As someone who lives in Europe and has never had contact with an attorney and knows exactly 0 persons that have been sued, I don't know what to do in this situation.
If for nothing else, there appears to be facts presented that raise questions under MRPC Rules 1.1-1.3
This is one of the craziest cases I have ever heard of! Even as a Prose litigator I know better than to file a frivolous lawsuit such as this! The Michigan bar association needs to review the "credentials" of this lawyer who took this case and at minimum sanction the attorney or suspend their license for a period of time.
I wonder if the "Lawyer" is someone who just completed law school and this is their first and only case. She could also be a "friend", relative, or ???? to the client. Regardless, I agree she needs to be evaluated as to the state of her credentials and ethics.

“Lucre” It’s a word every Michigan attorney snickered at when being sworn in because the arcane sounding word isn’t really common in common parlance. It’s better that way because it has a mythical character now that better defines what it is.

When your lawyer sends your response, tell the plaintiff’s lawyer that after you get the suit dismissed, you’re then gonna go after her law license for filling a frivolous suit.
Perhaps you could have a really goofy tailor make you a frivolous suit to wear in court!

Either he won't, which makes it an empty threat, or he will, in which case the threat didn't do anything useful. It's unlikely that it would have the effect of "Yes, you are right, I'll withdraw the case, apologize, and reimburse you for your time".
One things for sure, naming deputies in a frivolous lawsuit and calling the department thieves is a great way to get that business and lawyer some very special attention from the whole department

I learn more listening to Steve then I ever thought possible and it’s because he is real and easy to listen to
I had a similar situation where an individual that I believe is suffering from narcissistic personality disorder, hired a lawyer to rubber stamp his own written communications dealing with an inheritance issue. Three lawyers later, the day he was required to state his case to a judge, he caved in... $30k in lawyer fees and 6 years of bullying. So it appears that when someone is living in an alternative reality, they will go for it with blinders on.
Mr. Letto, I was once taken court for failure to pay a car loan that I never took out, on a car I never had, with a SSN that was not mine. Signed with My full legal name but my signature. Went to court, showed the Judge my D.L. & SS card. Judge threw out the case and Reprimanded the Loan company Manager and the company Lawyer for a waste time.😂😂
Turns out that there 3 people with same name as mine, myself, & a Sr. and Jr. Jr. Took the loan, Sr. CO- SIGNED on a '96 Mustang Convertible. Stopped making payments and Sr. didn't want Jr. have it in the 1st place
Then sue them on behalf of the trees that were slaughtered to produce the complaints! Tree lives matter !!! 😂😉

The first rule in dealing with a lawsuit brought by someone against you is always respond to the lawsuit in a proper manner as if the lawsuit were a valid one no matter how crazy the lawsuit may be. Judges don't like people ignoring lawsuits and they may rule in favor of the plaintiff if you don't respond.

I had made an earlier response stating that to be the case but that response was deleted unjustifiably by UA-cam. If I had intended to give advice to Steve Lehto, I would have begun my post with @steve Lehto.

The funniest bit about the service is not how close to your office the other attorney's office is. It's that the plaintiff obviously had your address before they started.
Hey, friend Richter, knowing where and how to serve the defendant[s'] copy of the complaint is a necessary step in exercising your First Amendment right to petition for redress of grievances. I learned that back in the previous century in a "Law for the Layman" night course. I had that lesson reinforced a couple of years ago in a "Protest of Election" action against the official in the city where I live who arranged for the Mayor to be re-"elected" via a process where the outcome was certain victory even before the ballots were printed. Judge P. dismissed the case "with prejudice." And he did so not only because I should not be expressing opinions on matters of Law without being a member of the Shysters' Union but because I had only "informally" served the City Clerk's copy of the complaint. Betch'a cant guess why going to the City Clerk's office in person and putting it in their hand was not good enough 😂 !
Frivolous lawsuits like this clog our court system and drive up legal fees.
This is why we need to have laws that lock down torts and why we need a complete revision of our laws away from a system based on the nonsensical English System of law. This is a reason our young people want to vote in a socialist system and away from a money driven capitalist society based on torts and other legal nonsense. We need to reform the entire legal system.

Sounds like a 56 page runaround that would basically result in double jeopardy. It took 9 months for them to get around to even bothering to serve process, so clearly she just pocketed his money

I was in business and got into a jam with a rotten customer who said he was going to sue me. OK --- he then sent a letter of intention to sue, but he never finished his threat.
I waited 10 months and sued him for breach of promise --- the promise? He failed to sue me.
The judgement went my way and the judge was laughing all the time and I got cost of court, cost of MY attorney and I had a great time!

the fact a attorney refuses to represent himself says a lot opposed to someone who knows nothing about law willing to defend themselves which is basically putting yourself at the mercy of dumb luck, I would have counter sued for legal exspenses and loss of time/earning potential

Case was files 9 months ago, THEN somebody else was sleeping on the serving switch. The file got stuck in somebody's procrastinating cogs, probably for a purpose but most probably out of sheer neglect.

I personally don't believe the judge will be laughing as they tend to take a somewhat more aggressive action to someone wasting the court's time. I believe the technical term is "pissed".

You have no choice but to get the plaintiff's attorney disbarred.
In fact, Steve is probably obligated to report her to the state board if he has knowledge of another attorneys that broke regulations. That’s possibly one of the regulations. It would not be retribution, it would be an obligation, LOL!
(I’m a licensed surveyor and that’s the way it works for us. No idea how it works for attorneys in Michigan.)
On the other hand, the bar regs may require him to send the lawyer a thank you note. I'd suggest he include " .... and thanks for gifting me with the rich video content!"

Especially if she took money from that guy to file this load of BS. In fact she may even face jail time for going so far off the rails.
The only way she can mount an adequate defense of herself is perhaps if she came from another state where these claims would be valid. But they should have to make sure those claims are valid in that state before deciding. Because the seems like the statute of limitations would be over in any state. Also fire that damn process server, I found Steve's address just by Googling his name.

This happened to me in my child custody case. My child’s mother had a lawyer put a lawsuit against me and the lawyer didn’t read the past court case. Then when the 5th lawyer realized that she had no case against me, the lawyer laid down her case...Some lawyers will push these BS lawsuits in court.
I’m a retired Palm Beach County Prosecutor and Judge and it seems that the best bet would be to file answer, a motion to dismiss, and a motion for summary judgement. I would grant those motions in two minutes, sanction the plaintiff’s attorney, grant attorney fees and refer the plaintiff’s attorney to the bar for sanction.

zipping to the end... if you win and get a judgment against them for attorney's fees, etc. , will you have to get the sheriff to confiscate and auction more of his stuff? this might get funny...

but another confiscation and auction will only result in another lawsuit 2025-2026 depending on how long it takes the lawyer to find him it will be a unending cycle till the end of time :P

Unfortunately there’s all sorts of exemptions so you end up getting nothing.
I won 12 1/2 law-suits out of 13.
I got nothing and I had to pay on the last one even though I was a third-party defendant.....Young girl turned left in front of me (failure to yield to oncoming traffic) I ended up T boning her patents van Which ended up turning over on its side and sliding into a car in the opposing intersection. That car sued me instead of the lady who caused the accident....I was found to be partially at fault which to this day I just can’t believe happened.
I had the right of way I was going on my merry way and the young 18-year-old girl in her parents van failed to yield to my right of way thus causing the accident and any results of that accident should have been only ascribed to her....

he cannot have the second bite of the cherry. If he lost the first action and suffered consequences, he cannot overturn the court orders which is what he is doing. As you say he had the right to appeal and failed.

The problem is that a lawyer who thinks this case is worth taking to court doesn't deserve to be paid. Probably doesn't deserve to be a lawyer either, at least not when it comes to legal issues on that subject.
How much chance the suing lawyer is an alumni of the Gray-Bar Law School?
From what I understand, at the end of a civil case, the prevailing party can request that the losing party pay all attorneys fees. But it's up to the judge to grant the request based on various factors in each specific case.

@@cleetose I am from Canada not the US but this is what I have heard of US law from watching various UA-camrs like Steve.
If you are sued in a civil matter and you win you are not awarded court costs, however this was in a video I heard about HOAs. You can only get court cost covered if you counter Sue as far as I'm aware.
But if this case is that egregious that like 75% or more of those claims are invalid then you really have to wonder how the lawyer can keep her license. Especially if she's not working on contingency, meaning if she took money from them to file this load of BS she needs to lose her job and repay that money.
The attorneys lost the arguments, but they still got the fees! One has to wonder if the attorneys in question are "ethically challenged", like "I can get a few hundred if I tell him he's full of shit, but if I file this case it's THOUSANDS!"

This is why if you are a business owner, it is imperative that you have a business insurance policy that covers property damage liability, but judging from the guy's choice in lawyer, I can't imagine he has a very good insurance agent.

Don't forget "chicanery".
He searched for 6 years before he found an attorney foolish enough to pursue his frivolous lawsuit. You can tell by the wording an inexperienced person wrote up the complaint.
This stuff is better than cable TV. I'm hooked.
My guess is that the "attorney" is a relative that just graduated from law school.
Or the staff (assistant attorney) drafted it and she signed it off without reading it first.

@@gavincrouch that's what I am wondering too. Marv may have a paralegal friend or family member who misrepresented his case to the attorney and drafted the complaint BUT it is still 100% on the attorney to double check the complaint before signing it so she's still a horrible attorney either way.
@@refinnej5302 The fact that it's not double printed and the word "bamboozled" is used, almost has me certain a practicing attorney (unless she is young - in her 20's [they use some colorful language]), would not have typed that out (in most cases administrative staff do that anyway). Well, she will get a surprise when she appears before the judge if she proceeds, unless there is more than meets the eye, we have not seen / heard what the sheriff was allowed to seize, I would like to hear the execution order stipulations (if the order states property of the LLC only and property of the owner and/or his wife was seized, that might be the issue).
Sounds like an attorney that needs money and is willing to milk a client to get it.

Yesssss, that's exactly what I said. The attorney knew it would get dismissed/lose. The attorney submitted the complaint/lawsuit anyway so that they could at least collect the money for their services. Sounds like the unethical attorney should get a few bar complaints, and Marv the crook should sue his new attorney for scamming him.

The plaintiff's attorney needs a review by the State of Michigan's Bar Association. At the minimum, she has earned a public reprimand.
This sounds like a lawyer just taking someones money, filing a frivolous lawsuit knowing it will be tossed out, and telling the person what they want to hear along the way. Its common with low cost lawyers.
I bet the plaintiff's attorney is not on a contingency fee.

Long ago, my father, who was a self employed painter and decorator, did some work for a lawyer. However, during the work, the lawyer kept on trying to expand the job yet stick to the cash value determined by the original contract that was already determined. He completed the original job contract, but the lawyer never paid him. So my father kept an eye on the lawyers house and one day noticed that it was up for sale. Bingo...now the lawyer had no excuses as to not paying. So my father took it to court. He represented himself, and the lawyer represented himself as well. Now many times my father did call the lawyer before hand, but the lawyer simply did not pick up the phone due to recognizing my fathers phone number, except for once. Everyone in the courtroom broke up laughing. My father won the case. The lawyer surprisingly congratulated my father for a job well done.
It's not likely that the complainant waited 6 years to file the case but rather it's taken 6 years for him to find an attorney dumb enough to take the job.

Been there and was assigned a public defense atty who just said to plead guilty! I wasn't, he was! I thought i would have a heart attack! I asked for a new atty. A court commissioner was assigned, not the usual judge . She was so rude, i was just stunned. So, when we were in the hall, i spoke to his atty with mine right there. I told him that since i had no representation i would have to defend myself. I asked him if he was aware that his client was guilty of...i named several things, and the last was that he actually broke into my home and left the summons on my table. His attorney asked if it was all true and he stammered and made excuses. His attorney quit on the spot saying he did not represent people who committed such offenses. That was that. But my nerves were never quite the same. I was going to throw the papers out and a friend said not to, he was asking for jail time! I care for my disabled son 24/7. It was all a vindictive thing. It took me 10 years to finally get child support ordered. He had lots of money and a great atty. I had nothing. At least i have my soul and that is forever. He has nothing good never. I am sad for him, but he had a choice.

Once went to Mazda Dealership for a simple rotation and balance. I picked the truck up and after about 3 minutes of driving I had to pull into a parking lot due to the shake. They had left ALL of the lugnuts lose. I was angry i started to tighten them myself , but i decided to call them and make them send someone out to tighten them. It took them an hour to make a three minute drive. A young man arrived and tightened the lug nuts and apologized a lot and wondered why didn't just tighten them. I told him i would have if it were not for the fact that i had already paid his company do it!
As a retired Deputy Sheriff I served thousands of Civil “Papers” I was named in a one Million Lawsuit in 1999 because we would set up on a main road that went to a Yearly HEMP FEST. It was “Misfiled” and was thrown Out. Not Fun..
This explains exactly how those wheels where not installed properly. They're people are living in an alternate universe.

got a couple miles down the road and the front passenger side popped right off. Good thing he was slowing to a stop at the time.
But it still caused real damage to the car. At least the shop did the right thing and repaired everything without question.
I think they were embarrassed by the whole thing.

I don't do all my car repairs. Checking the lug nuts ASAP afterwards is something that I always do.
@@missingremote4388 When a person brings his/her car to be serviced at a repair shop, it is expected that the shop is competent and will perform the work according to factory specifications. It is not the customer's responsibility to have expert knowledge in auto repair.
For example, when a customer brings his car in for an oil change, the customer can expect the shop to replace the oil filter with the correct model, add the appropriate amount of oil to the crankcase, use the appropriate oil for that particular make and model of car, and tighten the oil plug properly.
I would surmise that most Americans have not taken auto shop while in high school. There are some high schools that do not even offer this class.
This is a sure-fire example of a lawyer that has absolutely no clients, so she jumped on the first paycheck she's seen in months. She's most likely either brand new or trying to work from home and decided she needed the money more than her pride as a lawyer.

I have PTSD with lawyers because after going through a lot of lawyers during a divorce, my lawyer didn’t show up on a final hearing, had a stand in to listen to the opposing team complete with supposedly expert attorney etc, we couldn’t listen to the deliberations because the stand in lawyer left and I had no one beside me, my heart hurt so much, I was crying inside and God knows how much hate I feel for people taking advantage of me…I just want to go to hell and come back with a vengeance, that’s how painful it was…and yes my ex is a physician and had the money…
So basically, "I lost in court. I'm going to sue for damages from losing." Seriously... wtf?!
