      Judge sustained it bec he agreed w/the defense attorney that the witness statements were improper. He cited case law and gave parameters at the outset that the prosecutor chose to not enforce bec she disagreed. Lots of uninformed opinions here abt defense attorneys.
      The jury agreed she didn’t have to shoot Doug, but it’s amazing how y’all are willing to fawn over him as if there weren’t writings from his late wife about his violence, him firing a gun into the ceiling, his own disturbing words in texts, etc.

      @@koertrprtrgirlg9109 l also believe it is improper to judge the victim when he isn't the one on trial. I have never seen a defence lawyer interrupt a victim statement. Apart from anything else it is pointless and plain disrespectful when the individual has already been sentenced. That said among unscrupulous defence lawyers this one was particularly unpleasant.

      @@bronte333 I mean no offense, but I say uninformed bec that was the job of the prosecutor to review their impact statements so the defense didn’t have to object, but she decided she didn’t like the rules. Not sure how you get to blaming the defense for doing their job. You see this case differently than I do, and that’s okay. I see Doug as a violent man, whether she was justified in shooting him or not. There was ample evidence that established that. Stating the truth of who the victim was is not judging. Truth is all that matters when deciding the fate of the convicted.

      I don't understand the objections to the victim statements. No one said anything threatening or damaging. They spoke the truth. She's already convicted as a murderer. I call bs!!

      @@Aussietari what’s disgusting is the disregard by the prosecutor for the parameters set for impact statements in this type of conviction. She reviewed their statements, and decided she disagreed with the case law set by those before her, forcing the defense to object (which I assure you no defense attorney wants to do in that situation). These are actual court cases in a real court of law, not just entertainment that the viewer gets to decide what they want to see. But at least you’ve got the popular opinion on this channel.

      Because she has already been found guilty and they don't need to relitigate the case. This is supposed to be the impact, as the victims, that the crime has had on you personally. Unfortunately, there are procedures that have to be followed in a court of law, and victims don't have carte blanche to say whatever they want.

    I was disturbed each time the defense lawyer objected to victim impact statements, and and the judge sustained and reprimanded the state and victim family members. The defendant was allowed to put her twisted version forward during the trial.. Seemed unfair

    No they didn't rip into her, they got shut down at every turn by the defence with the help of the court. It was absolutely disgusting watching this hearing. They ripped Douglas Benefield's reputation apart but his family could not say one bad thing about the woman CONVICTED of killing him, there's something mighty wrong with this one. Some courts in the US really need to sort out their priorities. I'm watching from the UK, we have these problems too.

She made countless claims that both CPS and LE determined were unfounded, she used the legal system until that no longer worked and then killed him since the courts found no evidence to keep him from having joint custody.

    The biggest injustice here is that the victims were hindered from speaking the true impact the loss of their loved one had on them, to spare the feelings of a convicted murderer. Why? She maligned him throughout the trial, and nobody told her not to attack the victims character. This was the first time ever that an objection such as this was sllowed during victim impact statements. Shame on the judge and the defense for not allowing these victims to speak their hurt and thoughts. I expected better from the Florida justice system. 😡. My deepest condolences to Eva, and Doug's brothers. May you find peace and healing in the arms of Yeshua. ❤

    The victims should be heard. She got to tell her story through the trial. She has been convicted of manslaughter. In my opinion she had it planned. Why was the gun so accessible. I think about a small child being there and you would think she would want to keep the gun secure. It just does not make sense.

    It’s not enough the pain and sadness Doug’s family will always have to endure because Ashley murdered him, but the judge humiliates them? It was OK for the defense to try to destroy Doug’s reputation, but let’s be nice to a convicted murderer, even whipping out a statute that is not relevant to this case. Who’s the victim here?     The fact that she was still, even after being convicted of Doug Benefields murder, was still able to control his daughter in his daughters VICTIM IMPACT STATEMENT IS WILD! The judge was absolutely WRONG for that and so was her POS lawyer, but the judge actually surprised me with his rulings on those tactless objections! Wow!
    Poor Eva! Got victimized again today because of this monster!

      The optics were bad. It came across as the judge was admonishing the victims. This was their opportunity to have their voice heard. Even the prosecutor questioned the judge.

    I guess the concern here is that the MURDERER isn't insulted with WORDS??? WTF is this? The victim's family should be able to FREELY speak how ever they choose. I think somewhere in our Constitution we have something called the FIRST AMENDMENT...but apparently that doesn't apply to a murder trial. Totally disgusting and unbelievable.

    This murderer is a VERY MENTALLY DISTURBED person. She is a liar and very dishonest. I feel sorry for Eva, Doug's adult daughter most of all. I hope she is close to her father's family and her mom's too. Ashley is a terrible actress, it was so easy to see thru her act. What a piece of work she is. Enjoy every minute of your prison term you deserve every second. Shame on you! 👏🧟

    Shame on the system for not allowing the victims to express their pain, sorrow & opinions. By doing such a thing is to impact on their healing process & show the violent murderous criminal more respect than the victims. If the killler was a male would he have been shown the same from the court?

    I’m sure her mother is getting Doug’s ssi ! That’s probably why she wants Emerson. It seems her mother is poor. Sad the baby’s money will go to putting money on her mom’s kiosk and attorney! She shouldn’t have been able to collect that money but pretty sure she did. Hence her being able to stay home w her waiting for trial. Ugh 😢
