    You showed the wrong emergency at 3:17 , I'm sorry but you meant the one below it. Alexander Lukashenko runs Belarus not Syria. There are alot I can see how you got confused.

    The Lincoln case is even more complicated than the video suggests. The concept of "legal presidential emergency powers" did not exist. In fact, the doctrine of "nondelegation" was still a part of accepted Constitutional law, so even if Congress passed a law providing for emergency powers, it would've been struck down as unconstitutional. What I just wrote makes it seem like an open-and-shut case against Pres. Lincoln, but that's ignoring the context. Lincoln (together with nearly everyone in the northern States - even his political opponents) firmly believed that secession was unconstitutional (and having read the Federalist Papers thrice over, I suspect he was right). He further believed that the Constitution could not exist *at all* if secession was tolerated. Lincoln locked up individuals in Fort McHenry who were trying to get Maryland to secede. This was especially dangerous to the Federal Government because it would've meant that DC would be completely surrounded by seceded states. Lincoln argued that the Constitution empowered him to do whatever was *absolutely* necessary to keep to government functioning - including protecting the Congress. He also argued that even if he was not so empowered (though he claimed to believe he was) it was necessary to amputate the limb (the part of the Constitution forbidding this one action - if there was one) in order to save the whole life (the entire rest of the Constitution, including the Bill of Rights). I'm not saying he was correct, and his actions were therefore not illegal, I'm only saying there is a rational case that his actions were not illegal. In other words, it's a solid "maybe."
    EDIT: All this happened after the bombardment of Fort Sumter and the Baltimore riots. Actual lethal violence had been done on federal personnel, sometimes even on federal property. Lincoln was trying to protect authorities from additional violence while upholding the law as he understood it - for better or worse.

      The assassination had nothing to do with the writ of habeas corpus. Booth himself told a friend he was going to assassinate the President to prevent black people from being granted the right to vote.
      (Yes, I know this is a joke, but some people unironically believe that Lincoln was a villain, so I felt the need to speak up, even though that doesn't seem to be what was intended here)

    They declare emergencies for the same reasons that they will never undeclare them. By declaring emergencies they open up new and easier doors to money and power and the ability to make random laws on a whim and enforce them using federal troops and officers and they can skirt the due process of law. These are just a few of the more obvious reasons, there are many more and none of them benefit us in the slightest and are all intended to help the government in some fashion.

      The reason is more that congress is so bad at getting basic stuff done and also that there is a separation of powers between the president and congress (a very unusual thing in developed democracies; only the US and Korea really do this, although France and Portugal sometimes end up in this situation too).

      Have you read the list of national emergencies that have been declared? Almost all of the ones currently in effect are just sanctions on world leaders or other countries around the world.
      Proclamation 10371 signed in April 2022 bans Russian ships from entering U.S. ports.
      Executive Order 14024 froze the property assets of certain Russian government officials.
      Proclamation 9994, signed March 2020, waived some regulations relating to public health, allowing doctors to see patients over video chat. That proclamation was terminated in April of this year.
      How do these get the president money or power?

    If anyone is interested in some short comparative analysis of the US system v. an actually good one, here's that.
    Brazil has 3 kinds of "emergencies" (they call it "exceptional mesures").
    1) Federal Intervention: used against states that threaten the Union of its constitution and allows the Presidente to withdraw the Governor or assume powers reserved to the state level.
    2) State of Defense: used on a delimited part of the territory in case of serious threat to the Constitution, the public order or in case of natural catastrophes. Some rights can be limited such as freedom of transit and the privacy of phone talks. Maximum duration is 60 days.
    3) State of Siege: the most drastic one, can be decreed onto the whole territory in case of a military attack/invasion or situations the state of defense was unable to resolve. More rights can be restrained (the gov can order people to stay in a designated place and prisoners can be detained in non-jail places). In case of military attack, all rights can be withheld.
    BUT: Congress NEEDS to aprove these measures in the first place and EVERY RENEWAL, for 30 days maximum, needs congressional approval. If the measures continue without it, the President can be impeached. AND, the Constitution can NEVER be amended during the emergencies, so limitations to governmental action cannot be revoked if the President so wants.
    I quite admire these measures as they grant that checks and balances can work properly and are clearly defined by the Constituion.
    The US system is crazy.

    I'm not a Constitutional law scholar so take this with a grain of salt, but I think there is an argument that what Lincoln did was at least somewhat constitutional, since Article I, Section 9 of the Constitution lays out that the writ of habeas corpus (the thing that keeps the government from locking you up for no reason) can be suspended "when in Cases of Rebellion or Invasion the public Safety may require it." Also an example there of the emergency powers the Framers did write into the Constitution, because they didn't forget to give the government emergency powers as much as they chose to give it very limited emergency powers.

      I studied Constitutional law for my paralegal certificate (but not that part, IIRC). I'm also a history nerd, so I happened to know beforehand that the issue of the day was that many believed that Article I, Section 9 applied only to the Congress specifically, and that the President could not suspend the Writ on his own authority - only Congress could do that. Of course, Congress was not in session, and the loss of Maryland could've prevented it from ever going into session again. For more information of Pres. Lincoln's counterargument on the suspension of the Writ, I recommend reading Pres. Lincoln's own Special Adress to Congress on July 4, 1861. Read the whole thing, only a small part of it deals with this case, but all of it is excellent.

      A state which has seceded from the United States cannot be held to be in rebellion; as it is no longer under the authority of the United States. The Constitutional crisis that should have been settled, prior to war, is whether secession was Constitutional. This could only have been accomplished by SCOTUS. I just don't know the vehicle to bring it before the court.

      Because ideally, these powers would be used in a situation where action is required immediately, and there's no time to debate. That's why they are "emergency" powers. The problem here I guess is the vagueness of what an emergency is.

      Theoretically, every 6 months after a national emergency is declared, congress is supposed to meet to consider a vote to forcibly end the emergency, and thus the powers granted by it. However, congress has never done this, despite being supposed to.

    This was probably my favorite of all the HAI videos so far because it is not just informative and entertaining, it is satirical and pointed.
    I would love to see someone run on the "prevent the President from being able to give themselves emergency powers" platform, but, alas, I don't see anyone doing that anytime soon.
    It would be great if national emergencies, if we need them at all, had to be both declared and renewed by acts of Congress, not the President. But Congress has become so divided and dysfunctional that I can sort of see why the President thinks it's their job to do this.

    I totally agree with everything ur saying but I feel like you intentionally left out the part on EO 13224 right after "intended to relieve human suffering" that says if the donations are coerced, would endanger military forces, or if it would inhibit the president's ability to control a situation. That last part is the main problem in my opinion, that gives it too much broad authority, but the whole shutting down charities part was pretty incorrect I feel. I agree with the perspective but the facts do enough to show the problems n truth so no need to exaggerate or bend the words considering that's the main thing the presidents keep doing to abuse said power.

    Most “national emergencies” aren’t all that interesting. The Act is now mostly used as a way for the president to impose sanctions on members of various dictatorships or terrorist groups.       Nothing. Presidents weren't abusing the ambiguous national emergency power before then (more importantly, Congress was actually functional back then, so any of those procedures that were worth doing for more than a year would have simply b3en passed by Congress)

      People who like learning things often know a lot of things already...who would've guessed.
      Also, a lot of commenters are subscribers, so we are more likely to notice errors in something that is presumably intended to be accurate.
      That being said, this video was mostly accurate, as far as I know. I never went through the full Congressional Research Service report on national emergencies, so I can't claim omniscience.

    Clearly Sam doesn't know anything about the Constitution or its history.
    It isn't suspended or ignored during an emergency, individual rights are still kept in place. And the government doesn't have any powers not spelled out to it in the document.

      Trump was very rude and talked way more than he should have, but beyond that he wasn't worse than previous presidents. Like Obama built more wall along the border than Trump. Biden eventually authorized the completion of some of the wall construction Trump started. Both Obama and Biden deported more illegal immigrants than Trump and both used the same "cages" for kids. Trump got us out of Afghanistan (yes it happened while Biden was president, but only because Biden did not halt Trump's exit plan), got most of our troops out of Syria, had middle eastern countries agreeing to make peace with Israel, was the first leader anywhere to deliver real firepower to Ukraine, and stopped north korean ICBM tests with a single day of chatting. Also, that vaccine yall love so much was completed in record time due, in part, to the efforts of the Trump administration.

    It's funny how Sam can research things so well yet then inject random nonsense that if you would just spend 10 seconds on he would realize is wrong.
    If it's easy for him to buy a gun then it's because he already has a concealed carry permit, which means you took a class and you gave your fingerprints to the police.
    I'm willing to bet that since Sam thinks it's easy that means he doesn't have a permit so he would need to go to a federal firearm licensed dealer, pass an NICS background check (note that this is the universal background check politicians don't want you to think have), then depending on the type of gun and jurisdiction you would need to wait 3 to 5 days.
    It's also important to realize that the gun show loophole is a myth. The vast majority of gun shows will kick you out if you attempt a private sale, this is because 9.9 times out of 10 it's an undercover ATF agent (worse they are trying to coerce you into making the sell, something that is illegal)
    Also unless you have proof of sale the you can be charged if a crime is later committed with the firearm making most individuals stay away from private sale.
    I wish Sam would research things before just relying on partisan talking points.

      I've only bought one gun from an FLD. It was this year and the time between choosing one and walking out with it was under 10 minutes. There was no fingerprinting and I've never attempted to get a carry permit. I loved that. Still prefer buying from yard sales and flea markets though

      @@CaptainMisery86 the proper acronym is FFL. There is only a waiting period depending on your jurisdiction and what you are buying (long gun or handgun), for instance my country has a waiting period for hand guns but not long guns.
      Finger printing only happens if you apply for a concealed carry, typically refered to as a CCW. Depending on weather you live a CCW is required to legally carry pepper spray.
      You may have not realized this but you filled out a form for a NICS backgroundcheck, you needed a valid ID for this.
      You are likely never going to see firearms sold at yard sales or flea markets, unless they are also FFLs.
      If someone is willing to do a private sell with you on a firearm and you don't personally know them they are either a back market criminal or federal law enforcement, I would highly suggest not doing this.
