कोई व्यक्ति जो दारू पीता है लेकिन उतना ही की वह उसके द्वारा किए जाने वाले कार्य की प्रकृति को समझने में समर्थ हो लेकिन उसके बाद उसे उसके दोस्तों द्वारा जबरदस्ती दारू पिलाई जाती है और अब वह इस हालत में हो जाता है की वह कार्य की प्रकृति समझने में असमर्थ हो तो क्या से धारा 85 या 86 का लाभ मिलेगा?
