What don’t people understand?! ManU and Ashcroft came to an understanding thinking NewU would roll over and they didn’t. Now ManU has no DoF until NewU says so, while NewU can employ another one. Who do you think has the power?
if the words sacked or dismissed never appear in any written proof then it never happened. If he is still being paid he cannot have been sacked. If he was sacked and is still taking pay then he has dug himself into a hole that will see him in the courts for years.

Also why does anyone think that Newcastle would find out Man United want Ashworth & then would just sack him? In what universe would that make sense? How would it benefit them when it would mean they wouldn't be getting anything out of the deal. Seems like a desperate attempt from Ashworth to try to escape the contract that he signed.

I believe it is easy to get Ashworth if Man Utd really want him. All you have to do is pay the compensation, just as Newcastle did when he moved from Brighton. If Ashworth passed confidential information to ManU while still a NUFC employee be it officially confidential or would be reasonably assumed to be confidential and it goes to court he loses.
ManU has an equitable obligation of confidentiality, if it is reasonable for them to assume that the received information is confidential and it uses that information to its advantage then they lose in court.
If the reports that Ashworth gave information are true I don't see it going to court as NUFC will ask for full disclosure of all emails and phone calls between ManU, Ashworth and the guy from City and all the dirty laundry comes out.
I think this ends in ManU paying what NUFC ask for 2hrs before the arbitration case starts.

Only Man U would be in this mess, due to the fact that they tapped up Ashworth. You have no loophole, talking utter garbage. Contract clause signed and that's it. Pay the clause.
Even if you do, Ashworth's rep is in tatters, and now he is screwed. He's lost whatever good rep he had, he hasn't got a case for arbitration, and he's going to be sued.
Just that he got sacked doesnt mean the clause is null and void, as the former employee you still have detailed knowledge about sensitive information. Which you just dont forget just because you got sacked, in general courts stick to this "main principle". Otherwise it would be really easy for a fired disgruntled former employee to reign havoc on their former employer. Though you always can try, I doubt Ashford and United would win this case, their isnt a lot of jurisprudence both national and internationally out there either suggesting they have a decent chance to win. This applies both for the regular legal system and sports arbitrary system. Which Ajax experienced the exact same thing last year, when they thought they could just take over the ceo of AZ Alkmaar, Im aware the leagues are different but the UEFA rules still apply. And football clubs, managers and players in legal cases, still often refer to cases in different leagues to attempt to create new jurisprudence. Never say never, but the chance of winning this is slim. The most I think they could get out of this is a court ordered compromise.

Gardening leave in not being sacked
What Newcastle done was negotiate compensation. It's different to paying a clause in someones contract
This is a really simple case.
Ashworth is under contract at Newcastle. This contract includes a release fee. Man U can decide to pay it and Newcastle can't stop him walking away or they can negotiate a lower fee. If they do nothing, he stays until October 25 or Newcastle decide to release him.
The fee is high but Ashworth new this when he signed the contract. The fee paid to Brighton is irrelevant as that would have been tied to the contract he had in place with Brighton.
By sharing confidential information in breach of his contract which has then been used to leverage against Newcastle, ashworth may have left himself open for significant personal liability.

Such lack of facts and misinfo. Your 'comprehensive' research very speculative. Start from presumption that negotiating strengths of NUFC and MU broadly same. Any employer can put an employee on gardening leave (while still paying), if reasonable to do so - reasonable as seen from perspective of what is in employers wider interests. As far as I can judge, any sum to buy out legit gardening leave is ENTIRELY a commercial negotiation and I cant see how/why arbitration arises. This is not like a rent review in a lease, where an arbitration process normal and necessary,, eithrr MU offer enough £ or NUFC free to chooooose to hold Cashworth on leave for contractual period. What happened re Brighton utterly irrelevant.

Newcastle can stick to their guns and pay Ashworth until 2025 and get nothing in compensation. That’s just letting emotion or spite get in the way of business. Common sense would dictate a compromise by accepting a reduced amount of compensation. Common sense is a precious commodity in today’s world however.
