This scene never fails to make me laugh. Bad guys are sitting around hiding and not robbing until Harry leaves. Then they jump up and start waving their guns around and taking hostages BUT STILL NOT ROBBING. And it's in broad daylight, with huge picture windows showing all of the activity to the crowded streets. These guys are geniuses.
However enjoyable this scene is, it’s a bit hard to believe that Harry was so absorbed in his newspaper, that he didn’t notice the sugar trick! Nor did the gangsters!

In a gun battle of the threat is moving then it’s still a threat. Direction of movement is not relevant as we can’t read minds and don’t know the intent of said threat. Plus, you must engage the threat until it’s not able to operate as a threat.
It seems to me that the actor playing the first goon can't hide how much fun he was having during the shoot
