Aquiescing may be true if you simply turn up and 'state your NAME for the court'. But if you rebut the 12 presumptions of law and reject the summons - sending it back to the council, and then turn up anway, Sui Juris, In propria persona (Special appearance) and state that you are there under duress and reject their jurisdiction.. ... then you have made it very clear that they have no claim and no jurisdiction. You then announce their 'constructive trust' as null and void, as you are the living beneficiary, announce the case dismissed, and go. Then follow up with a letter explaining their lack of jurisdiction and their expenses fraud.
Councils don't make "Claims," couldn't be the "Claimant," How can any council, which is a title on a piece of paper, "Speak and be heard because First they would have to be able to write and file that "Claim" and black ink on a piece of white paper cannot do it?
They can try & jail you if you turn up to court and only if you refuse to pay. However, you can withhold payment lawfully until they prove they are not funding terrorism/war, in this country & abroad.

A shame people didn't stand their ground. Quick estimate.. if 7000 people demanded to be dealt with as an individual and each took 40 minutes.. that would be 4666 hours translating at almost 2 1/2 YEARS!! dealing non-stop with council tax working flat out 5 days a week 9-5. TWO AND A HALF YEARS! This would bring the council tax system to its knees if people just DEMANDED to have a proper trial or at least have an opportunity to explain their individual circumstances/reasons etc..
It requires somebody to sit down and prepare a ''To Do Menu'' and somebody else to prepare 'Template letters' and make this all available at a Web Site as open source material. So here is a starter on dealing with Council Tax- There is a process that people need to go thru but NOT turning up to the First hearing when Summonsed by the Council and Not appearing in Front of the Bench is the first critical Mistake. People need to adopt a procedure similar to this format- 1/ On receiving the Summons write to the Council and ask for the ''Contract' whereby you have consented for any disputes to be dealt with and resolved by an ''Administrative Court''. State further that you have no issues with a Magistrates Court but not an Administrative Court. 2/ On attending your Hearing, state that you want to appear in front of the Bench and do not take No for an Answer. In most cases the First Hearing is the Hired in 'faces' and so as they have no powers the matter will usually be adjourned. 3/For attending the second Hearing you will more than likely have received a Letter of the Adjournment which now has a Case Number and the new Court date and time. 4/ .When attending this Hearing it will be in a Magistrates Court with at least a JP as Bench Chair. 5/ Make your Case, on whatever grounds you objecting and the Court will more than likely make an Order for the Council for the Sum they have claimed with Costs etc. 6/ Now you' MUST' ask the Court for a ''Certified Copy of the Order'' with Seal which you will be told by the Clerk to the Court that no copies of the Order are given out but you may write in for an Extract. Then you state that an Extract is Not a Court Order and you require a Court Order. You will again be told no, there is no Court Order Certified Copy available. 7/ After the hearing you then write into the Court Admin and ask for a Copy of the Court Extract which will show that you asked for a Certified Copy of the Order and were informed that was not possible. If your Court Extract does not state this you MUST write to the Court and ask for a Certified copy of the Court Order and make sure the Letter is Recorded Delivery Signed for. 8/ The Council will now send you a ''Liability Order Notice'' making out that its from the Court. 9/ Now write to the Council and ask them for a Certified Copy of the Court Order made on XXXX Date and further state that in accordance with the Local Council ACT of 1888 no Council or Local Authority has the power or Authority to issue Court Orders or produce Copies of Court Orders whatsoever. So insist they send you a Certified Copy with Seal of the Order which of course they cannot as they cannot issue them and the Court does not give out Certified Copies of the Order when its for Council Tax. 10/ .Any Enforcement Officer or Bailiff must have a Certified Copy with Seal of the Court Order from the Court to A] be on the premisses and B] to restrain or Seize assets etc. This is Law as set down in the Tribunals, Courts and Enforcement Act 2007. Schedule 12 which details that the enforcement officer must show their identity and the Proof of Authority from the Court that entitles them to be on the premises. And it further states in in the 2007 Act Schedule 12 at - Paragraph 25- [3] The authorisation - [a] may be by Order or in a Warrant under paragraph 15 [b] may be subject to conditions Paragraph 26 [1] The enforcement agent must on request show the debtor and any person who appears to him to be in charge of the premises evidence of - a] his identity b] his authority to enter the premises In that the Court does not give them out, it can't because its not a Full Magistrates Court and that is why when you asked in Court and the Council are unable to obtain a Certified Copy of the Court Order with Seal when it’s for Council Tax.. This is their system, they elect to ignore Due Process so by applying the ''Law'' it creates legal problems that due to their wanting to ignore correct procedure they run Ito no end of Legal problems. But be resilient in that Enforcement Officers and Bailiffs will try and seize assets if they attend and no one is home, like Cars on the Driveway etc in that they do not get paid for Nothing and they will play their role in the Scam, so its’ critical to ensure that once a Liability Notice by the Council has been received , You protect yourself at all times.

Here in Devon it's done over the telephone too. I was 'invited' to a telephone hearing for council tax. Phoned the court and told they have no records for me.
There is no contract between the council and the home owner/tenant. It's fraud and illegal and no magistrate has the power to issue a liability order, they are a disgrace.
Surely this is a point within itself when it comes to renting. How many Landlords have we not only helped pay their mortgage off but we have paid this illegal tax for the rented properties they own too. The mortgage fraud is of course another case within itself but it's so easy to see how they have spun a web of lies so much so that even they don't know what is true any more. The fact that the "financial crash" happened because they were essentially betting against themselves and yet they never got jailed is preposterous. Multiply that number by the times per year that the council hire the court for the same purpose. Adds up to quite a lot who are already not paying for one reason or another.

My guess is that the reason why the council tell you to contact the claimant before attending court is because they have to hire the court building and the actors they put in there. If they cannot fool enough people into attending court, then they will not spend the money on the phoney prosecution.
I don't think attending court is compulsory. Nothing ever collapsed by someone not showing up and judgements can be made with or without your input, this would just have been a person's opportunity to put their case forward. Although in this case, quoting Vobes in a court would likely not be helpful or have any positive impact on what happens next.

This happened to my wife & I. They took us aside & offered us 'easy ways to pay' to avoid going into court that day. I said 'no' as it was complete fraud & there was no lawful obligation to pay. They couldn't get us out of the room quick enough as there might be a chance of us empowering the other folk in the room who were in the process of being talked into paying options. To be fair to the state education system of that time, I had a Civics teacher who explained everything we're discussing today..... I would like to add a little information, Around 5or more years ago up north around Middlesbrough the council where sending out council tax summonses, was using a computer Generated signature of a JP or a magistrate to hundreds if not thousands of people using this computer generated signature. However the magistrate or JP had retired 18 months earlier, and nothing happened to the local government.
I can't stand this ubiquitous corruption. The mass numbers who are knowingly corrupt is phenomenal. We have lost our spiritual base, our moral compass and integrity. This is truly a spiritual war we are in. I really do think we are now in the Kali Yuga

Great...But the average working person knows we are being ripped off in many ways but how many have the appetite and time to take on the establishment. I certainly doff my cap to this guy but dealing with court summons and councils is not something most people will look forward to.
Yes non-compliance is the way to go. Move your letterbox onto the outside of your boundary wall there is no law to say that you have to open mail that is put in there. In the bin it goes. No need to open it how much time does that take? Easy peasy. you've been indoctrinated to be afraid of their paperwork. Eventually you do become desensitised. And you start becoming happy.

I had the council attempt to charge me a “empty property tax” which was vacant for 3 years prior to myself moving in. They said I was responsible for 2x the council tax for the first year being vacant and 4x the council tax for years 2 & 3.. received a summons £4.5k, I refuse to go to court and wrote a number of complaints to the council. When I contacted the courts, they had no record of me being sent a summon. Eventually after the year and a half, Council cancelled the payment request.. absolute joke!
I can attest that Freemasons run Hampshire Police as well. I was told by Police at Hampshire. I will go further and say that all Police 'services' are companies started by Freemasons, and the government effectively outsources security to them.

I called my local sanctioned criminals demanding to know the name of the judge who heard the case. after 4 calls over two week I still got no name. I did however get the majority of my then arrears wiped without explanation a couple of weeks later.

I've just checked companies house and west lothian council where I live have one person listed as owning the company and they are a software provider called Seemis and no person has significant control. When you look at seemis they have nobody listed as a director or person with significant control other than all the other councils. It all looks very weird and would love your man to investigate this x

But if you rebut the 12 presumptions of law and reject the summons - sending it back to the council, and then turn up anway, Sui Juris, In propria persona (Special appearance) and state that you are there under duress and reject their jurisdiction..
... then you have made it very clear that they have no claim and no jurisdiction.
You then announce their 'constructive trust' as null and void, as you are the living beneficiary, announce the case dismissed, and go.
Then follow up with a letter explaining their lack of jurisdiction and their expenses fraud.

Quick estimate.. if 7000 people demanded to be dealt with as an individual and each took 40 minutes.. that would be 4666 hours translating at almost 2 1/2 YEARS!! dealing non-stop with council tax working flat out 5 days a week 9-5. TWO AND A HALF YEARS! This would bring the council tax system to its knees if people just DEMANDED to have a proper trial or at least have an opportunity to explain their individual circumstances/reasons etc..
or..renting out the court for 2 hours a day.. 10 years it would take to process these cases.

and somebody else to prepare 'Template letters' and make
this all available at a Web Site as open source material.
So here is a starter on dealing with Council Tax-
There is a process that people need to go thru but NOT turning up to
the First hearing when Summonsed by the Council and Not appearing in Front of the Bench is
the first critical Mistake.
People need to adopt a procedure similar to this format-
1/ On receiving the Summons write to the Council and ask for
the ''Contract' whereby you have consented for any disputes to be
dealt with and resolved by an ''Administrative Court''.
State further that you have no issues with a Magistrates Court but
not an Administrative Court.
2/ On attending your Hearing, state that you want to appear in front
of the Bench and do not take No for an Answer.
In most cases the First Hearing is the Hired in 'faces' and so
as they have no powers the matter will usually be adjourned.
3/For attending the second Hearing you will more than likely have received
a Letter of the Adjournment which now has a Case Number
and the new Court date and time.
4/ .When attending this Hearing it will be in a Magistrates Court with at
least a JP as Bench Chair.
5/ Make your Case, on whatever grounds you objecting and the Court
will more than likely make an Order for the Council for the Sum they have
claimed with Costs etc.
6/ Now you' MUST' ask the Court for a ''Certified Copy of the Order'' with Seal which
you will be told by the Clerk to the Court that no copies of the Order are given out
but you may write in for an Extract.
Then you state that an Extract is Not a Court Order and you require a Court Order.
You will again be told no, there is no Court Order Certified Copy available.
7/ After the hearing you then write into the Court Admin and ask for a Copy of the Court Extract
which will show that you asked for a Certified Copy of the Order and were informed that
was not possible.
If your Court Extract does not state this you MUST write to the Court and ask for a
Certified copy of the Court Order and make sure the Letter is Recorded Delivery Signed for.
8/ The Council will now send you a ''Liability Order Notice'' making out that its from
the Court.
9/ Now write to the Council and ask them for a Certified Copy of the Court Order
made on XXXX Date and further state that in accordance with the Local Council ACT
of 1888 no Council or Local Authority has the power or Authority to issue Court Orders
or produce Copies of Court Orders whatsoever.
So insist they send you a Certified Copy with Seal of the Order which of course they cannot as
they cannot issue them and the Court does not give out Certified Copies of the Order
when its for Council Tax.
10/ .Any Enforcement Officer or Bailiff must have a Certified Copy with Seal of the Court Order
from the Court to A] be on the premisses and B] to restrain or Seize assets etc.
This is Law as set down in the Tribunals, Courts and Enforcement Act 2007.
Schedule 12 which details that the enforcement officer must show their identity
and the Proof of Authority from the Court that entitles them to be on the premises.
And it further states in in the 2007 Act Schedule 12 at -
Paragraph 25- [3] The authorisation -
[a] may be by Order or in a Warrant under paragraph 15
[b] may be subject to conditions Paragraph 26 [1]
The enforcement agent must on request show the
debtor and any person who appears to him to be in charge
of the premises evidence of -
a] his identity
b] his authority to enter the premises
In that the Court does not give them out, it can't because its not a Full Magistrates Court
and that is why when you asked in Court and the Council are unable to obtain a Certified Copy of the
Court Order with Seal when it’s for Council Tax..
This is their system, they elect to ignore Due Process so by applying the
''Law'' it creates legal problems that due to their wanting to ignore
correct procedure they run Ito no end of Legal problems.
But be resilient in that Enforcement Officers and Bailiffs will try and
seize assets if they attend and no one is home, like Cars on the
Driveway etc in that they do not get paid for Nothing and they will
play their role in the Scam, so its’ critical to ensure that once a
Liability Notice by the Council has been received ,
You protect yourself at all times.
Thats just ONE HEARING IN ONE COURT!
Have you heard about the case of Leighton vs Bristow and Sutor, which has resulted in the High Court ruling that documents used by enforcement agents are unlawful, meaning they cannot enforce a council debt. Great video again, thankyou Rob for your vaulable info.

How many Landlords have we not only helped pay their mortgage off but we have paid this illegal tax for the rented properties they own too. Based on property value, the tennant does not own anything. Property tax should only apply to the owner.

My guess is that the reason why the council tell you to contact the claimant before attending court is because they have to hire the court building and the actors they put in there. If they cannot fool enough people into attending court, then they will not spend the money on the phoney prosecution.

Nothing ever collapsed by someone not showing up and judgements can be made with or without your input, this would just have been a person's opportunity to put their case forward. Although in this case, quoting Vobes in a court would likely not be helpful or have any positive impact on what happens next.

This happened to my wife & I. They took us aside & offered us 'easy ways to pay' to avoid going into court that day. I said 'no' as it was complete fraud & there was no lawful obligation to pay. They couldn't get us out of the room quick enough as there might be a chance of us empowering the other folk in the room who were in the process of being talked into paying options.

Wrong they turn you into a corperate entity by capitalising your name and putting the surname first when you apply for a drivers license or passport, a driver in Blacks law dictionary is described as a person employed in conducting a Coach, waggon, or vehicle for payment, a licence is a permit to conduct trade on the road, trader derived from the Latin tradere / traitor, ever since the end of the second world war the education system has been deliberately dumbed down, all our truly intelligent men were wiped out after two world wars, they no longer teach Latin Grammar, or cursive writing skills, all three are required to understand law as they use the dead language of Latin, it's why the court officials wear black robes . Hence the need of a special summons they're asking a living flesh and blood man to enter into the realm of the dead, why do you suppose the names on headstones are in capital letters, a headstone is your final ledger of your accounts.
Spot on the truth is the truth..they know that we the people have the power.
It requires somebody to sit down and prepare a ''To Do Menu''
and somebody else to prepare 'Template letters' and make
this all available at a Web Site as open source material.
So here is a starter on dealing with Council Tax-
There is a process that people need to go thru but NOT turning up to
the First hearing when Summonsed by the Council and Not appearing in Front of the Bench is
the first critical Mistake.
People need to adopt a procedure similar to this format-
1/ On receiving the Summons write to the Council and ask for
the ''Contract' whereby you have consented for any disputes to be
dealt with and resolved by an ''Administrative Court''.
State further that you have no issues with a Magistrates Court but
not an Administrative Court.
2/ On attending your Hearing, state that you want to appear in front
of the Bench and do not take No for an Answer.
In most cases the First Hearing is the Hired in 'faces' and so
as they have no powers the matter will usually be adjourned.
3/For attending the second Hearing you will more than likely have received
a Letter of the Adjournment which now has a Case Number
and the new Court date and time.
4/ .When attending this Hearing it will be in a Magistrates Court with at
least a JP as Bench Chair.
5/ Make your Case, on whatever grounds you objecting and the Court
will more than likely make an Order for the Council for the Sum they have
claimed with Costs etc.
6/ Now you' MUST' ask the Court for a ''Certified Copy of the Order'' with Seal which
you will be told by the Clerk to the Court that no copies of the Order are given out
but you may write in for an Extract.
Then you state that an Extract is Not a Court Order and you require a Court Order.
You will again be told no, there is no Court Order Certified Copy available.
7/ After the hearing you then write into the Court Admin and ask for a Copy of the Court Extract
which will show that you asked for a Certified Copy of the Order and were informed that
was not possible.
If your Court Extract does not state this you MUST write to the Court and ask for a
Certified copy of the Court Order and make sure the Letter is Recorded Delivery Signed for.
8/ The Council will now send you a ''Liability Order Notice'' making out that its from
the Court.
9/ Now write to the Council and ask them for a Certified Copy of the Court Order
made on XXXX Date and further state that in accordance with the Local Council ACT
of 1888 no Council or Local Authority has the power or Authority to issue Court Orders
or produce Copies of Court Orders whatsoever.
So insist they send you a Certified Copy with Seal of the Order which of course they cannot as
they cannot issue them and the Court does not give out Certified Copies of the Order
when its for Council Tax.
10/ .Any Enforcement Officer or Bailiff must have a Certified Copy with Seal of the Court Order
from the Court to A] be on the premisses and B] to restrain or Seize assets etc.
This is Law as set down in the Tribunals, Courts and Enforcement Act 2007.
Schedule 12 which details that the enforcement officer must show their identity
and the Proof of Authority from the Court that entitles them to be on the premises.
And it further states in in the 2007 Act Schedule 12 at -
Paragraph 25- [3] The authorisation -
[a] may be by Order or in a Warrant under paragraph 15
[b] may be subject to conditions Paragraph 26 [1]
The enforcement agent must on request show the
debtor and any person who appears to him to be in charge
of the premises evidence of -
a] his identity
b] his authority to enter the premises
In that the Court does not give them out, it can't because its not a Full Magistrates Court
and that is why when you asked in Court and the Council are unable to obtain a Certified Copy of the
Court Order with Seal when it’s for Council Tax..
This is their system, they elect to ignore Due Process so by applying the
''Law'' it creates legal problems that due to their wanting to ignore
correct procedure they run Ito no end of Legal problems.
But be resilient in that Enforcement Officers and Bailiffs will try and
seize assets if they attend and no one is home, like Cars on the
Driveway etc in that they do not get paid for Nothing and they will
play their role in the Scam, so its’ critical to ensure that once a
Liability Notice by the Council has been received ,
You protect yourself at all times.

Remember, there are an awful lot of people, clerks and assistants on minimum wage or close to it, as indeed are some working within the NHS doing the admin, catering, cleaning and basic health care assist roles.
Going to the council court summons means you're effectively putting on a red nose and joining in on the circus...

I would like to add a little information, Around 5or more years ago up north around Middlesbrough the council where sending out council tax summonses, was using a computer Generated signature of a JP or a magistrate to hundreds if not thousands of people using this computer generated signature. However the magistrate or JP had retired 18 months earlier, and nothing happened to the local government.
One law for them and a different one for us. Nothing changes until we change it.

Bath council can't fine you, they can only issue a PENALTY NOTICE, courts issue fines, it's a MASSIVE DIFFERENCE.

I had the council attempt to charge me a “empty property tax” which was vacant for 3 years prior to myself moving in. They said I was responsible for 2x the council tax for the first year being vacant and 4x the council tax for years 2 & 3.. received a summons £4.5k, I refuse to go to court and wrote a number of complaints to the council. When I contacted the courts, they had no record of me being sent a summon. Eventually after the year and a half, Council cancelled the payment request.. absolute joke!

I called my local sanctioned criminals demanding to know the name of the judge who heard the case. after 4 calls over two week I still got no name. I did however get the majority of my then arrears wiped without explanation a couple of weeks later.

The laws we follow are those made through the courts.
Just don't answer the door unless you are expecting a visitor who isn't a bailiff. They'll eventually go away.

I've just checked companies house and west lothian council where I live have one person listed as owning the company and they are a software provider called Seemis and no person has significant control. When you look at seemis they have nobody listed as a director or person with significant control other than all the other councils. It all looks very weird and would love your man to investigate this x

Their people listed are all the other councils in Scotland and there are 0 people with significant control......more than happy to have this explained to me as I am thick!

I worked in a computer repair shop, and one day got to repair the computer of a crown court which would not boot up..
i repaired the computer and had access to court summonses and proceeded to fill in the form with my friends names on, and distribute them at will .... i had a good laugh In the process.. obviously i told them the truth eventually..
