- The U.S. Supreme Court has overturned a 40-year-old case that allowed federal regulators to enforce their interpretation of ambiguous laws.
Without the so-called Chevron doctrine, the SEC could have a harder time pursuing an enforcement agenda in the near-vacuum of legal and regulatory clarity for the crypto industry. Meanwhile, the SEC has declared war on ETH staking, filing suit against Consensys, alleging that its MetaMask swaps and staking services violated U.S. securities laws.

The Supreme Courts ruling on the Chevron doctrine could completely nullify all of the SECs prior Crypto cases. Being that there are no applicable existing laws and regulations that apply to digital assets without the SECs ability to interpret and twist the laws. And the CFTC will have total and complete reign over crypto as a commodity. So Judge Torres very well would have complete justification to reverse the XRP ruling that it's institutional sales where Securities.

This Chevron deference being overturned seems like a good thing that should've been done long ago. Why should unelected members of an agency be the ones interpreting ambiguous laws? If it's too ambiguous, congress needs to fix it. Otherwise, it should be the actual members of the justice system, the judges, interpreting the law to the best of their ability and building up precedents, all the way up to the Supreme court, if necessary.
This might not be a good thing tbh. This deference relied on experts in each federal agency to interpret ambiguous laws. Experts in each field. Congressmen are NOT scientists, they are NOT doctors, they are NOT teachers, etc.
This deference actually gave power to the people (even if they work for federal agencies) and too much power to the Supreme Court and congress.
I fear this brings us one step closer to an authoritarian state.

They are trying to reduce government power over currency. It is the basis for creating a parallel digital currency system. The arguement will mean that other curencies should be allowed if it functions and that is the area of the olde fiat banks as the new digital currency is owned by the government.

I think now Gensler has been sufficiently neutered. As such a weakened castrated Gensler may well be better kept in his chair than replacing him with someone new and strong. Unless of course we can be 100% assured that the replacement is genuinely pro markets/pro crypto.
In mind that his job was to sufficiently stifle crypto markets until BRock etc were actually ready. So from that persepctive he has been somewhat succesful. Without doubt he also tires of his position and looks for an opportunity to jump ship while trying to maintain some dignity (a challenging task).
