- The plaintiff has known the defendant for 25 years, and because the defendant works at a car dealership, she asked the defendant to help her get car insurance. She paid the defendant because he said he would help her out, but then the DMV demanded she turn in her plates for lack of insurance. She claims the defendant scammed her, so she’s suing. The defendant argues he charges a fee, but he referred her to the broker.

The Defendant kept the entire $650.00. That's why he met the "insurance broker" alone. He was telling the insurance broker one thing, and her another and he pocketed the money and blamed the broker! He's pretty low.
And we met in the parking lot of Walmart at 3 am. Frankie doesn't care he's already working on the next person he's going to "help".
This entire case makes zero sense 🤦🏼♀️ you dont need 3 other people to get insurance, you call them yourself & get insurance.

Brokers can get deals on insurance, so if you're trying to save money it's not particularly crazy to ask around "hey, do you know a broker who could help me with a discount or something"

Again, there is a legit reason for communicating this to the judge, at the get go. It means you are not a part of a 2-income house and depending on that other income to possibly be able to help out in the interim of resolving an issue. Time is of the essence in many cases involving single parents financial status. And the only reason she used "mom" is because she's female.

Because in Pennsylvania where I live , you call the insurance company And get insurance and you pay it right to the insurance company , not a Friend and not Some guy in a car you've never met ? Not to mention it's cheaper than what she had to pay doing it yourself.
I work in the auto repair industry and live in Texas. Back in the days, insurance companies used to have brokers sell the policies for them. They did this so they don't have the overhead in selling. They gave incentives to the brokers to sell their policy over others. Today, most insurance companies sell directly because it is easier and more profitable to do it themselves since technology changed that. There are still brokers (Marsh comes to mind as we use them for our fleet vehicles) that will shop policies for you. They collect data and bid them out to companies. This is usually for if toy have large amount of properties (like an apartment complex) or your business requires several different types of policies (property, Healthcare for employees, D&O, vehicles, business, workers comp, etc.). It is cheaper to pay someone to search for a better deal and manage the accounting and financial side of it for you.
I was wondering that as well. I live in upstate NY. For auto insurance, I've just gone online to the insurance companies and received a quote, selected the company, paid and your documents come in the mail or you can print them. Also, they offer housing, renting etc. you can select whichever one. I've had agents reach out to me after getting my quote while I'm shopping around but I just decline and do it myself. People also forget when you get new auto insurance you have to make sure the DMV receives the declarations page or else they have no idea. At least in NY.

In another similar case JM ruled in favor of the defendant bc he wasnt technically a broker.

Although the judge said that this is common, it sounds like the plaintiff could have been in on it. The only time that she seemed to get proactive was after the recall for her plates. The plaintiff let her first policy lapse and called her friend??? This could have been an insurance fraud scam in which she was in on until it didn't work. She then trusted him again? Nah. Something is fishy. Fortunately, the friend didn't throw her under the bus by trying to distance himself. JM would have thrown the case out if the truth was revealed. She didn't even "finish" the application. 🤨😑 fishy
Yet another racist, derogatory and unnecessary comment by Milian when she referred to this deal between litigants as a "drug deal". She continues to be exposed every time in how she is. I'm elated that I brought this to everyone's attention yrs ago and since then, everyone can see how she acts and behaves towards black litigants all by themselves.
