The phone that was suppose to be in evidence was not just searched. That officer took the phone home with him from the evidence room and used it as his personal phone , and it was proven that more was done with the phone , to include using a certain machine to mess with the text messages on the phone. The police man then brought the phone back and placed it back in the evidence room. They knew about it and the judge asked him, why did he do it and he said , his own phone was out of minutes. 😮😮😮 That same phone was still accepted into evidence and used as main evidence to secure a conviction. Think about that.
I've been saying it for a while now. This case has way too much error, not just one but many, my G stay outta these basterds hands they'll do anything to put away a man who has strong influence on the population.

Wow, they allowed someone to continue on jury even though he attempted to bribe the other jurors. But afterwards the juror was convicted of bribery. If you planned on prosecuting the juror. Why allow him to continue?
Because the law at that time a murder trial cannot continue with less than 11 jurors. One lady from the 12 had already been gone leaving 11. So cutting off the bribing juror would have been against the law. So they kept him.
It is worthy to note as well.... that the Defense Lawyers DID NOT Object to the tainted juror continued participation.... the Defense FIRST raised it when the matter reached the JAMAICAN Court of Appeal!!

When it comes to executing any form of justice, Jamaicans on a whole are in the mental state of just going by perception....Good judgement doesn't sit well within us. However, we're talking about Judges and prosecutors who should understand that they must be thorough in a court of law....They must follow the laws according to the books. Every Jamaican must have the basic knowledge of how the judicial system works and when it begins with regards to a case. The ppl must understand that the judicial process doesn't begin in the court, it begins once the crime has been committed, and so it's imperative that citizens stay clear of a crime scene before it has been processed. It is the norm in Ja. when something happens, for the citizens to invade the scene, touch and move things. Then the police officers/investigators often, do not take the time to properly extract and preserve crucial evidence needed to be presented to the courts. Then in the court, the prosecutors and the Judges do their own thing, sometimes overlooking key evidence. The whole system is just a mess...Chaka, Chaka! I think pride and laziness is our biggest downfall! No one wants to listen to anyone because everyone is trying to prove who's bigger and more powerful; and they can't be bothered because it's going to be too time consuming. Growing up, there were 2 sayings: "Short cut draws blood and the easy way works out to be the hardest." Now, it's going to be a lot of blood and sweat to go back through the process. They couldn't be bothered to pause to do it right the first time; now it's going to be twice as hard to resurrect evidence (if they're still available); find witnesses (if still alive, even); and a whole works of other crucial findings. I don't believe that they would want to throw this one out because they had some very compelling evidence to pursue justice. However, I can see something good coming out of this case. It's a huge lesson for everyone in the justice system to reform themselves, if everyone is willing to learn. Once we get our justice to work fairly for everyone, amid the crime and violence, I can see hope for our beautiful Jamaica!

This implies a lack of trust in the judicial system of their country, and furthermore, shows a lack of respect for the judges in their country. The last statement was attualy an advice to the Jamaican supreme court to follow through with the privy council and quash the case as it should not have reach to the privy council on the jury situation alone, so they didn't afto look at the other two.

It was mainly the failings of the State which the Appeal Court if they had considered the case properly due diligence it would not have any reason to come to London. The eagerness of tampering is what makes the case strong against them in the eyes of the public. I feel if none of that happened this case would've been closed already.
The deadline to submit the findings of the forensic expert that determined the phone was in Fact tampered with was not met, and therefore the appeals court didn’t allow the report to be used as evidence for the defense, I am sure if they decided to do a retrial the report would be a major key of evidence for the accused, and that’s even if the phone records are allowed to be used against them. Being that the records were obtained illegally more than likely it would be tossed and wouldn’t be allowed in the case.

The state experts would have also examined the phone metadata tampering allegation and validated the allegedly illegally obtained reports from the accused service provider which may not be deemed strong enough to be tossed out. So many possibilities, lets just see.

They couldn't be bothered to pause to do it right the first time; now it's going to be twice as hard to resurrect evidence (if they're still available); find witnesses (if still alive, even); and a whole works of other crucial findings. I don't believe that they would want to throw this one out because they had some very compelling evidence to pursue justice. However, I can see something good coming out of this case. It's a huge lesson for everyone in the justice system to reform themselves, if everyone is willing to learn. Once we get our justice to work fairly for everyone, amid the crime and violence, I can see hope for our beautiful Jamaica!

The then Jamaica laws and legislation in trial by jury in court were allegedly manipulated in the disruption of justice by tainted jurors and compromised evidence. By cause of probability, this weighs in favour towards the defendants and their accusers.

The biggest issue is that a missing person without proof can not be considered dead. By this alone, the case shouldn't have even been considered. There must be valid prove of death, a body or DNA or video of the actual killing ( which would still need validation) not sure why they are even wasting time with this case that should've never been tried from the beginning.

The last statement was attualy an advice to the Jamaican supreme court to follow through with the privy council and quash the case as it should not have reach to the privy council on the jury situation alone, so they didn't afto look at the other two.
The mobile phone was not an exhibition the Privy Council had leaned their judgement on. It was mainly the failings of the State which the Appeal Court if they had considered the case properly due diligence it would not have any reason to come to London. The eagerness of tampering is what makes the case strong against them in the eyes of the public. I feel if none of that happened this case would've been closed already.
The deadline to submit the findings of the forensic expert that determined the phone was in Fact tampered with was not met, and therefore the appeals court didn’t allow the report to be used as evidence for the defense, I am sure if they decided to do a retrial the report would be a major key of evidence for the accused, and that’s even if the phone records are allowed to be used against them. Being that the records were obtained illegally more than likely it would be tossed and wouldn’t be allowed in the case.

The state experts would have also examined the phone metadata tampering allegation and validated the allegedly illegally obtained reports from the accused service provider which may not be deemed strong enough to be tossed out. So many possibilities, lets just see.
