It was beyond criminal. What they did to her it was inhumane what they did to take advantage of a young girl in that way is absolutely positively disgusting. However, the one mistake that she did make was that she should’ve had an attorney look over the contract with her so if she had any questions or concerns that the attorney could’ve answered those questions for her before signing it
The way she respectfully and professionally publicly speaks of her former employer without using one remotely negative word or reference is incredibly admirable. Yes, the late Prince Rogers Nelson wasn't the only person to ever lose the right to use their name. IMHO it's criminal that the courts could possibly rule in her former employer's favor.
Basically, they made the name - and any variation of it - the legal brand. So her name used to be "Hailey Paige Gutman" and any variant of that, like "HPG" or "Gutman" or whatever you can think of, was included in the "brand name" deal. Further more, they made sure that the brand name would go to the company (and sadly, it seems some judges affirmed this), not the designer, and took away her personal social media accounts but also her ability to appear as a designer of bridal or evening fashion in a professional capacity. Cheval was a young, inexperienced designer back then and probably thrilled at the chance to design for such a huge brand and, to be honest, probably couldn't even afford an attorney specializing in IP and business law at the time, either. So unfortunately, yes, it is possible for a company to take away your rights to use your birth name in a professional capacity. :(
She is not allowed to compete with the brand Hayley Paige. That means she legally cannot make clothing. It is all about money and power and, unfortunately, she does not have enough of either.
