I've noticed an interesting change in PCSO's over the past 12-18 months. They've not only stopped carrying designation cards but also started to say that they don't know what they are. More recently they've started referring people to the various police forces websites.
Now, during this time, its worth noting that the regulations surrounding PCSO's and designation cards hasn't officially changed. It's become so wide spread that I can only assume that it's a concerted effort by the police to faze out the cards and give PCSO's defacto powers and force a legislation change?
People might think that's not possible. But I would argue that 3 years ago I wouldn't have thought it possible to pass a law that effectively makes protesting illegal? Or that forcing people to take a vaccine that's not 100% safe is being seriously debated? But here we are. The great power grab of the 21st century.
I'm just speculating here but, if nothing else, there is definitely a pattern here.

    • @bedpansniper
      @bedpansniper 2 роки тому +1

      Good point!
      Bare with me...
After ww2 there was a shortage of qualified nurses, so they allowed some auxiliary nurses who had completed a lesser 2 year, more practical training programme to register as nurses. These were the enrolled nurses, they had similar roles as the Registered nurses bur never held management positions or training roles.
Sounds a bit like the way PCSO is going to me. Give it a coupe more years and they will have power of arrest, but won't have many career opportunities past beat Sargeant.

Absolutely. They brought in coof AND BELIEVE you me it was DELIBERATE to enforce more powers and take away our freedoms. I said they will soon take away our right to peacefully protest and guess What? They have. This is why we came up against such hostility and physical assaults by the police when carrying out our legal rights to peacefully protest. The vxxs are another story. Things will never get better only worse. They want us totally controlled like North Korea and China.

Wait...Those PCSOs were driving a car equipped with official emergency blue lights and sirens. I thought that only constables were supposed to be in control of fully equipped police cars. So, not only are their uniforms incredibly ambiguous, leading members of the public to believe they are fully fledged officers, they are now being given access to vehicles that will further present this misappropriated impression that they have more powers than they actually do. This is "mission creep" beyond the role that PCSOs were initially intended to fulfill. We predicted this would happen a decade ago, and bit-by-bit here it is. Baby steps so nobody will notice. It's a gradual change from oath swearing constables to a private security service.

    • @johaquila
      @johaquila Рік тому +3

@@nomadiclapse PCSOs (police community support officers) are not exactly analogous to mall cops. It's a type of actual police officers in England and Wales. They are always unarmed and originally they were severely restricted in what they could do (which varies regionally). This is why they must wear different uniforms. Many but not all restrictions were lifted in 2017. Now they can even arrest people in certain cases, but e.g. they can't initiate a stop and search.
It seems that the original intent (at least officially) was to have cheap reinforcements for the police who do all those things for which you don't really need police powers or proper training, and now this has been turned into a trick for creating a new lowest rank of regular police officers with less pay and minimal training.

It could cover workplace tidiness, upkeep, signage, police interaction, non compliance of the law, officer knowledge, bad parking etc. This would give a score and could be presented to the Cheif Constable for actions to improve. It's also an easy answer to the cops who ask "can I help you?"

    LEGALS & Policy
    - failure to identify
    - no designation card - and yes, it’s a card listing their name, their powers, responsibilities and more… or anyone could just show them a page on the internet!
    - wrong uniform. They “should wear a hat when meeting the public” and yes, PCSOs did indeed look like warranted Constables
    - Sergeant (£42,000 pa) thinks PCSOs should have warrant cards, and don’t even know that they must have Designation Cards and be carried and shown on request. His JOB is to manage these people. He just hasn’t a clue. Probably a “fast tracker”. Got a degree, but little else - simply riding the gravy train upwards, regardless.
    - videoed without warning. A policy and GDPR breach.
Cliché … “at this moment in time” I’m not asking for your name. No need to say that Plod phrase at all. Immature Power play by Elvis (thank you very much…)🎼
PS. “Stand over here…Make sure you’re not blocking the entrance”… err, just like the two PCSO Plods did 5 minutes earlier, parking their car on double yellow lines dangerously close to the exit gate, for no genuine reason. To lazy to drive another 5m to make it safe.

Privacy is the issue here and in public when no questions are being asked, then they do not need to record anyway but if they know they want to ask a question and record it THAT is when notification prior to the question being asked must take place. Can we identify an individual directly from the information we have?
If, by looking solely at the information you are processing you can distinguish an individual from other individuals, that individual will be identified (or identifiable).
You don’t have to know someone’s name for them to be directly identifiable, a combination of other identifiers may be sufficient to identify the individual.
If an individual is directly identifiable from the information, this may constitute personal data.
Can we identify an individual indirectly from the information we have (together with other available information)?
It is important to be aware that information you hold may indirectly identify an individual and therefore could constitute personal data.
Even if you may need additional information to be able to identify someone, they may still be identifiable.
That additional information may be information you already hold, or it may be information that you need to obtain from another source.
In some circumstances there may be a slight hypothetical possibility that someone might be able to reconstruct the data in such a way that identifies the individual. However, this is not necessarily sufficient to make the individual identifiable in terms of UK GDPR. You must consider all the factors at stake.
When considering whether individuals can be identified, you may have to assess the means that could be used by an interested and sufficiently determined person.
Basically what this means is a clear image of you (and your voice) is “identifiable data” ie you can be distinguished from others. Remember too that the police have powers to trace your your UA-cam account in certain circumstances. This combines your image, your voice with your data as, for example, IP addresses expressly qualify as “data”. That enough to mandate this rule of announcement in ALL cases.
The other aspect is the Police, via legal representation, have agreed operational terms with the ICO. These include the policy of an announcement. So there is also the second legal aspect of breaching the legally binding agreement of treatment of data. This has many parts including but not exclusively: recording video, recording sound, holding ALL that data in ALL cases for 30 days, if a complaint is made it MUST be released to the individual - and so on. This means ALL aspects of the agreed processes must always be followed or the Police breach their ICO agreement EVEN IF a single part may not qualify in absolute terms.
PS. I take it you’re not legally qualified?

They’re not stupid (well maybe they are but not for doing this) they do it intentionally because the more responses they can get out of you increases the probability if you contradicting something you previously said, thus allowing them to establish suspicion that you’re lying about your purpose there and furthermore to ground a search and seizure of your person.
This is why the best thing to do when talking to the police is to just record, say “I don’t answer questions” do whatever they say but make it clear you do not consent to any searches of your personal effects or your person. Then fight it later in court.

Pretty sure that if they use any designated power then it would be unlawful because they have to rely on that card to use them. So if they want to confiscate someones alcohol in the street and the person asked to see the powers given to them to be able to do that then they need to show it or else they cannot lawfully take their alcohol as per the law.
They also need to be in uniform any time they need to rely on their designated powers. All he showed you was some online information page about PCSOs
