Maharashtra's Scenario: 1) Can A Speaker/Dy.Speaker Disqualify Legislators Even If A Removal Motion Of The Speaker/Dy.Speaker Was Already In Motion Earlier, As Is The Case In Maharashtra? 2) Who Gets The Party? How Is Party Ownership Decided In Case Of Splits? Here Shiv Sena President Uddhav Thackeray Says He's The Real Owner Of Shiv Sena Whereas The New CM Eknath Shinde Claims His Faction Is The Real Shiv Sena. 3) Is Merging With Political Party Mandatory? Or Can A New Group Of The Defectors Be Formed ? As Uddhav Thackeray Says These Defectors Are Not Shiv Sainiks And Therefore Technically Eknath Shinde Faction Hasn't Joined Any Political Party. Neither Do They Have Formed A New Political Party. What Is The Solution Over Here To Tackle This Scenario. I Was Expecting These Questions To Be Answered. At the time of making of Indian constitution Dr. Amedkar said accountability of govt to the public is more important than the stability that's why parliamentary form of govt was adopted and supreme court considers parliamentary form of govt as part of basic structure but anti defection law was brought to ensure the stability over accountability thus this law violates the parliamentary form of govt doctrine. Why doesn't the SC declares this piece of legislation unconstitutional on the grounds of destroying the basic structure of the constitution?

Excellent Session. Yet, There Are A Few Questions From This Session Left UNADDRESSED w.r.t. Maharashtra's Scenario:
1) Can A Speaker/Dy.Speaker Disqualify Legislators Even If A Removal Motion Of The Speaker/Dy.Speaker Was Already In Motion Earlier, As Is The Case In Maharashtra?
2) Who Gets The Party? How Is Party Ownership Decided In Case Of Splits? Here Shiv Sena President Uddhav Thackeray Says He's The Real Owner Of Shiv Sena Whereas The New CM Eknath Shinde Claims His Faction Is The Real Shiv Sena.
3) Is Merging With Political Party Mandatory? Or Can A New Group Of The Defectors Be Formed ? As Uddhav Thackeray Says These Defectors Are Not Shiv Sainiks And Therefore Technically Eknath Shinde Faction Hasn't Joined Any Political Party. Neither Do They Have Formed A New Political Party.
What Is The Solution Over Here To Tackle This Scenario.

Sir thanking you for making polity this easy and make my interest defects towards polity....My opinion here is if we dropped this anti defection law the corruption still continues but we need a solution, a way forward to minimise this I thing amendment is a better option...But we also need officers like shri T.N. seshan sir at ECI.

At the time of making of Indian constitution Dr. Amedkar said accountability of govt to the public is more important than the stability that's why parliamentary form of govt was adopted and supreme court considers parliamentary form of govt as part of basic structure but anti defection law was brought to ensure the stability over accountability thus this law violates the parliamentary form of govt doctrine.
Why doesn't the SC declares this piece of legislation unconstitutional on the grounds of destroying the basic structure of the constitution?

Sir for ur kind consideration, in my view, d solution not lies with repealing the act but to reforming it in a constructive way to deal with the current circumstances and also taking into consideration of d futuristic loopholes as d available act hv some gud provision like clause 1.
So we sud keep on reforming as democracy too inherent d evolving nature.

Agreed. If not a total repeal the 10th Schedule needs urgent reforms as suggested in the Video to strengthen democracy and ensure a legislators' freedom of speech and expression.
