      A POTUS or former POTUS is also not beneath the law. Elias and his fellows have weaponized law.       It needs to review by the SC to determine if it applies or not and if so, what are the limits? For example, free speech….but you can’t yell fire in a theatre, if there is none.

      It is idiotic. The very basis of an impeachment of a president, for high crimes and misdemeanors, proves that there is no immunity for a criminal act done exclusively for the personal or political interest of the incumbent. The Constitution also goes on to say that the incumbent is open to legal action on leaving the Office. The only presidential immunity that can exist would thus be in relation to an action taken for reasons of National Security, which would by definition involve authorized senior military and legal members of the administration... and the SCOTUS Justices know it.

      There are no temporary monarchs that I recall anyway. They are monarchs for as long as they live, and then they make sure they have one or more sons to step in and continue the line.

I'm thinking that he has thrown so much weight (legal/political pressure) on his own back that he is going to exhaust himself and his resources to the point of failure. You can't take on that much weight without your back eventually breaking. He isn't in the same condition that he was in 2016. And another thing. Back then he was running, essentially, to boost his brand. It wasn't that big of a deal to him. He was relaxed and enjoying the added global fame. Today, he is running out of sheer desperation and there is so much pressure, attacks from all fronts, that he is getting sloppy, incoherent, dysfunctional, and a complete mess.

      The district court of appeals already discussed and ruled. There was nothing more the courts to decide. The only effect that SCOTUS will have is to delay the start of the January 6 trial

    I was a CO at a DOC in California. To work there I had to go through extensive physical and psychological testing. It was important to know that I could not be corrupted and be able to make fast and appropriate decisions. We need a set of standards that a presidential candidate must meet before he or she can even be on the ballot.

    The reason we are facing this appeal is because Trump represents an awful character that nobody anticipated would ever rise to the high office of POTUS. However, SCOTUS has to consider this appalling individual's belief that he is above the law and rule on it. So even the pro-Trump jutices will have to hold their noses and not support the appeal.

    As you know, Marbury v. Madison made the Supreme Court the ultimate authority in the land. This case gives them the right to declare legislation from Congress and executive and administrative actions unconstitutional. We can't overturn Marbury because the Supreme Court will never overturn themselves, so it would have to be done by constitutional amendment.
    One problem is that the Constitution is so short and often vague---and it doesn't address hundreds of modern issues---that they can just make shit up. Take gun control. The Constitution gives the "militia" (citizen army) the right to bear arms. Guess what---ever since we have had our government with a standing army there has been no militia. So the Supreme Court decided that any asshole with a gun is a "militia"? Our Founding Fathers only added this so we could carry muskets into battle against the British. Now they're deciding what constitutes an assault weapon. This is especially hypocritical for the "constitutionalists" who lean heavily on the intent of the Founding Fathers when they wrote the Constitution. What if it doesn't cover a topic at all? Then they make it up.
    In Marbury, the Supreme Court ruled that the Supreme Court was the final arbiter. This is circular and is a conflict of interest. One could see this as the Court successfully conducting something akin to a coup d'état (they put themselves in charge). They took voting power away from citizens by appointing themselves Lord High Master. I don't know about you, but that sounds unconstitutional.
    I also think we need more than just case law---and only a single case at that---to establish who has the final word on everything. If Congress were to pass a law that does away with Marbury, would the Court, then, strike it down thereby keeping itself in power?? This is a runaway court!!

      yes of course - that whole 14th amendment disqualification - they ruled that they would not be the determiner of whether or not someone was ineligible for office. -they wanted it to go to the congress. Meanwhile the congress - wrote the 14th amendment. There is not a rational, cogent line of thinking when it comes to these justices and their decisions. Sort of like those justices that were asked about Roe - vs Wade and their opinion on that - and they all said - it was decided law - obviously nothing they say is really true.

      Great points Paul, and damned if I know the solution. What if we had an absolute blue tsunami this November, would that give the President and Congress and Senate, together, the right to overide SCOTUS and cancel "Marbury" ? It may be time to establish that once and for all. The PEOPLE elect all three of those bodies, they should have the SUPREME power. The Supreme court was always meant to be an "arbiter", not a "creator" of laws. What is in the best interests for America now, and damn whatever you guess the Founding Fathers meant, they are long gone.

      Strongly religious people are incapable of being devoted to reality, and too many of the Supreme Court justices are in that category. If you allow yourself to believe in things for which there is no evidence such as the superstitious and supernatural claims of most dogmatic religions, then you can believe in anything that you choose to believe. When it comes to reality, there are no such choices, it's not a matter what you want or what you like to believe. People have the right to believe whatever they want, and have religious freedom...that is fine. But, they should never be allowed to sit in judgment of others or to influence public policy. The ideal court would be composed of judges who are not religious or mildly religious only for purposes of rituals and rights of passage, being part of a community, and for cooperative good works toward the betterment of society.

    Watching from afar.The Supreme Court made an appalling decision on putting a stay on the issue of immunity which had thr effect of delaying the accountability and trials of the wannabe dictator.The appeals court heard oral arguments and presented their decision that no one is above the law.Anyone of sound mind and common sense knows it was a no brainer and the correct decision going forward.

    If the scotus wasn’t appalled & outraged in regards to J6, so that they would uphold convictions of those responsible, what hope is there that they would hold this criminal accountable for anything else.     I would argue that Trump being in court for a criminal trial like Georgia would be a necessary part of an election since during the campaign voters need to acquire all information about a candidate's capability to serve and the case would be doing that. Not having the case would take away a fundamental right of voters.

    A President should only be protected from prosecution if the relevant "criminal" action/s was/were PREVIOUSLY endorsed as "special NATIONAL SECURITY circumstances" by both the HOR and the Senate. Any criminal action not so endorsed must be subject to the full force of the law!

    Campaigning for an office is a choice. The courts should not care about that choice. Being held accountable for crimes is not a choice. If running for an office means you can't be tried for crimes, every criminal in the country will decide to mount a campaign for everything from president to dog catcher.

    The way I know law is that no one is above the law. The allowance is in pardon by another President or else the crime committed is prosecuted after one term in office comes to an rnd.

      The US AG will have the authority to dismiss all federal charges. It is not clear whether Trump would have the authority to pardon himself, as this has never been tried in American history.
