Yung property co owned by 4 siblings, tapos nagpadala ng SPA yung tatlo na nasa ibang bansa laban sa isa nilang kapatid na andito sa Pinas na kapag di sumang ayon sa desisyon nila eh papademanda nila yung kapatid, at yung magagastos sa attorney, hearings, etc. eh ibabawas doon sa makukuhang share nung kapatid na naiwan sa Pinas oras na maibenta yung co-owned property. Siyempre walang laban yung natirang kapatid doon sa tatlo, wala na nga siyang pera pang kuha ng attorney, losing case pa yung mangyayari kaya walang kukuhang attorney doon sa kaso nung naiwang kapatid sa Pinas, three against one eh majority wins. Ang ending napilitan na lang siya sumang ayon para mabigay share niya ng walang bawas at makaalis siya doon sa property na co-owned nila. Nawalan na ng bahay yung kapatid, namulubi pa siya at panay pa pagbabanta yung ginagawa sa kanya nung tatlo. Atty, Around 56:34 regarding Art. 1678 may I clarify if the lessee a BPS is really in BAD FAITH or it should be in GOOD FAITH for the lessee to be reimbursable of 50% of the value of the improvements?
We have to state the proper context. First, a lessee is not a Builder in Good Faith who is entitled to full reimbursement because he is aware that the property is owned by the lessor. Thus, he is the converse, a Builder in Bad Faith. But unlike a builder in bad faith who loses everything, except necessary expenses or repairs for which he is entitled to reimbursement, a lessee is entitled to 50% reimbursement of his improvements if the lessor decides to appropriate it. The law on lease will apply. BUT NOTE! If the lease agreement prohibits the lessee from introducing improvements and the lessee introduced improvements in violation of the contract, then the lessee is a Lessee in Bad Faith. He can lose the improvements and the contract of lease can also be rescinded and the lessee evicted from the property
Good afternoon po Atty! I hope you can address this question po. Both the 1st party and the 2nd party po ay magkatabi lang. Before the land between the two is divided po, it was occupied by the 2nd party, then later on the LGU donated the other part of the land to the first party, some of the buildings of the 2nd party were covered in the land donated to the first party, such building was utilized by the first party for it's operation. Later on the second party claimed the building and started renovating such, emphasizing that the building is their's despite that the land is owned by the first party and continued with the renovation. How would you rule on this matter po?
