      @Dougal Douglas its wrongful arrest, unlawful/false imprisonment, assault by an officer, malicious prosecution as the officer was there waiting for the man WITHOUT a warrant for arrest, and even human rights breaches.
      I hope they both sue this force and officer, as this will be a 6-7 figure payout, because of an officers ego.

      The tax payers end up paying. The pigs in question will continue to draw their salary unaffected.
      This is why cops need to be personally accountable for their actions and personally responsible for compensation payouts and costs from their own salary, savings, assets or pension fund.
      Things will only change when a few cops have lost their homes and pensions because they had to pay for their actions and not the tax payer.
      I hope to see that day.

      It's not a complaint, it's a crime report. DO NOT make a complaint like you slipped on their driveway, these things need to be prosecuted as criminal matters when police operate outside their authority. Just the _threat_ of arrest here is a s26 offence in it's own right, police officers know about Harvey v DPP because their own union was bitching and moaning about it.

What's most scary about this is that prior to mobile phones being so commonplace I bet this sort of incident happened all the time and went unchecked.       @Dougal Douglas That is the caliber of officer today. They won't treat a gang of yobs the same way they treat members of the public. If a group of youths swear at them they likely won't even mention it, let alone call up SEVEN cars to arrest someone who says 'dickhead' . As for ethnics/trans/gays or other 'odd bods' they would just laugh in unison in case they take offence and report them for racism or saying hurty words .
      You'd think this man was a wanted violent thug with a switch blade pulled .
      We the public are asking for tough action against such thugs but NOT against members of the public who have committed no offence or crime. They are only interested in soft targets like someone on their' tippy tappy 'saying rude things about our establishment, or a business man doing 100mph on the M1 or something that keeps them in the station like monitoring more Facebook /Twitter and targeting future targets as well as employing selective racism and sexism consequently employing third rate officers who are as suitable for the role as Rambo would be a ballet dancer!
      The entire force needs to be disbanded and rehired this time with traditional officers with genuine integrity and suitability . Probably asking too much now, through!
      You won't see them because they are probably too frightened to go out and face real criminals in case they get hurt or some nasty yob uses hurty words. So they decide to leave things like burglary and go for the easy crimes involving the normally law abiding.
      Such officers are a huge liability!!!

      @@jl-xs6ud Plus if you fail to make an arrest, it's recorded as an unsuccessful investigation. That's why you never see burglaries being investigated anymore.
      Or assault. Or anything else unless it happened in front of a million cameras and witnesses. And if they did investigate, the court proceedings would cost tens of thousands, and all that would happen is that a lawyer would spend an hour talking about how the guy who did it has "mental health problems", so they'd have a 2 week holiday in jail, then be back on the streets, bragging about their time inside, acting like even bigger dicks.

      Yes, situations like this are happening all over the country all the time. I've been assaulted numerous times by the police, including sexual assault, taser and PAVA for no reason whatsoever. People that have never experienced this sort of thing tend to think it doesn't really happen or that the innocent member of the public must have done something to deserve it.

      @@lesjones471 I agree but I was assaulted by the police in my own home. Asked for the footage from the 4 officers all of which had body cams that were recording. I was refused the footage as they said it might affect an ongoing investigation and may prejudice a prosecution. I'm sure it bloody would! They forced entry under false pretences and broke every part of CASE. Only to be later told no further action, but guess what the footage was already deleted.
      I'm glad the wife recorded it as I'm sure they won't provide the bodycam footage.

      Denzel Harvey is the case you want. Basically the police have to reasonably believe that a specific individual felt alarmed or distressed by the swearing and the prosecution must prove it in court.

    I had the cops in my house 2 weeks ago. I did the unthinkable thing of actually calling them to make a complaint about off road vehicles being driven on the road and paths. This is not the first time I have had do this and I am not the only one. Anyway cops come in I have video footage and 4 independent witness'es. But the cops want to pick apart my evidence. So I told them to forget it and to leave. they both look at me like I am speaking an Alien language. My wife then tells them to leave and again we are still meet with blank expressions. I than give up the nice please leave to a more direct approach. "What are you two waiting for Get the fuck out my house". Well they got butt hurt at that point and tried to arrest me for section 5 public order, I asked who was the victim? The male officer said he was. I did try and explain to them that they could not be victims of sec 5 and they were now trespassing and then I was promptly told there are no trespassing. Yeah you guessed it they know best. If he had said section 38 then that would have been different. Things went down hill from there. They shit their pants pressed the panic button and before you know it there were 6 cops in my kitchen. The other cops stood and did nothing once hearing from the female cop that first came that they were asked to leave politely and did not leave. I was then uncuffed and they all went away. Tossers

      Mistake to let them in your house. They (2) turned up at mine in support of BRITISH GAS just to remove the meter. Didnt go out but had it all recorded on camera.
      Authorities want to use my land to build 40 houses. Guess who won't be allowed to run their gas supply to those units.

    I always thought a member of the public HAD TO COMPLAIN, BEFORE an officer could arrest you for a public order offence, like swearing in public.
    That's what I was told by my solicitor, and what he said in court, and got my charges dropped.

    The officer needs a complaint from a member of the public in order to threaten arrest for a public order offence. If there is no complaint he is not granted powers of arrest.

      Plus, as far as I know, the actual phrase is 'Serious alarm and distress'. It has to be something other than day-to-day behaviour and language, but this ridiculous catch-all phrase is being mightily abused so it's any old 'alarm and distress.' Garbage nonsense.

    For there to be a public disorder, a member of the public must report one as such and the plod should have a crime reference number. The fact that this plod made it up on the spot tells you everything, I wonder how many others he just randomly tries it on with. PS the fitness standards have certainly been adjusted downwards.

    Come back bro.. you was the original Police corruption channel in the uk before all these so called auditors, you actually had a cause and it wasn't fame or clout you was actually raising awareness and helping to change things for the better for the 'little people' (myself included) who don't have a voice and get there rights abused daily. Believe it or not your service is needed now more than ever before.. unfortunately in my opinion nobody has been able to fill the gap you left when you stopped uploading, in fact they have probably made things worse in terms of how the general public view police critic's.
