My father died five years ago, and they have a revocable trust. It’s only then that I realized their estate really isn’t protected. And I ask this because only recently I discovered that the five-year look back is prorated 20% per year. So if I could set up an irrevocable trust and even if my mother makes it to 97 before entering a nursing home, doesn’t this, save me 1/5 of the value of her house? if my mother should go into a nursing home, she may or may not have enough money to pay for the care before having to sell the house. I assume if she only lives to 99 she might have enough money before selling the house. Additionally, I am wondering what the law is in New York regarding a care giving adult child living in the house for the last five years and asking them to leave the house if our mother ends up in a nursing home. 33:55

So I guess a Will. - I hope that people that I know at the town office will help with this. Then set up the MOST SIMPLE RLT that I can. Just deed the house over to the new RLT, name my son as Successor Trustee. name my son as Beneficiary, etc. So skip the POA stuff. No probate. I have a heart condition. So I expect to just have the lights out event. You know, just a quick event. Absolutely no one else really matters. Maybe one of those letters for my son to open with "suggestions."
