. Apparently, not good enough for Amber.
And, Pamela needs to be fired or demoted. She spent $8M in defense costs, when Travelers only had a $500k exposure. (That's 16x more than their policy limit.)

Well, the jury can be told that if they believe someone has lied on the stand once, it can be asserted everything they said was a lie. So, the punishment usually comes in the form of the verdict. Perjury is a more complicated charge than just proving a witness lied under oath.

The judgment against AH is the $10 million, plus $350,000 punitive. The Judgment in favor of AH against JD for that $2 million is it's very own distinct judgment. Important detail. The parties didn't come to any agreement prior to filing their respective Notices of Appeal. The Court does not offset judgments. AH is stuck.
She actually has to pay the $10,350,000. She can't subtract what JD "owes" her as it is separate case. Either way she can't afford it.

AH didn’t miss the deadline to post her appeal Bond & neither did JD. She hasn’t put up a suspension Bond that stops JD coming after his $10.03 million ( don’t know about JD ) under Virginia Law a suspension bond is not compulsory in a civil case & it didn’t go down in the final judgment.
As an insurance claims rep that handles stuff like this, I really enjoyed the video. I have seen several other UA-cam lawyers commenting without any real understanding of this area of law. Good job getting it right.

Paying the suspension Bond is not required in a civil case in Virginia . The judge definitely said it but it isn’t in writing on the final judgment.

Yup. Their money is her money from her perspective. This could have been avoided had she taken the divorce money and just kept to the agreement. She got greedy and needed to play the victim it would seem. She really seems to think this wasn't going to blow up in her face.
When I think of ALL the people who are doing tons of work because of Amber's bad behavior, it makes me sick. Johnny tried to avoid this, EVEN THOUGH he was the one being abused. He was fine with divorcing & that's that- but not Amber, and she is the abuser! It seems like it should be the other way around - but there's ONE big difference between AH & JD: Johnny wants a peaceful life, AH wants to prove how bad her emotions feel to the world, & his hell-bent on twisting reality to fit her exaggerated & disordered emotions, caused by things other than Johnny, he's the one being blamed for her emotions.

There are some jurisdictions where you can't, and that if you *do*, it will nullify your policy. (I know this is the case in Alberta and possibly Saskatchewan in Canada, and it's definitely the case in the whole of the UK bc it's in the T&C of just about every insurance policy we've ever had. And yes, I do read these things...)

From a personal point of view everything seems to have backfired on AH. I feel sorry for her in the fact that Johnny moved on, she's burnt bridges, being vile framing someone she had manipulated into a marriage for cash.
Consequences - now Australia is coming, the UK might reopen, Insurance suing her, run out of cash, Studios cancelling her, globally humiliated, rich musk keeping a great distance, if she is wise APOLOGIZE to Depp privately and maybe even in public take responsibility for your actions and say young people do not follow my path I messed up big time and have leant to start telling the truth and be kind to people. She could possibly recover but through humbling herself genuinely. It may take years but she can recover but if she continues this way, there may not be a way back.

yes but Emily is wrong about the suspension bond this time, watch Robert Byrne's "Why Amber Heard Does NOT Need To Pay a $10.35M Bond To Appeal Her Case" vid.
The suspension bond is ALWAYS OPTIONAL according to the Virginia code (section 8.01-676.1 subsection C). The misunderstood is because the hearing transcript is missing 5 pages, so she's missing context.

I find this law suit absolutely fascinating as I used to work with insurance. I would LOVE to read the policies in full! I am also curious about the fact that Travelers paid more than their policy limits and if this will make equitable contribution tricky. They may end up getting a lot less than they anticipate (if it were to be awarded at all considering the “intentional” part. SO interesting …

Emily - I am totally law nerding out. My background is in insurance coverage and case law and I am in California so I knew exactly what you were talking about. So my thoughts...I am curious if Travelers will fund the appeal bond.. Surely AH and Elaine are asking/demanding Travelers to fund it. But Travelers probably (almost certainly) has the same basis to seek declaratory relief against AH as NY Marine / ProSight does (the jury's findings support the same "intentional acts"exclusion is found in most liability policies.) I will be curious to see if Travelers files for declaratory relief against AH. In the end, I think NY Marine will win its countersuit against Travelers - it did enough to comply with the spirit of providing "independent counsel" under California law. I also think most homeowners and general liability policies would have sufficient intentional acts exclusionary language to get a DJ and get out of covering AH based on the jury findings. .
Assuming it is true that the Travelers policy is an HMP policy, Travelers will not fund the appeal bond since the HMP policy has a limit significantly less than $10 million.

Question: Since AH did not pay the $7 million to charities according to divorce (which were scheduled by date & broken up into in $350,000 payments on schedule according to legal docs) when her reason for WANTING Johnny to make a full one-time payment and FORCED him into paying her the entire amount, then never paid it according to schedule (and unlike she said in trial, Elon's payments DID count according to schedule on legal docs), is there any way she can be sued or charged legally for all of that? For breaking agreement between her & Johnny and/or agreement with charities?
She did it to add credibility for her claims about Johnny. The Uk Judge mentioned Amber’s donations in his slander case against the tabloid that printed her abuse claims as a matter of fact in his decision to deny Johnny’s defamation claim.
It was mentioned in the trial AH refused to sign the payment schedule by the ACLU .
