Great Video! I Just started getting divorce spousal benefits. I never knew this even exsisted till recently. My ex and his lawyer tried that on the day of our divorce hearing. My attorney pointed out to the judge that we would be three weeks shy of ten years if it was decreed that day. He made special instructions in open court that our decree should not be booked and paged for another month to make sure I was able to access benefits. He was so disgusted by the end of the long drawn out process my ex and his lawyer created.

And the Battle Creek, Michigan office is full of liars besides extremely rude. They said they do NOT do in office appointments at all, when I requested an appointment. While waiting for my ride home, 3 men came out of the building with papers in hand. I was the only person in the front at the reception window and no one was in the waiting room except the guard who made a smart- mouthed comment to my request. I wanted an in office appointment so I could see what the worker was looking at on the computer screen, and be able to view my file, and know who I'm speaking to. Another woman entered & exited while I waited for my ride. She was told the same, no in office appointments too. But she watch 2 of the 3 men come out of the building also.
@@denisewilson8367 The security guard at the Rock Hill, SC Social Security office is very rude too. I've been several times and he's been rude each time. Once I talked with a rude heavy man who acted like I was a nuisance, and another time the person attempting to help me could barely speak English.
They have been rude in Greensboro, NC too. I went during my divorce to seeif I could get disability. After hours I finally saw a lady. She only talked to me for a for a minute. She said I didn't have the required work credits in recent years, so I wouldn't qualify. I asked her what do women like me do. She said, "your husband will be your disability payment, and your attorney will make sure of it." My attorney was horrible. She was yelling at me at mediation that I had to accept the offer from my ex or come up with an additional ten thousand dollars for her just to step foot in a court room. I was crying. She had told me it wouldn't be any problem to get permanent spousal support. I signed and only got ten years. She had been paid twenty thousand that my mother gave me. She took a loan out on their house. My dad was deep into Alzheimer's. It's been a nightmare. My ex makes several hundred thousand a year. I'm trying to find an attorney to help me. We have something called change of circumstances here. I'm destitute.
I'm doing my daily training by going back to some of your old videos because I just saw one by a woman who was giving some slightly incorrect information. I wanted to be sure that I was correct!
My x husband worked for the uprr. It has all kinds of deep stuff to understand. I waited forever and never got married because my dad thought I was going to get all this money but we think we figured it out that since I’m divorced I can’t get the amount of money I would get if I was married still. I finally just got married and I’m going to take my money from my own working record.
SSI ends at age 65 yrs old and then they would change you over then to a percentage of his amount if you were married the 10 yrs and his payed more than your retirement security
@@DebLindley-xg8gz SSI is for people with disabilities. My disabled son is 35 and has been on it for years. You can take your own social security as early as 62, but the age for full benefits is different depending on when you were born. It's so complicated that I think it is important to learn from an expert like Dr. Weir so you at least know what questions to ask to make decisions for your particular circumstances.
I just barely had a representative tell me that my ex has to apply before I can get my ex-spousal benefits. What can I do? I was told just last year that social security requires me to apply for spousal benefits since I am on SSI. and 62 years old.
If they told you wrong like that, then ask to see a supervisor and tell them you want to file for Independently Entitled Divorced Spouse benefits and start them when you first asked last year. Take care, Ed
Don't forget DAC The Disabled Adult Children Program. I worked with Intellectually Disabled Adults ( Disabled before 18 years old, says 21 now) which received Social Security & Medicare as Adults from Parent Social Security.
I work for a school, and was told SS will take 2/3 of my 1/2 of my ex-husband’s SS, simply because I didn’t pay into it (I did when I worked other private sector jobs- was told I won’t get Social Security I had paid from them either). Can this be revisited by Social Security and revised ? -is there a way to get this started? If my husband had died and I had to draw from his Social Security, they still would’ve taken 2/3. Why would any Public employee marry someone who pays into SS, knowing they’ll never receive survivor benefits?

I have recently filed for S.S. I turned 62 five months ago. I filed because of a chronic illness that prevents my working. (Yes, I have applied for disability as well). Question; case worker asked me to send my marriage and divorce papers from my first husband. ( married almost 15 years). Am I correct in understanding that because I remarried ( second husband passed away after almost 6 years of marriage. And because I remarried after his passing, that disqualifies me from receiving spousal benefits from my first husband? Just wanting to have clarity in order to plan for living expenses (regardless of disability qualification). Thank you for your time.
If you are not now currently married or you remarried after the age of 60, you might be eligible for benefits on your first husband. That is probably why they asked for the documentation. To determine that eligibility. If you would like to support this channel, consider buying me a coffee or beer: ko-fi.com/edweir ...and no worries if you can't tip, I appreciate you being here!
I was on SSI then I went in for review and the only one, when I was done and I turned in my paperwork the man at the window said I was looking at some quite a bit of money and I didn't know what to say but he went on to say your due survivors, Widow benefits but I won't get that amount of back pay we will have to Penalize you, l was 54 at that time he said l should have applied at 50 ,l was never told this, can I get the Back pay and when should I get on my own record?
Its not that much and you lose the disability benefits also that's subtracted . You don't get that much on surviver benefits and all only go back 2 yrs but you can apply later
My ex husband is 8 years younger than me. Married 12 years. Forced me to not take any of his military retirement. I’m 64 this year. I’ll have to wait until he is 62, me 70 before I can get my increase or him passing away? Correct?
If your ex-spouse hasn't filed for benefits yet, then you will have to wait for 2 years. If that person has filed for benefits, then you don't have to wait for 2 years.
the oklahoma city office made me provide my ex spouse’s phone number or they were going to deny my case/filing - i didn’t even know his number & had to get his number from our son - that ss rep just opened a can of worms cause i don’t think the ex believed that it was not going to affect his retirement & they did not go back to my protective filing of at least 4 months

Now I live on a pill to survive. When we were married he worked for his father was to get the business but left me high and dry . While he bought a house for a half million. I raised our three kids and worked when I could but became so sick I had to quit. Lost my sss cause it had no name until 12 yrs later. I get under a grand a month to survive it wasn’t even a couple years he got the business. Can I get it and retro? I was screwed hard had no one to help me.

Two days ago I called social security and waited over an hour. I was asking about divorced spouse benefits. I gave her the info including for ex spouse. She would not give me any idea on what the amount might be (married over 23 years), and told me to call back whenever the ex spouse files for benefits! I told her that I did not think that was accurate, and she simply copped an attitude and repeated herself. 😕
Yes, she was definitely 100% wrong. If there's any money left there, then you are entitled to it if your expouse is, at least 62 years old. Unfortunately, you're gonna have to call again. And specifically, say those words independently entitled divorced spouse.
I am currently married am fra and was on ssi disability from 2004 till 2016 when I remarried at age 59 and lost eligibility due to his income - I am currently collecting retirement social security of $220 a month-the Social Security office says I am not eligible for divorce spouse benefits from my previous spouse of 11 yrs back in the 80’s because I remarried under age 60- but my understanding is that if I was disabled and collecting disability at 59 I am eligible? I was on ssi not ssdi
SSI is not the same as SSA disability. No such thing as "SSI disability". You may have been 'disabled' and unable to work due to your health but not approved "SSA DISABLED"
Get another lawyer. Second opinion or a second pair of eyes analyzing the situation, could make you eligible. I'm not married, but try again. Don't stop at the first No from SsA or your lawyer. Blessing to you.
Dr. W mentioned all the ways to appeal a decision. You can keep bothering them, ask for a supervisor, ask for the Assistant District Manager or District Manager, Call the Area Director's Office, Call the Regional Office, Public Affairs office, try to get help from your Congressperson, and last (but takes a long time) request a hearing with an Administration Law Judge.
@@mrssonjayoung7572 My son has autism, too, but also physically disabled in a wheelchair. They denied him SSI, but one letter from a lawyer and they reversed that decision. He is total care. In January 2024, they switched him to his father's SS which is several hundred more than he was getting on SSI. After 2 years, he will be eligible for Medicare as well as the Medicaid (Waiver) he has been on since he was in elementary school. Then I can drop him from my private insurance without worrying he might have to pay for his medical care. If your son is a still a child, be sure and get him under your guardianship before he turns 18 if he is likely to always be dependent. It is much easier to do it then than try to interdict an adult. You have to go to court for both.

Can I get information regarding my ex spouse’s amount before either of us retire? I’m trying to plan ahead and am wondering if filing under his benefits is even a remote possibility.

I was told I made more than half of my ex spouse’s benefits which I don’t believe is true because I was the lowest wage earner in the household & also stayed at home to care for our two children. SSA told me that I can only get a percentage of his benefits (not the full amount he’s getting) when he dies.
And a lot of people don’t understand that when you are married, and you lose a spouse, and you file your federal taxes at the beginning of the new year for the previous year, you file as “widow” and you can file three consecutive years! The year the spouse passed away and two years after that you would file as “widow”. Wow, my mother-in-law. OK let me back up. My father-in-law never learned to read, but he worked. He was able to get disability and later on some type of retirement and it all leaked out to around 2000 a month. My mother-in-law and my father-in-law were divorced. Mother-in-law was deaf. She worked full-time most of her life and then she came of age to collect Social Security at age 65, so she collected her SS she was living on like $560 a month. Later on so many years later, she went to the Social Security office and she says can I get disability? And they said no you’re already on Social Security. Well, she’s passed away now, but she really struggled and got the end of the stick!
I currently receive widow benefits on second marriage. I turn 70 in 2025. I will apply on my own. Will I collect anything from decease spouse and divorce spouse I was married to over 10 years?

I understand that if I get divorced. My wife whom doesn't qualify for her own benefits can collect under mine. My question is. Can my benefits be garnished on top of that for alimony.
My ex is a computer expert, very shrewd and bitter. He has been self employed since our divorce in 2004. Are all earnings reported to social security based on gross earnings or only net earning when self employed? On the SSA site, if he waits til 70 to claim his benefits (which he will) he will receive $1069/month. He regularly made more than $100k per year, while I made about 1/3 of that. Is it possible to take the majority of your self employed income and write it off on deductions? Thereby reducing reported income to the government dramatically ?
The highest benefit is only a few grand amount so at 50% spousal if you waited till he is 65yrs old your looking at approx $1500 a month to live on with out any other income the amount drops with other income also.

10:37 he decided while married to opt out of Social Security for a retirement plan- what about his SS before the decision?
thank you for your time
Just an interesting tidbit..I worked for Social Security for 7 years in the 70s...
I wonder if you were hired with all the SSI employees that were hired at that time.
Thank you for the info…
I’m getting widows benefits now, I’ll be 62 this year, how/what you I do to file for divorced benefits????
very helpful Thank you !
You're welcome!
I'm doing my daily training by going back to some of your old videos because I just saw one by a woman who was giving some slightly incorrect information. I wanted to be sure that I was correct!
Happy viewing!
Mine never paid into the system whala! No benefits!
Wow, he's some kind of special, isn't he? Thanks for nothing, right?
What pay would I get when filing for divorce Back pay, please help me understand
I'd still try to get the ex's benefit amount. It doesn't impact his benefit amount and may increase yours.
If you're currently married, you can't collect IEDS. You must be single.
UPRR workers aren't eligible for SSR benefits. They have their own retirement system.
SSI ends at age 65 yrs old and then they would change you over then to a percentage of his amount if you were married the 10 yrs and his payed more than your retirement security
😅
You can receive SSI aged beginning at age 65.

Awesome!
Dr Ed indeed it’s a great information 👍🏻✌🏻🙋🏼♀️
Glad you think so!
Don't forget DAC The Disabled Adult Children Program. I worked with Intellectually Disabled Adults ( Disabled before 18 years old, says 21 now) which received Social Security & Medicare as Adults from Parent Social Security.
Thank you! I've done several videos on that topic.
Disabled before 22 😉
I work for a school, and was told SS will take 2/3 of my 1/2 of my ex-husband’s SS, simply because I didn’t pay into it (I did when I worked other private sector jobs- was told I won’t get Social Security I had paid from them either). Can this be revisited by Social Security and revised ? -is there a way to get this started?
If my husband had died and I had to draw from his Social Security, they still would’ve taken 2/3. Why would any Public employee marry someone who pays into SS, knowing they’ll never receive survivor benefits?

I was told by as that I earned too much money to get survivor benefits. I’ll be 62 in December. They said that I’ll have to wait until I get to 67. Is this accurate?.

Hi, just watched your vid. How early can I inquire / apply on ex spouse's benefits? I am not yet 62 couple more years to go.
My sister is divorced and she was married something like 13 years and she is 63 and she was told she didn’t qualify or couldn’t get it, not entitled

Then the "Federal rules trumping Local Divorce Decrees" should also apply to Federal protection rules of taking away an ex spouse's Spousal Retirement benefits, too, right?

Do you have to be retired to claim spousal benefits?
I applied but was told to wait until my ex spouse was receiving a larger amount. I was married 30 yeats years, can I go now and apply.
I ve been married for over 15 years - we do not live together and I file Head of Household on my taxes. Will this disqualify me for spousal benefits?
With 10 year's marriage not sure how survial benefits work there more for the kids from what i know.
Does this apply in california?
Dr Weir, do you also advise xspouses of social security employees? I need info on how to proceed in getting my deceased xhusbands retirement benefits after being denied by OPM. We were married 40 years. If you also have extensive info on that Zif like to know. Thank you!
Appeal the denial.

Do I have to wait until ex husband to claim SS?
I was on SSI then I went in for review and the only one, when I was done and I turned in my paperwork the man at the window said I was looking at some quite a bit of money and I didn't know what to say but he went on to say your due survivors, Widow benefits but I won't get that amount of back pay we will have to Penalize you, l was 54 at that time he said l should have applied at 50 ,l was never told this, can I get the Back pay and when should I get on my own record?
Its not that much and you lose the disability benefits also that's subtracted . You don't get that much on surviver benefits and all only go back 2 yrs but you can apply later
And put GOP / WEP in the mix!
Who has b 62 the one filing for divorced spouse benefits or the one being filed on.
My question is, can you get your spousal benefits if you file for early retirement or do you have to wait for full retirement to receive it?
Sorry for delayed response. Please join one of my many live Q&A sessions if you still have questions.
When he turns 62 years old you can file off his but it's about 32% of his benefit amount only.
My ex husband is 8 years younger than me. Married 12 years. Forced me to not take any of his military retirement. I’m 64 this year. I’ll have to wait until he is 62, me 70 before I can get my increase or him passing away? Correct?
Yes, he has to be 62 years old for you to file or deceased.
Wow, nice outfit.
What’s up with waiting two years after the divorce to apply for spousal benefits.
WTH! You really need to file a complaint. They can't do that, legally. Because you met the requirements and provided the documents needed.
You also need to file an appeal for your back pay.
Hello let’s write this again sigh. Married 20 yrs, was very ill no one could figure it out until a dozen years after to which I had multiple tumors on my pituitary and they chopped it off, 3 brain surgeries later.

Go for Divorced Spouse Benefits
@@MyGovExpert This video popped up at the most perfect time. Thanks so much!
As long as he's 65yrs old you can apply but you must make an appointment they won't give info like that on the phone you need to see claim worker

How do I know if he divorce in another country and his ex wife is alive but in another country ..

Wth I just posted a question yesterday and it’s not here argh
I was married for 22 yrs. Divorced and then he passed away in 2015. Am I not entitled to survivor benefits?
You can be eligible for widow ss benefits, yes. You need marriage license and divorce decree
If I am eligible for widows benefits, why did they tell me to wait until I was 67?
@@sandra-r5b2w maybe so you would get the max amount??? Can't say. It could have something to do with your current age.
I missed out by a week for ten years. I told my lawyer and he ignored me. Social security won’t talk to me.
Yea, they are very strict there...it has to be 10 years.
Get another lawyer. Second opinion or a second pair of eyes analyzing the situation, could make you eligible. I'm not married, but try again. Don't stop at the first No from SsA or your lawyer. Blessing to you.
10 years is 10 years that is the rule no exceptions
If you knew that, you could have delayed it yourself 🤷♀️No?
If a child has autism and was removed from Social Security Benefits. What options are available?
@ Thank you
@@mrssonjayoung7572 My son has autism, too, but also physically disabled in a wheelchair.

How about if you were never divorced they still tell you you’re not entitled to it
Maybe he didn't make enough himself?
If you're not legally Divorced, you can't collect IEDS (Independently Entitled Divorced Spouse) benefits.

If you remarried after the age of 60, then yes.
I did not, but thanks for your help.
I was told I made more than half of my ex spouse’s benefits which I don’t believe is true because I was the lowest wage earner in the household & also stayed at home to care for our two children. 60 days in most situations, I do believe. Possibly 30 days, in other circumstances.
I understand that if I get divorced. My wife whom doesn't qualify for her own benefits can collect under mine. My question is. Can my benefits be garnished on top of that for alimony.
It really depends on the court. That's not really a Social Security thing. Social Security just follows whatever the court tells them to do.
@@MyGovExpert thank you
Pay your alimony and you won’t have to worry about being garnished. Yikes.
