The legal implications of prosecuting someone who has received a preemptive blanket pardon are complex and raise constitutional and procedural questions. While a pardon can prevent punishment, it does not necessarily erase the underlying facts or prevent other legal consequences. 1. Prosecution and Conviction Despite a Pardon • Guilt Determination: A pardon does not prevent prosecutors from filing charges, conducting investigations, or presenting evidence. A court could still find the individual guilty, but the pardon would prevent sentencing or punishment. • Historical Precedent: Some legal scholars argue that a guilty verdict could be reached to establish a historical or legal record, even if the pardon prevents consequences such as prison time or fines. 2. Limitations of a Pardon • No Protection Against State Prosecutions: A federal pardon only applies to federal crimes; it does not shield individuals from prosecution at the state level for equivalent or related crimes. • Civil Liability: A pardon does not cover civil cases. The person may still face lawsuits and financial penalties resulting from their actions. • Future Offenses: A pardon covers only past actions. If the individual engages in similar illegal behavior after receiving a pardon, they can be prosecuted for those new offenses. 3. Symbolic Convictions In some cases, prosecutors may pursue charges even if sentencing is off the table to establish wrongdoing in the public record. This could serve as a political or symbolic action, reinforcing the idea that the person committed a crime, even if they are legally shielded from punishment. 4. Self-Incrimination Issues While a pardon removes criminal liability, accepting a pardon is often interpreted as an admission of guilt. However, individuals may still invoke the Fifth Amendment in future proceedings if admitting details could expose them to state prosecution or civil liability. 5. Political and Ethical Considerations If a prosecution is pursued despite a preemptive pardon, it may lead to political debates over executive power and constitutional limitations. Some legal scholars suggest that extreme misuse of pardons could be challenged under the principle of “abuse of power,” potentially leading to congressional action or judicial review. Conclusion While a preemptive blanket pardon can prevent punishment, it does not necessarily stop prosecutors from pursuing a case to prove guilt. Courts might still render a guilty verdict for historical or procedural purposes, but sentencing would be blocked by the pardon. However, individuals remain vulnerable to state-level prosecution and civil lawsuits, which are unaffected by federal pardons.

There should never be preemptive pardons. That gives people a free pass to do whatever they want. What a load of crap. When Trump leaves office he should preemptively pardon all Republican politicians and voters. I mean if we are going to create a country of lawlessness then why should it be only for a select few?
According to the law, you have to be able to articulate a crime in order for a crime to exist. Without being able to articulate a crime based on reasonable suspicion, its considered a “hunch” which by law would be considered “UNreasonable“ and therefore no investigation, charges, nor prosecution can be brought. In order to be pardoned from prosecution of a crime, you have to have been found guilty of a crime, which a person was prosecuted for after reasonable and credible evidence proved beyond a shadow of a doubt that a crime was committed after an investigation was conducted based off of reasonable suspicion to believe that you have been engaged in criminal activity. With this said, Joe Biden needs to be able to articulate a crime that he believes his family, Dr. Fauci , Liz Cheney etc have all committed to justify a blanket pardon. Without being able to articulate these crimes, which would essentially be in admission to guilt, a pardon cannot exist. Conclusion based on my interpretation of the law. It should be open season For the Trump administration to revoke their pardons, investigate them based off of reasonable suspicion that they have all committed crimes, and bring the appropriate charges if crimes were found to have been committed.
Joey thinks he shredded the US Constitution on the way out. Oh will he be surprised? The SC will get involved. He just pointed out who our Govt should look at. What a fool.

Does not the existence of these pardons, eliminate the right of these individuals to invoke the 5th amendment? This is the way that 'immunity' granted to witnesses eliminates -their- ability to invoke the 5th amendment. You cannot invoke the fifth if your statements cannot be made to incriminate you. However, you can still be guilty of perjury when testifying as that is subsequent to the pardons. The pardons only cover 'actions' taken prior to the pardon. Bring them in and make them sing.
We need a new law that stops pardon power on the day before the election. If a pardon is used the President should face the voters after the final pardon.

Exactly! He needs to be charged, then we can address the blanket immunity. I'm not sure how someone can be given immunity when there are no charges to begin with.
Biden just shutdown Trump, funniest part of all Trump will be kicked out of the WH for life in 2028 so good luck locking up Hillary Clinton since 2017.
This also needs to be investigated. Competency could play into the validity of many things in addition to legitimacy of the pardons.
I think there might be a case for this.
@@markwilder3146 Biden knows all too well what's coming with Trump. I would argue its you who is 'cognitively' slow. Trump is an authoritarian dictator with immunity who is power hungry, and we should all be concerned.

He cant authority to grant clemency, encompassing not only pardons of individuals but several other forms of relief from criminal punishment as well.1 The power, which has historical roots in early English law,2 has been recognized by the Supreme Court as quite broad. In the 1886 case Ex parte Garland, the Court referred to the President’s authority to pardon as unlimited except in cases of impeachment, extending to every offence known to the law and able to be exercised either before legal proceedings are taken, or during their pendency, or after conviction and judgment.3 Much later, the Court wrote that the broad power conferred in the Constitution gives the President plenary authority to 'forgive’ [a] convicted person in part or entirely, to reduce a penalty in terms of a specified number of years, or to alter it with certain conditions.4 a 5-4 decision, the Court ruled that Nixon was immune from Fitzgerald's civil claimsNixon v. Fitzgerald, the Supreme Court held that presidents are "absolutely immune" in civil cases when the action at issue falls within the "outer perimeter" of their official duties. Nixon was "entitled to absolute immunity from damages liability predicated on his official acts." The Court considered the immunity as a "functionally mandated incident of the President's unique office, rooted in the constitutional tradition of the separation of powers Courts do not have jurisdiction over civil lawsuits for damages that stem from a president's official acts.
Pre-emptive pardoning shouldn't exist; its a blank check to commit crimes. No pardons for charges not brought. Republicans need to test these pardons, and if need be it should go to SCOTUS.
Joey just opened Pandoras Box. But he is such a fool he doesn't realize it. Nor do the Dems. I expect outrage from that side because payback is coming. You can bet the farm on that.

GregGutfeld and others here (6:50 - 7:23) talk about how Fauci could be brought in by say, Sen. Rand Paul, for questioning and that he would have to show up and testify, and sounds like the Jan.6thCommittee thing would also apply.
Dems say that no one is above the law, Rand Paul or others bringing them in would be lawful, so Dems should support it.
They are stripped of their 5th Amendment rights, as others have said, because of preemptive pardons.
They can say they "don't remember.'
The legal implications of prosecuting someone who has received a preemptive blanket pardon are complex and raise constitutional and procedural questions. While a pardon can prevent punishment, it does not necessarily erase the underlying facts or prevent other legal consequences.
1. Prosecution and Conviction Despite a Pardon
• Guilt Determination: A pardon does not prevent prosecutors from filing charges, conducting investigations, or presenting evidence. A court could still find the individual guilty, but the pardon would prevent sentencing or punishment.
• Historical Precedent: Some legal scholars argue that a guilty verdict could be reached to establish a historical or legal record, even if the pardon prevents consequences such as prison time or fines.
2. Limitations of a Pardon
• No Protection Against State Prosecutions: A federal pardon only applies to federal crimes; it does not shield individuals from prosecution at the state level for equivalent or related crimes.
3. Symbolic Convictions
In some cases, prosecutors may pursue charges even if sentencing is off the table to establish wrongdoing in the public record. This could serve as a political or symbolic action, reinforcing the idea that the person committed a crime, even if they are legally shielded from punishment.
4. Self-Incrimination Issues
While a pardon removes criminal liability, accepting a pardon is often interpreted as an admission of guilt. However, individuals may still invoke the Fifth Amendment in future proceedings if admitting details could expose them to state prosecution or civil liability.
5. Political and Ethical Considerations
If a prosecution is pursued despite a preemptive pardon, it may lead to political debates over executive power and constitutional limitations. Some legal scholars suggest that extreme misuse of pardons could be challenged under the principle of “abuse of power,” potentially leading to congressional action or judicial review.
Conclusion
While a preemptive blanket pardon can prevent punishment, it does not necessarily stop prosecutors from pursuing a case to prove guilt. Courts might still render a guilty verdict for historical or procedural purposes, but sentencing would be blocked by the pardon. However, individuals remain vulnerable to state-level prosecution and civil lawsuits, which are unaffected by federal pardons.
They are so disgusting, I hope under Trump still go after them . Nobody above the law period .

Can parsons be revoked then? Surely hope so!

Pardoned people who didn't have convictions? That sounds guilty of something to me
Does not the existence of these pardons, eliminate the right of these individuals to invoke the 5th amendment? This is the way that 'immunity' granted to witnesses eliminates -their- ability to invoke the 5th amendment. You cannot invoke the fifth if your statements cannot be made to incriminate you. However, you can still be guilty of perjury when testifying as that is subsequent to the pardons. The pardons only cover 'actions' taken prior to the pardon. Bring them in and make them sing.
Corruption. Disgusting. I voted 4 Biden and switched to trump. Praise God!
We need a new law that stops pardon power on the day before the election. If a pardon is used the President should face the voters after the final pardon.
