@@PeterLumain which case he would lose. “I tried to steal his property, and he caught and attacked me for it, Here look I have it all on camera”. Kids these days are too stupid. They’re literally filming themselves committing crimes and expecting to get away Scott free. The slap was well deserved. Most other people in a gym setting would have the kid on the ground literally begging for help. You don’t mess with other peoples stuff. Especially more so when it’s someone who can and will catch you.

I am a retired law enforcement officer, I would not arrest the man for re-claiming what belongs to him or the slap he used to get his message across. Had he punched the kid he would be going to jail!! I would be having a chat with the kid and explain how things really are!!! Then call his parents and have chat with them about their son!!!

It's not assault. The man has a right to do what's necessary to get his property back. He asked politely first, then used the minimum force to secure it's return.

It passes muster as battery. It fulfills all the requirements. This doesn't mean he'd be convicted of this. Juries understand that sometimes some actions are required and the minimum force used by the bigger guy would justify this to most juries.
It is WHY we have jury trials. Sometimes laws need to be ignored because of the bigger picture.

@@rbarnes4076 Or laws need to be updated since they were written by people who don't know the real world. Lets be honest most politicians and legal experts didn't grow up on the street. So the laws they write are written with little if any input from the people from below. They're written from the pov of a person who never lifted anything heavier than a pencil. They also rarely consider the different scenarios that many of these laws might end up covering. Most laws are written with only one scenario in mind. Which happens to be rare in the real world.

@@florinivan6907 It is simply impossible to construct a set of laws that cover every possible scenario and extenuating circumstance. This indeed is why we have a jury of our peers to pass verdict. There is even something called jury nullification. It allows a jury to return a not guilty verdict even in the case where they are convinced the defendant is for sure guilty, but the circumstances do not warrant punishment for the crime. It is 100% legal.
