I’m from NY and as soon as you get arrested for a DUI they suspend your license, its insane. I’ve lived in NC for a few years now and was arrested for a DUI which was later dropped after they saw my blood test had nothing in it and they only suspend your license after being found guilty. Some states just use any opportunity to take freedoms and money away from you…
You can file a suit against anyone for any reason. Civil court is way different than criminal court. Just like how the cops can arrest you for any reason, you can sue for any reason. The hard part is finding a lawyer to see it through.
It's not the State you'd sue, but rather, the police department the officer works for. The city that police department is in would pay for the settlement if won.
as stated, you can sue for anything. in this case, it will be hard to find a lawyer to take this on a contingency fee basis, since the administrative entities - PDs, cities, counties - will defend this - with tax payer money - until doomsday, and the projected settlement amount very well might not be enough to entice a law business. Also, getting all the DUI cases certified as a class action suit is going to be a high bar to clear.

It's not just Tennessee. In Missouri, if you own multiple vehicles and get a DWI, you have to get an interlock device on all of the vehicles that have your name attached to them. In Arkansas, if you don't own a vehicle and somehow get a DWI, you are forced to either buy a vehicle to have an interlock installed, or talk someone into allowing a device to be installed on their vehicle for you. In AR, you used to be given a choice. You could either not drive for however long your license was suspended or get an interlock. Now, you have to get an interlock, regardless. Also, 9 times out of 10, the interlock systems cause electrical problems with the vehicles they're installed in.
They warn us about all these online scams....but the biggest scammers are right here in local governments....traffic court itself is a scam....unless you can PROVE the ticket you got was bogus...you are guilty. That's not how the justice system is supposed to work.... you're not guilty because the cop says so...but in traffic court....you are and YOU must prove the cop is wrong.

I can see an argument for public safety requiring this. HOWEVER, the private company should be billing the COURT, with the option for the court to add these fees to any fines imposed upon a CONVICTION. Why would anyone need to know the "particulars" of the case. These are 600+ driver's that have been wrongfully charged. 600+ driver's who've been wrongfully fined/forced to pay money as a direct result of being wrongfully charged. No reasonable person would think we're doing everything right in that instance. When the governor is asked to comment about the more than 600 innocent people that have been charged in Tennesse for DUI that were completely sober his only response is that law enforcement in Tennessee are "highly professional". Bingo. It's a proven fact that people with zero drugs or alcohol in there system have been and are being arrested and charged with dui. I was arrested for dui years ago when I wasn't even driving my car, I was drunk so had my friend drive use home and got into an accident. Cops show up at the hospital and accuse me of driving and arrested me. I won in court but still went thru the entire ordeal.
"just don't break the law" has never been the answer, the cops literally get paid if they can get you on the hook, and if they weren't then they still need to arrest someone to look good for career advancement, and God forbid you tell one to their face, then they're planting evidence on you for a year long trial. EVEN IF you're find innocent, a year long trial isn't exactly effort free, "the process was the punishment".

And no one can convince me the testing lab for TN couldn't find results within a week or two if they wanted to scale it up. If the state had to reimburse costs at higher levels plus a penalty for how long it took to get passing tests the state would fix it so fast.

All they need to do is to fix the blood tests. Guess what, it takes a few hours at most to do it in Europe. The rest of the problems of the whole process would simply go away if it was done in timely manner. Not to say it would save the court time tremendously as it would save minimum of one time of meeting a Judge for everyone, as bloodwork results would be ready before you see a judge for the first time.

When the governor is asked to comment about the more than 600 innocent people that have been charged in Tennesse for DUI that were completely sober his only response is that law enforcement in Tennessee are "highly professional". I doubt if a family member of his was arrested and jailed for DUI and were later found to be completely sober he would refer to the arresting officers as highly professional. What would be even more infuriating if any of those arrests that came back with a blood reading of 0.00 had an officer initially claiming, "I can smell the odor of alcohol coming from your breath".

I agree with DUI penalties, but not the laws about roadside tests, and breathalyzers. We should be able to legally drink and drive. It's the property damage, and bodily injury that warrants punishment. If you wreck, and it's found that you were intoxicated add years just for the intoxication alone. No more of this up front bullshit. Much like red flag laws, DUI laws do an end run around due process. It ruins more lives than it saves. In this case, it gives the police the power to fuck anyone on a whim, and this report makes it clear that this is their practice, innocent or not.

Bingo. It's a proven fact that people with zero drugs or alcohol in there system have been and are being arrested and charged with dui. I was arrested for dui years ago when I wasn't even driving my car, I was drunk so had my friend drive use home and got into an accident. Cops show up at the hospital and accuse me of driving and arrested me. I won in court but still went thru the entire ordeal.
I know people who wasn't drinking and had to use it because their medication was in their system.
"just don't break the law" has never been the answer, the cops literally get paid if they can get you on the hook, and if they weren't then they still need to arrest someone to look good for career advancement, and God forbid you tell one to their face, then they're planting evidence on you for a year long trial. EVEN IF you're find innocent, a year long trial isn't exactly effort free, "the process was the punishment".

Unfortunately they get away with it bc you report then let it go. We need real journalists again. Passionate ones. That being said it needs to be looked at why there is so little access to legal help when you are falsely arrested or accused. I had several instances where i needed help bc i was wronged legally and there just is no help out there unless you have thousands of dollars up front

This is all about collecting as much money as possible for as long as possible. If the state had to reimburse costs at higher levels plus a penalty for how long it took to get passing tests the state would fix it so fast.
