- इलाहाबाद हाईकोर्ट की लखनऊ बेंच के जस्टिस अजय लांबा और जस्टिस संजय हरकौली की खंडपीठ ने एससी/एसटी (अत्याचार निवारण) अधिनियम में दर्ज एफआईआर को रद्द करने वाली एक याचिका पर एक अहम फैसला सुनाया...कोर्ट ने साफ किया कि जिन मामलों में अपराध सात वर्ष से कम सजा योग्य हो, उनमें बिना नोटिस गिरफ्तारी नहीं की जा सकती है। यह आदेश संसद में एससी-एसटी एक्ट में संशोधन के बाद 19 अगस्त 2018 को दर्ज एफआईआर के मामले में दिया गया है.. जस्टिस अजय लांबा व जस्टिस संजय हरकौली की बेंच ने कहा कि जिन मामलों में अपराध सात वर्ष से कम सजा योग्य हो, उनमें बिना नोटिस गिरफ्तारी नहीं की जा सकती है। इस ऐसे मामले में गिरफ्तारी से पहले अरनेश कुमार बनाम बिहार राज्य के केस में सुप्रीम कोर्ट के 2014 के लिये फैसले का पालन किया जाए। ऐसे मामलों में पहले आरोपी को नोटिस देकर पूछताछ के लिए बुलाया जाए। यदि वह नोटिस की शर्तों का पालन करता है तो उसे विवेचना के दौरान गिरफ्तार नहीं किया जाएगा।

For SC/ST One time, one reservation, one family policy should be implemented और बड़े दलित का आरक्षण बंद होना चाहिए| sc-st act जांच के बाद ही कारवाही होनी चाहिए, नहीं तो संविधान में न्याय और समानता का अधिकार खत्म कर देना चाहिए. Jai Bhim.
कोर्ट को चाहिए कि कानून को art21,समानता, इत्यादि। भेद भाव रहित आधार पर गाइडलाइन करनी चाहिए और सरकार को नीतिगत योजना,अभियान के जरिये जागरूक हो के sc/st/obc वर्गों से भेद भाव को ख़त्म करने का प्रयास करना चाहिए साथ ही कोर्ट के निर्देशन को गंभीरता से लेना चाहिए।

देखा जाए तो SC/ST कानून में बदलाव होना चाहिए । क्योंकि बिना जांच-पड़ताल के सिर्फ इलजाम लगने से किसी को गिरफ्तार करना न्याय नहीं हो सकता । कोई बदला लेने के लिए भी इस कानून का दुरुपयोग कर सकता है जिसकी वजह से किसी निर्दोष की जिंदगी बर्बाद हो सकती है भारत में सबको अपनी बात कहने और गरिमापूर्ण जीवन जीने का अधिकार है इसलिए सुप्रीम कोर्ट को एक संतुलन का रास्ता निकालना चाहिए , कानूनों का दुरुपयोग रोकने की व्यवस्था की जानी चाहिए ताकि सभी को न्याय मिल सके और सभी की स्वतंत्रता बनी रहे ।

The provision of automatic arrest is done because the victim will be harassed by the aggressor after the registration of a crime. You are putting just your side and neglecting the other side. Many women have misused the anti-dowry act, just to take revenge... and the SC had removed the section 498A of automatic arrest... but later it has agreed to reconsider its decision. This is a totally arbitrary decision by SC where they refused to reconsider the decision on SC/ST Act... Supreme Court has become a joke in this country where CJI decide on a case in which he himself is an accused!! I am glad that this idiot is going to retire in October.
what about rape charges, dowry, domestic violence charges.
कोई भी कानून समाज के हित मे बनाए जाते है लेकिन कानून किसी एक वगॅ के लिए जानलेवा साबित हुआ तो उसपर शोधन संशोधन जरूरी है ।
लोकतंत्र में कानून का एक सिद्धांत है चाहे कितने भी अपराधी छूट जाए पर एक निरपराध को सजा नहीं मिलना चाहिए l मैं मानता हूं की SC/ST Act. कड़े होने चाहिए जिसका मकसद जातिगत खाई को पाटना है, पर जो व्यक्ति 6 महीने सजा काटने के बाद बाइज्जत बरी हो जाए हम उससे यह कैसे अपेक्षा कर सकते हैं कि वह SC /ST लोगों के खिलाफ समाज में जहर नहीं घोलेगा l
आपकी बात से सहमत हूँ ।परन्तु बहुत से क़ानून ऐसे हैं ,जिनमें लोग फस जाते हैं,सजा भी काटते हैं। तो क्या वो लोग बाहर आने के बाद समाज के लिये हिंसक हो जाते हैं।यदि ऐसा है तो हमें अपना नजरिया बदलना होगा।
या फिर क़ानून जैसी चीजों को ही ख़त्म कर देना चाहिए।

government should think in all dimensions before passing any act/law there are various cases where false accused turns out to be innocent but what happens to his life after that getting out innocent...he is seen as criminal,his society scolds him and many other things but nothing settles year after year he is forced to leave his place some commit suicide...I suggest not to make act or law very swiftly under pressure. prevention of atrocities some time itself leads to atrocities on innocent.

Rstv पर जो भी पैनल अपनी बातें रखे वो बहुत ही व्यावहारिक हैं पर एक बात पर ध्यान देना चाहिए कि अधिकांश मामलों स्थानीय थानों मे ,fir महीनों तक दर्ज नही होती और जो अपराधी है डरा धमका के case को खत्म कर देता हैं। आप सभी से ये अनुरोध है कि इस तरह के case के बारे मे भी अपनी राय जाहिर करे, लेकिन आप लोग एक आदर्श स्थिती के बारे मे बात कर रहे है लेकिन जहा पर crime होता है वाहा इतना ideal स्थिती नही होती है।

'SC/STएक्ट और कानूनी पेंच' कार्यक्रम में राज्यसभा के सभी विशेषज्ञों के द्वारा दिए गए सुझाव एवं विचार उच्चतम कोटि के थे, जहां तक SC ST प्रावधानों को लेकर मेरा मानना है कि इसका दुरुपयोग रोकने और इसका सही उपयोग करने के लिए आरोपी के ऊपर जब तक अपराध सिद्ध ना हो जाए तब तक उसे कानून के निगरानी में रख कर जांच प्रक्रिया रख चालू रखी जाए और अपराध सिद्ध होने के बाद ही गिरफ्तारी की जाए, साथ ही आरोपी को जांच प्रक्रिया पूरी होने तक को-ओपरेट करने की अपील की जाए ताकि इस विशेष कानून का सही इस्तेमाल हो सके और दोनों पक्षों के साथ अन्याय होने से बचा जा सके ।

वर्तमान में चर्चित sc&st act महत्वपूर्ण विषय पर आदरणीय विशेषज्ञों के विचारों एवं rstv का धन्यवाद। sc&st act के मामलों में व्यक्ति के मौलिक अधिकारों का हनन नही होना चाहिए एवं जांच करने के बाद ही गिरफ्तारी होनी चाहिए। अपराधियों को जल्द सज़ा होनी चाहिए, पीड़ितों को न्याय मिलना एवं दुरुपयोग को रोकने के लिए सख़्त प्रावधान होना चाहिए तो ही ये अपने उद्देश्य को पूर्ण कर सकेगा।

Instead of weakening the act, there is need to give stringent punishment to the person who makes false complaints. Police must perform their duties without bias.
Our Constitution says that a person is not guilty untill proven and art 14 and 21 which are provided to every citizen. SC ST act violates Constitution . And law should be such that it provide justice to all parties . If by providing special tool to one section of society law is doing injustice with general category . It has been found that SC ST act misused and what about the right of other person and a person who has suffered under this law will going to have hate feeling against SC ST community and this will not going to provide equality and create a tension in society

sc st act me sansodhan ki jarurat hai kyon ki jb is act ko lagu kiya gaya tha to purpose tha ki kisi sc and st person ke sath atrocity na ho, use control kiya ja sake, lekin baad me iske misuse ke result bhi samne aaye jisse ki kai innocent logo ko problem hui, to mera manna hai ki turant giraftari na karke, uski investigation ki jaye aur ek authority honi chahiye jo ye ensure kare ki investigation me transperancy ho aur judgement minimum time me hona chahiye.
SC/ST act was incorporated for the safety of fundamental right of a citizen, but it has took a different way altogethert by helping a community to violate others fundamental right in order to secure the first one.
As a society there is what not more need to be improve , apart, from the cast slangs and above that what really looks a infant decision is that the one who still find cast a slang in 2018.
Wheras people are using F Word and even the appropriate slang so vibrantly that no one really affect with them anymore now.
Such a mockery as a society we are spreading for the whole planet.
Today the major challenges besides any of the cast are:

- Child trafficking
- Increasing Rape and women violence
- Lack of basic needs- (Food, Health & Shelter)

- Absloutely Low manufacturing
- Mammoth Income and wage inqualtiy and so on .
I would urge to everyone, if cant be a help, make sure you are not creating an obstacle for others.
The Constitution has provided right to life & liberty for all so in any criminal case like SC/St act , weaker sections should be protected under Judicial process by the law but there must never be the 'Miscarriage of Justice' .

Justice chandra sir is spot on about arrest and detention of accused as in indian judiciary it is fundamental in nature that no body is guilty unless it is proved. it cant be undermine in any condition. Yes sc st act is imp for the ppl of this communities, but it should not be on the verge of natural justice of ppl of all community. Let the justice take it course without politicising this sensitive issue. No law can be special if it is denying the natural justice of society as a whole.

Agar koi garib h to usko shadi me ghori nhi chadna chahiye naa ki sirf kisi community ko sirf.

Totally Biased debate... No one even bothered to put the side of SC/ST. Rajya Sabha TV looks and conducts like just another new channel. Everyone seems to accept that the SC-ST act is misused, without any hard data. And no one seems to put forward the point that all laws have been misused in some degree by the people. This biased is the only reason that participation is required by the SC/ST in the government and in education. Quality of Rajya Sabha TV is going to dogs!!

Ya, I got the sarcasm. The SC/ST act was made in 1989.. and it was not mentioned in the constitution. I hope you have actually read the constitution! Also, the constitution is flexible until it violates the basic structure of the constitution. I hope you are aware of that also... I am assuming that you are a UPSC aspirant as Rajya Sabha is mostly seen by the UPSC aspirants. That means you are actually not fit for IAS, you don't have any empathy for the weaker section and don't have any respect for the national leaders. I hope you do not clear the examination, It would a great tragedy that a person like you would become a civil servant. Anyway, I am sure they will catch your lies in the interview, if at all you reach there..

I might have missed that debate.. I am not sure how it is justified for a new channel to rig a debate by fully supporting an issue, at one time and opposing it at another time... Balance is required or how else people who appreciate Rajya Sabha TV efforts to maintain quality in content and coverage on actual issues facing the nation, will not see it as any different from the TRP hungry mainstream news channel, who will debate on anything and everything except all the important issues facing the country.
