Just like in the US, Elon Musk has been trying to meddle in Brazilian elections for quite some time, even going as far as paying the fees for the defense of candidates who had been convicted by the electoral justice. X also closed its office in Brazil last week, so that they could operate in a way to escape Brazilian laws.
Our Supreme Court gave them 24 hours to appoint a legal representative in the country, which they refused to do, and that is how X was blocked in the country. ALSO, in order to ensure the payment of innumerous fines applied to X since the beginning of this year, Starlink also had its accounts blocked.

I am Brazilian and I support the measures against platform X. I affirm that there is a misunderstanding about what the right to freedom of speech means. *"Freedom of expression" is not the same as "freedom from aggression".*
In fact, there has been a political and ideological group attacking Brazilian democracy for some time. We have seen here, death threats against authorities, mobilization for attacks on our institutions, hate speech using platforms like criminal articulations. The whole world witnessed the attempted coup d'état that took place on January 8th against our institutions. The articulations for these acts took place using digital platforms.
It is necessary to understand that freedom of expression is not the same as absolute freedom or to do anything. Guys, it was not a ban, it was just a temporary suspension. As soon as he comply with the judiciary given order the access will be restored. Its not possible to permanently ban the service without changing the constitution, which guarantees the free exploration of any legal comercial activity.
BlueSky does not need a representative in Brazil because the network has not reached 10 million users (Brazilian users) yet.

The international media fails to understand (or ignoring) the root causes and political realities in Brazil. Beautiful country and easy going people with highly corrupt polititian and governments institutions. The Brazilian law nº 12.965 de 23 de Abril de 2014, in its Article 19 talk about freedom of speech and it is very specific at § 1º The court order referred to in the caput must contain, under penalty of nullity, clear and specific identification of the content identified as infringing, which allows the unequivocal location of the material. Moraes was asking to ban an account not the specific post, therefore the magistrate did not followed the law. It called “prior censorship”.

The reasons behind the Constitutional Court are the fact that Twitter did not comply with court orders. However, there is a huge criticism abound Minister (justice) Moraes actions. Also, it's important to note that it wasn't a decision by the court but a monocratic decision by Minister Moraes. These monocratic decisions are among the most criticized by Law Scholars - and the criticism come from some of the most respected Law Scholars in Brazil like Walter Maierovitch and Joaquim Falcão.
You should have brought some of those Law Scholars to the discussion because since it was a decision by the Constitutional Court the legal aspects should be at the center. Brazil appoints Ministers to the Constitutional Court is a copy of the US system for appoint Justices to the Supreme Court: the President appoints and the Senate confirms. Alexandre de Moraes was appointed by Dilma Rousseff's vice president after she was impeached - Michel Temer. At the time Moraes did something no one had ever done before: he lobbied Senators - with closed door meetings - for his confirmation. That is not illegal but, imho, it should be.
It's decided by just one judge, because that's the judge responsible for the case. That's just how it works. Elon is invited by the same judge to have a lawyer to represent Twitter and it will come back online as soon as Elon wants to play by the rules. Because the case can't go on without a a lawyer to defend him.

Did anyone notice that the judge's rule was illegal? That it required X to block speech from a senator, which has such speech explicitly guaranteed in Brazilian construction?
