    My daughter has had MS for almost 20 years and is still fighting for disability. She been on MS meds , has seizures, had an aneurysm and suffers from depression. She's lost jobs because of it years ago and yet once again she's awaiting another appeal in Ulster County NY for over a year. She's been denied twice. She has been under Dr.'s care for many years for this illness. She falls, has slurred speech at times yet no one seems to care. She has plenty of medical records, MRI and ARI test results showing her condition. We are at our wits end over this. It's outrageous some people get it for a fake injury. No one cares.

      That's horrible!! I'm sorry to hear that! 😞 keep trying! They usually deny the first 2 times you apply...bc so many people just wanna check! The 3rd time shows them it's really needed!! Even SS told me this. I got mine on my 3rd try...without a lawyer!!! Prayers for ya'll stay strong and good luck!

      I'm in the exact same position. I have Multiple Sclerosis and have slurred speech, poor memory, and fall or hit myself on things regularly trying to walk by them. I can't cook because everytime I try, I burn myself, cut myself, etc. I don't function well at all, and my eyes shake. I can't see when my eyes do that, and it does it multiple times a day. I also can't get approved. I can oy stand for maybe 5 minutes at a time, and I can not sit with my legs hanging down for any time at all. I hardly function at home, but somehow I'm expected to work?! Ohh and I can't pick things up without dropping them, I have almost no feeling in my hands so it seems like I'm clumsy but I just can't feel anything in order to have control over it!

      @@multiplesclerosissux don’t give up the government wants you to give up so they don’t have to pay. Yes they make it terribly hard. I have a sister work two jobs all her life then had to have heart surgery and now find it difficult to work. Goes days where she can’t talk and is being denied benefits.
      Autumn just side note, with your symptoms it sounds quite a bit like myasthenia gravis symptoms. MG is something that people with lupus can also develop. it’s neurological. My sister had that problem. Her rheumatologist kept telling her to stay on the medicine for lupus but symptoms got worse A lot of her tests were coming back inconclusive but she finally found a Doctor willing to treat the symptoms because if it walks like a duck, quack like a duck, look like a duck is generally a duck and she was finally received diagnosed. The medication she received was helpful at getting her back on her feet then find out she had a tumor on her thymus, which produces hormones that caused the symptoms of MG and just recently (1 mth) had it removed. She’s doing so much better. It was the MG that was causing her debilitating symptoms more than the lupus.

    If you want to win continuous care from a doctor along with a concrete diagnosis is the only way. Forgot to add that you need to show that you are not able to find employment you can do with your particular health issues...all of these are important.

      I did all 5,but. I was unhirable due to epilepsy. Company don't want this responsibility, not covered. I present, denied. I was also denied because husband was on ssa,it was fake. I am one in a million people, but was targeted by appellate court. They admitted it after 7 years.

      @@snapdragon8888 my hearing by phone is in a couple of weeks . I’m 52 and have worked 29 years of my life with legit health problems only have 1 kidney etc etc etc and I still don’t feel like I’ll get approved pisses me off to the core !

    5. nonmedical statements from former coworkers, supervisors, attendance history.

      i got 3 out of the 5..
      MRIs and X rays of my knee, brain and back..
      medications
      seeing a therapist and psychiatrist on a weekly to monthly basis (psych i only see once a month. my therapist once a week in person or sometimes via phone)

    I just had my hearing on the 4th and wow what a waste of time I was diagnosed with osteoarthritis stage 4 bone on bone all compartments of my right knee horrible pain every day all day was told I need a knee replacement by every doctor I've been to but all say I'm to young at 45 years old and I'm obese so I have to loose over 100 pounds too I'm trying to do that I'm down 45 lbs. since Feb. of 2018 I have been prescribed Norco's 325 - 10 twice a day for the pain cant cook or clean or move to the bathroom without help and my walker I was also prescribed too I cant drive a car as its my right knee and it is impossible to move the joint at all without it locking up and popping and stabbing pain I have been off work since march of 2016 and was denied 2 times because a doctor said I could work 2 hours a day but not lift 10 lbs. no standing no walking this system for disability is a designed to not pay you as during my hearing the job specialist said I could hypothetically do 3 jobs but when my lawyer challenged it the judge stopped everything what a joke of a system took me over 2 years to get this hearing and its obvious this system is a joke and a scam the people of this country need to not pay into this system if it isn't there in case you become disabled its time to force our politicians to fix this system as hard working American people are suffering because of this flawed system !!! I only have 3 months left where I'm living now then I will have to be homeless !!! this country needs a wake up call !!!!!!!!!!

      I feel your pain!!! Your case is almost identical to mine. My judge didn't even consider any of my orthopedic physicians medical records. She based her decision on a fill n doctor whom I only saw 2 times. He stated that said I rarely elevate my feet but he is the one who increased my BP meds with a diuretic in it to reduce swelling as well as control it. I followed up in a month with him and she said that I stated again that I rarely elevated my feet. She ignored almost a whole entire year(2018) of medical records describing my pain level, limitations, and impairments!! I dont understand why someone could not even consider your primary physicians findings and statements supporting my deteriorating condition. Hopefully we both will get what we deserve one of these days before it's too late! Best of luck to you. You and hundreds of others are in my prayers.

      Call the federal court house on Monday have them send you the proper paperwork to file a lawsuit against them ssi is an entitlement don't believe me look it up on Google

    Hi Mr. Ginsburg!!! I want to thank you immensely. I was able to learn so many things from your videos that i was able to get disability on my first try. Its been rough with my ruptured disk, and it was even worse when everyone was so pessimistic about me getting disability. If it wasn't for you, I'm sure my case would have been lacking a few things. I was awarded in a little over 3 months in Texas. You are doing great work helping people. I want to Wish you a Merry Christmas and an amazing New year, 2017!!!

      I'm glad to see this comment. It gives me a little hope. I have two ruptured discs and one is extremely severe. So i can honestly say i (LITERALY) feel your pain and their is no pain like it that i have ever dealt with. I am also trying everything i have learned from these videos and hope for an approval my first try.

    Helped my wife do the online SSD forms (no attorney used for any portions) and got her approved in 89 days. Unbelievable, under 3 months. She had been in a car crash with me (I was driving and she was front seat passenger) when a 17 year old girl crossed the divider and hit us) and needed continuous iron infusions, blood transfusions, had damage to her heart and had 5 broken ribs as well as needing a double enteroscopy to corterize holes in her stomach large intestine (that's why infusions/transfusions were needed). We lastly just needed to list all her meds, and then they sent approval letter. This was in NJ. I am surprised some of these comments below sound bad and were denied.

    Well now I feel better watching this video. My Ortho suggested I file for SSDI after I have had 3 hip replacements in 16 months and I am 33. I have all of these and I am on LTD from my work now. I am going to get testimonials from my bosses and plenty of my colleagues. I just wish you were in Arkansas.

    If you file for SSDI, then you turn 62 while you’re waiting for your case to be settled, can you start collecting reduced benefits? And how will that affect your disability case?

    I have been on this miserable journey going on 2 yrs now. I've just gotten thru the social security drs exams and waiting for their medical Dr to look at the results. I've just found the videos recently and am watching them. I have a lawyer I contacted saying to contact him if I get a denial letter again. With Ptsd,degenerative disk diseases,cervical instability problems,arthritis thru my whole body smh everyone told me to file that it was a guaranteed thing. I haven't been able to work since 2011 . So I don't know. Drs and documentation out the Ying yang but still being tormented. Idk I'm hoping I can find the answer. It's driving me crazy. I love to work and if I try to do anything it puts me down for a time. Smh persistence is my middle name so won't quit til I can get some answer wether it be from living under an underpass or finally having some kind of financial stability. Blessings to all who were approved quickly. Their process aggravates health issues wether physical or mental. Their whole system needs to be revamped and updated.

Well my day is in the morning (hearing) I am staying on a good note lawyer feels all should go well all doctors filled the paper work that was sent t them and also with new laws that were applied back in May 2017 to make sure Judge gets all my records before hearing all set!! Please keep me in your prayers almost 3 yrs for this hearing Praying it all goes well! Got my date back in May and I was like OMG 3months!! Well 3 months came quick!! :)

    i have an unusual case and feel lost. years back i was crushed by a forklift. crushed my pelvis. have it rebuilt. a year later i was hit by a car and sustained multiple injuries. more titanium in my leg. im now 50 and cannot sit for more than 10 minutes. or stand for more than 10 minutes. i have not worked more than a year straight in 25 years. i have lost everything as well as the ability to take care of myself due to not working steady. im at a lossm no money for doctors or lawyers. what can i do to salvage my life??

    Mr Ginsburg, I was Very recently approved for SS# Benefits and at the same time IMMEDIATELY was informed by my LTD Carrier that I no longer qualified for THEIR LTD as they had determined I was no longer Disabled (BTW my Left Leg is STILL missing due to Diabetes) and so Cut Me Off faster than you can Snap your Fingers! I had gone thru the entire (and enormous!) hassle of Medical Paperwork, Doctors' corraborative opinions etc..for the entire 11 months that I was on LTD. I had previously worked 17 years at my job with EXCELLENT references. The Lawyers that the LTD people assigned to help me Win my case for SS# Disabiity took their cut right off the top when the Award was given to me. The LTD folks are now demanding their Payback. I find it EXTREMELY COINCIDENTAL that Only AFTER I was Approved for SS# that the LTD folks don't think I qualify for their LTD any longer. Had they determined that in the past 11 months well, then they had No Chance of getting reimbursed by me! I think they should just have REDUCED my LTD Payments accordingly as it states in my LTD Policy? Do I have a case against them? Since they STOPPED my LTD Payments 3 weeks ago I don't think I have anything to lose? Please, provide your Educated and Experienced oppinion about this to me.

      I was an LTD Adjuster, it is hard to get your claim reinstated, LTD is a group product, u can appeal and usually lose and then it's a civil case were u have to pay an attorney. That is unusual, if I saw SS awarded I always approved, SS has a much harder definition of disability. My advice, Keep the $$$. I had more people after being awarded, I would say send the check in, they use to say F#$# u.. n I didn't care, I wud do the same

    Sent in my whole MD Anderson cancer records in and was still denied of stage 4 melanoma cancer benefits.4 surgeries and 20 lymph nodes removed later..

    how about "invisible" diseases? fibromyalgia can have 60+ symptoms but it's not something you can really see such as a broken bone.

      +FIBRO MOM - FMS is clearly a legitimate and devastating disease. However, it is much more difficult to win FMS cases in SSD hearings. Judges prefer to approve claims for conditions where there is objective evidence. On the other hand a very supportive doctor (ideally a rheumatologist or other specialist) can be very persuasive. FMS can be an uphill battle but still viable. I have a strong FMS case scheduled in a few weeks - I am hopeful that we will win.

      I don't know if you will see this as you posted this 2 years ago. Fibro has a nerve component. I was dx'd with fibro and it was lyme so you may want to rule that out. However, you should go to a neurologist and have them do an ENG and a nerve biopsy. That will add some weight. If you have back problems get an MRI. Also, if you depression go to psyche not a family doc but psyche. Always tell the nurse your symptoms and repeat to your doctor. Go to a rheumatologist, neurologist if indicated, psyche, family doc and go to physical therapy and chiro. Then file. If they send you to their doc for a physical carry nothing in with you but ID. That's it. They will document that you picked up your purse rather you bent over and picked it up.

      @@dianecelento4974 It was 10 years after the rash so I did the one that didn't take insurance. Of all the tests that was the more reliable one at that time. I don't know if there are other ones now. I do know that it's hard to win a disability case with lyme disease but you sure can with the damage it does.

    I've had EMGs, a myleogram that took 1.5 hours to do (worst test) Myocardial infarction with 1 stent.. Insulin dept, cholesterol, beta blockers, lopressors, 5 slipped disc, shots in my back, 7 fingers operated on, ulner nerve surgery, got another ulner nerve needing done, 2 busted rotator, CABG x4, 2 bilateral Carpel tunnel surgeries. Basically 12 surgeries in 2 years and missed approximately 1 year. Thank God my job had short term disability. Denied one claim. Working in the 2nd.. filed November 15, just got my denial 2 weeks ago.. what's up with this denying my claim? No longer working and my attorney filed for a 2nd claim.. was surprised I got denied within 2 months.

    I have my disability hearing tomorrow. I have bipolar, ptsd, major depression, anxiety. I am 32 and I stayed in a nursing home for over two years getting treatment and only been out three months and it's been very difficult trying to get back into society. I hope all goes well I just can't see how I can work with the bipolar episodes and depression that keeps me in bed. I have a horrible time remembering things and am very angry.

    Hi Mr. Ginsberg, thank you for the informative videos! I do have a question though: what if you've had back injuries in the past...very few documented because of no budget for seeing doctors, etc? And no one, not even the ER department here in Florida will okay an MRI because of the costs. I do, however, have three documented arthroscopic knee surgeries that span over an 18+ year period. I'm 54 and in constant pain and can not longer find work, because prolonged standing is not an option, and I don't have the most modern office support skills. Is there still hope for me even though I have no recent doctor visits?

      Di, without an MRI and ongoing treatment you will have an uphill battle. SSD judges are not likely to award benefits without objective evidence of your issues.

    The best proof of disability you can have is letters from your primary doc and specialists providing all your diagnosis and a signed statement saying in their best judgement that you cannot hold any type of job.

      Mine was granted but they totally discounted my doctor's report. I had x-rays, MRI's surgery, exams etc and in the decision totally disregarded his report.

      That's not true,my pain management dr. Don't feel my pain,but he'll say I shouldn't be having any pain for my symptom, I personally think they can hurt you, maybe that's why the judge didn't look at your drs. Statement because they know that drs. Don't know how your really feeling inside.

    The year 2011. I became ill from Breast Cancer, one vocal paralyzed, Copd, The cancer itself caused nerve damaged mostly on my left side. I have neuropathy in both legs & feet ( from Doctors request= not to drive no more ). Because majority of the time I can not feel my feet because of the neuropathy & my balance is not like it use to be. About two years later, I now have congestive heart failure. I sleep in a hospital bed mainly because of my one vocal paralyzed & so I would not aspirate my secretions into my lungs. So, therefore, I have to take water pills every day because I retain water around my heart & lungs. Around 2013, I had to be put on a ventilator for 3 & half days because I had a benign tumor taken off my right side of my neck, which became swollen & it was pushing onto the other vocal that was paralyzed & that caused me not to be able to breathe. So, at that point i almost died because it was almost to late to get me to the hospital. Another time I almost died was when I caught pneumonia & there again i had to put on a ventilator for a day & a half=that was in 2014. I had breast cancer twice. once it was in remission in 2012 & it came back in 2014. So, I had to go through chemo twice, But, no radiation. I had a lumpectomy in 2014 & that went wrong because it caused me to have an infection & it layed open when they opened up my stitches.. (big enough hole that you could stick your head through to my chest), That had to heal from the inside out. I still have nurses that comes to the house to monitor me & draws blood every two month for my doctors & I also have an occupational therapy working on my left arm. I had surgery on it about 8 months ago but that surgery has not helped with my nerve damage. I am unable to raise my arms over my head. I am unable to walk but a short distance because of my vocal paralyzed & Copd. I have blood pressure issues. Either it runs 170 over 110 or it was so low once that I had to have an ambulance come and get me. I am on about 20 different medications & there would be some days that i just want to say goodbye to this world. My chronic pain is mostly all over. Some days I can stand it but other days i just want to jump off a bridge somewhere. = JUST SAYING!! I have been in front of the same judge twice. Once for my SSDI & the other one for my SSI. My SSDI went all the way to Federal courts But, could not find someone to take it to 5 district. So, of course, the SSDI is now expired. Now, I am still fighting for my SSI & now my Widow's benefits SSI. That same judge declined my SSI, already.. So, it went to the appeals courts & the appeals courts sent it back to the judge & told him that we do not agree about the physiology reason. ( Oh, one more thing to point out ) After my very first declined letter from the judge. I did not want to live no more. I was a mess & my home nurse found out what I was planning on doing & she called it in & I had to spend a 72 hour suicidal hold on me. Emotionally I am a mess as of even today. I am begging for some help!! It is not even telling you things you might want to hear. These are facts. I know deep down. I can not work physically & emotionally & it really kills me inside knowing this truth & I can't get a break. **I DO NOT KNOW WHAT ELSE I CAN DO?? I AM SO VERY DESPERATE. *** CAN YOU TAKE CASES IN KENTUCKY??

    I live in Michigan and have been off work for 15 months due to injury s I had foot surgery last year ,still awaiting surgery for a fracture left wrist , and I'm 7 weeks post op back surgery s1 l5 pars fracture which was a 7 1/2 hour surgery and I'm still having this intense tingle and numbness in my feet I've applied for ssi and was denied twice reason giving that I have a education, I'm still young turning 50 this year) and that there is other work I can do ,I've been driving hi lo the last 10 years so I've appealed again I haven't even healed yet and they have made there determination its so stressful worring about paying bills that I'm risking hurting myself again just to put cholthes on my back I've seen people with little to know injury s get approved I think it's all a lottery i guess I'll just have to live my life in pain.

    Excellent I have been on ssd in past but worked for 7 years for great employer then left due to bullying of new coworker. Then new job, refused to allow me to go to dr appointments and made it all very difficult for me. With reopening of case I did submit all employer emails where it was clear they did not want employee with bipolar disability.

      You don't win based on a diagnosis but in my experience these conditions often produce functional limitations that would preclude work. If you are over 50 you likely have a solid case.

    Mr. Ginsburg. I am hoping that you could do a video on one of my many disorders. I have Ehler's Danlos Syndrome, Type III, POTS and MCAD, all of which are very common comorbidities for people with EDS. Luckily, I do not have Chiari Syndrome. However, between the three of these, I am miserable. However, I don't think that the judge is going to take me seriously because these three disorders are rare and take a while to describe. Any help you can give on this topic would be wonderful. Thank you!

      Is the Blue book still online? you can match the symptoms you have to other disabling conditions that describe the same degree of functional limitation to a system dysfunction that you have. Like being limited how far you can walk before you have to sit, or uncontrolled hypoglycemia causing brain fog, etc Have your depression about the conditions documented. They will count additive effects from more than one condition. If you can document where your symptoms match, then you can take it to an attorney. Back awards count from the first date of application.

    I lost my big toe and the toe next to the big toe from lawnmower accident in 2012 I applied for benefits and got denied . 2 yrs ago I got hurt at work and have multiple herniated and bulging discs workman comp juggled me around with 3 dif agents and 3 months later denied me saying pre existing condition. I never had this condition before and I had to pay for mri myself no insurance yet from work at time one month hired in … then I got insurance 60 days later and got denied any surgery or injection therapy …. got denied for prosthetic for my left foot with amputated toes , very sore till this day having to wear steal toed boots that don't fit right and your big toe is responsible for 40 percent of your weight … so now im on fmla at work and have all documents of denial of everything and have documents proving my back and toes and have gone through phys therapy ….worst therapy ive ever seen ..I laid on my back and raised my pelvis up spread my legs and did stretches and it cost me 3k but with my insurance I only have to pay 800 bucks lol joke ...did not help me and my herniated bulging discs …. the ER dr. gave me 30 steroid pills and said you can go back to work in 5 days lol … a month after that I suffered from sciatica for a year OMG worst thing ever … now I see a chiropractor 2 times a month to relieve my pain to a dull annoying pain lol ….would I get denied again??

    I have schizophrenics disorder and have trouble concentrating remembering things disorganized thinking communication and social problems delusions. Sometimes paranoid or hear something that's not there. They denied me twice but I'm waiting for a hearing. I've been on lots of meds and now I'm on invega and topamax.

      I have had some success with schizoaffective disorder if I can present evidence showing that my client cannot manage daily needs (like cooking, bathing, organizing a schedule, using transportation).

      @@ssdattorney i'm not good at cooking i can only microwave and make pizza or something simple like mac and cheese, i can take a shower, i don't really have much of a schedule but i can organize it, i know how to use transportation like ride a bus but it's confusing to know where all the bus lines go. i usually only take a one way trip to downtown station.

    Because of how long it takes to get disability, it's really important to carry short term and long term disability through an employer. It is a lifeline in case you become disabled. That way you don't have to be homeless or something worse while waiting on SSA to approve you for SS disability.

      @@MsLilBit8344 I wish there was a remedy. Unfortunately there is something called Soverign Immunity that protects SSA from this type of suit. The problem is that Congress has underfunded SSA for years and SSA just does not have enough people to process claims in a reasonable period of time. So you end up with claimants waiting 2 years or longer for a hearing date and when they finally get their day in court, there are no recent medical records because they have no money or insurance. Then the judge denies the case because there are no updated medical records. Disabled people don't have a lobby nor are they a unified voting block so it is easy for Congress to ignore their plight. Lisa Rein of the Washington Post has published several articles recently about the massive dysfunction at SSA but I'm not hopeful that any changes will come out of this public shaming.

      There is a big difference between being denied at the administrative level vs. being denied at a hearing. At the administrative level (initial and recon), the SSA adjudicator is looking for a listing level impairment, whereas at a heairng the judge will consider more factors. Were you denied at a hearing?

    I have denied 3' times for SSDI, my case is on a appeal now. I have to say this is ridiculous. I have a number of health issues including COPD and I am a thought broadcaster, I really am. Thought broadcasting will not get better, I have it till the day I die. There is no cure so my psychiatrist was going to write the judge a letter that my condition with thought broadcasting is not cureable but my attorney does not want him to write that and send that to the judge. I think there trying to make a example out of me and its disgusting. I worked most of my life and I still work part time for the last 2 years because I have to survive. Every 10 minutes I have to stop and catch my breath, my thoughts and the way my processed thoughts are torture. I have no privacy, the whole thing is a joke

    I have had Nuerological of the brain since 18 months old and Seizure disorder cause from the damage and still to this day dealing with it. Yes I am on medicines. I had even brought every required documented paper as they ask for and these hot shots want to be's overlook it and ignored me. Because these unprofessional people neglecting the fact of my medical issue and ignoring my evidence and rejected to read it, accept it or review it and it was from my actual neurologist and you call these fools professional. Nobody asks to be born develop, experience or diagnosed with for any medical condition. No matter how strongly any Judge, person, friends, family or anyone for that matter tries to ignore it, judge anyone with a condition or discriminate and ignore as the social security office has done repeatedly for years and gotten away with it. I got news for those who don't walk in the shoes like we do who have a medical issue.. no matter how hard someone tries ignoring, neglecting, walking away from the fact and truth of a person having a medical condition or even being
    discriminating or judging a person . It won't work because no matter how hard you keep playing the game trying to ignore what exist you will never cure it, controll it or make it disappear. It'slogic common sense it will be there for life and even if most conditions go away it develops into a different, more risky and serious matter over the years and comes back by itself or with another issue even maybe more serious. It will not go away and the person with the form of a medical condition will have live with the fact of many high risk over their head all their live. For anyone who does not have what I have or any condition who are you to decide about my health when you have not a clue to what a person has to deal with, feels like on daily basis including the insult and criticism we have to tolerate. The fact is the social security office has neglected many cases for many years and still to this day goes by the same rules they had 40 years ago and never updates their stuff. They tend to go by their thought of opinion or what they think not the actual truth or documented doctor forms. Worse off the neglect and ignore actual licensed doctors and demand you see theirs when you already have years of proof this is how unbalanced , upside down the social security is and actually the need a 100% all around investigation. Trust not one person in thus world ask for we were born with, developed, diagnosed with or just develop and you people get away with using your so call thought as a excuse cause you will not it admit exist and cannot be cured , controlled or disappear by your words or no matter how hard you try and what you do. Its there accept it and truth it is a condition! I should be getting disability since I first applied in 1998 and the fools in the office even made me get 100 witnesses back then to sign these forms they sent me. It was done and completed as they asked and turn in but they ignored it and that is a lot of signatures. I even still have them forms around somewhere here packed away. I even got all my papers going back to when I was 18months old. I am 54 and still dealing with seizures and had been injured from 3rd degree burn, rods in my leg and other injuries and bodily harm from seizures over my life time. So don't tell me its minor when you have no clue or until you walk in the shoes of someone with a form of a condition.

    I have a case waiting on approval , I had a fractured hip and pelvis from head on collision and I had the hip replaced with plates and pins but my bone grew back because i was 22 and I had to get that removed again , I hope to work in the next 2 years at least but right now I have breakdowns when I walk and serious amount of arthritis , swelling and bruising In the hip , but once I get my strength back hopefully I’ll be good to go can’t wait to run and jump again

    Dr. Mr. Ginberg, I owe it to you. I used your advice from your vids.got disability almost asap on my second try with your advice.would recommend Mr. Ginberg to anybody. I have a question. I am totally deaf (for life) but disability isn't giving me permanent disability. They are garnishing my SSDI. I make less than those on SSI now. Is there anyway to get that changed? Any info would be so greatly appreciated.

      You could look into enrolling in an income based repayment plan. If your income is very low and you claim allowable expenses, your "payment" could be zero or just a few dollars per month.

    I've hired a attorney from the beginning. I've only talked with him 2 times. I recently filed for reconsideration. From what i can tell at the initial and reco sideration stages the attorney's paralegal just submits my medical records that i send him. Do attorneys have access to adjudicators and explain your case? Do they just help in the hearing level? Im starting to wonder if i picked the right attorney.

      For the first application and reconsideration it's the SS pulling your record that's what you sing allowing then to do so once they deny your reconsideration your lawyer can now step in to get the records and it's your job to keep them updated with appointments test visits meds and any procedures you have so make sure everything is in your file when you see the judge I noticed SS didn't pull all my records they are not going out thier way to help you so you need to keep onto of everything because if you get denied at the hearing you can't add stuff to the file if you decide to go for the 2 appeal or even federal court

    Hi. Thanks for the videos. I will be 52 next month and I have a long work history. I have had 4 psychiatric hospital stays with one suicide attempt within one year. I have been diagnosed with depression and was put on many different anti-depressants. I have recently been diagnosed with bipolar disorder and borderline personality disorder. I am taking Seroquel and the dosage keeps increasing because of lack of sleep and anxiety, panic attacks. I'm also taking med for anxiety, asthma and flexeril for back pain. I have filed a claim two years ago and I'm waiting on a hearing date. I have so much medical documentation and I'm still waiting for a hearing. What could be the problem?

    I belive that God helped me , I have diabetis but not on insuline, muscleskeletal disorders herniation, artritis, sciatica, narriwin both arm labrum tears but no surgery, on menthal health but never admited , I just got my favorable decision , thats why I askes you no long ago to make a video talking about combined efects .     How do you fight an insane judge who makes an unfavorable decision that you with an ongoing psychiatric condition - with approved by GAF from your psychiatrist, a newly discovered back problem and a massive stroke one year before the hearing. - do not qualify for SSI?

      Stents are designed to increase blood flow. If they work properly your heart function is likely to improve. THis may mean you need to look at a closed period of disability unless other medical issues leave you unable to work even with stents.

    All great things but I am not seeing the angle addressed where a person may actually be able to work. But because of injury such as back injury with surgery that repaired damage is now a risk to potential employers. Thus because of that injury your not employable by any employer due to liability risks. This is what I faced in my fight for disability. I at the time was not a invalid I was on medications but certainly not helpless. But I got constantly denied employment because of my back injury. So just because you might seem able to work or even want to work you become someone no body wants as a employee.

    Mr Ginsburg, My issue is very complicated. I was injured at my workplace 2006 and had 7% total impairment and was paid back then. I went out on SSDI 2008 under another issue. In 2011 I needed total knee replacement and then did receive workers comp for 12 months from the 2006 injury. I was well aware at that time this would generate more then the allowed amount from SSA. I contacted them and indeed set up a payment arraignment. in March of 2012. Here where is gets tricky. in 2016 I revived a windfall from SSA finding over 60.000.00 in earnings which indeed raised my SS payment but also in that same letter stated the over payment has been paid in full. Now in may of 2018 received yet another letter from that under payment did not take into consider the over payment from workers comp. plus its now another 1000.00 more and they have no record of the 2800 we gave them for the over payment. No wonder why the gov can get anything done right the first time. Very frustrating when I am the bottom 1% . Any guidance will be helpful. Thank You,,,,,Robert

      Bob, these types of situations can be maddeningly frustrating. It might help to have a lawyer actually go down to the Social Security office to see what they have. I would also involve your U.S. Senators - they can sometimes cut through the red tape. Unfortunately SSA is a dysfunctional bureaucracy with overworked staff and sometimes faulty recordkeeping.

Lets say a person request for documents on how and when they came to the dollar amount they say they generated this over payment, are they SSA required to give the recipient these files? Generally speaking, If a person gives SSA a request for wavier of payment because they would not be able to pay their reasonable monthly bills , are they agreeing to the over payment and shooting themselves in the foot sort ta speak for future request or reconsideration's?     The answer is no it isn't at all the same as a full time job or taking the same a an adult day care job. However I do need to take him for some outside help to provide me with necessary tools to continue to help him improve. They are not full time programs they work in blocks. I also can arrange transportation and I can drive him if need be for a summer camp program. But they are unusually no more then five days at a time and months part. I home school him so I can manage this offering him the one to one that he still needs.

    I've recently had 2 inguinal hernia surgeries in a yr period because the first one failed and developed a massive hematoma from the second and ended up in the hospital also I got diagnosed with a black or degenerative disc in my back which I put off because of my hernia surgeries. I've done manual labor my whole life and I'm 48 and literally am in pain in my hips, legs , back and neck everyday from just reg day to day tasks. I would love advice on what my next step should be and if I can qualify for disability.

      Marc, the question is whether the activity limitations arising from these conditions is likely to last at least a year, and will your treating doctors support you in stating that your impairments preclude simple, work like activity. Have you had an MRI? What does it show?

    I have a question... I am looking to get my disability for epilepsy and PTSD. I've been denied 3 times ( w out attorney ). I am going to college but can't afford expenses. Is it bad idea to try and get a job if I'm fighting for disability? this condition has kept me from everything. My drivers license was taken, i could not finish high school, had to quick nearly every job obtained, tried to enlist in military and when they discovered my conditions they put me on authorize leave for good.     I am thinking of applying for my Keinbachs disease. I have mri and ct scans showing complete collapse of the lunate. I am scheduled for a proximal row removal where they remove three bones out of the wrist. The surgeon told me it is a salvage surgery to help minimize pain.

      Interesting, I had never heard of Keinbach's Disease so I looked it up. If you have it in both wrists you could argue that work is not possible because of inability to use your upper extremities in a work setting as well as pain. If this condition exists in only one wrist then you would primarily argue for disability based on constant and unremitting pain.

    question i had lung surgery 4 times now and the last time they being the doctor took a section of ribs out from 3 ribs and he has me taking gabapentin for the pain which isnt working anymore i also take fluconazole for a lung infection i caught the reason for the last surgery was i got an infection from the first doctor who didnt clean and prep the area on my lung and left a hole so i was coughing up puss when i went back to the hospital this last time

    My son has 5 strokes and 64+ seizures. Ran over by a car with titanium in top of right hip to toe. Falss 2 or 3 times a day. I cant get him any Insurance. He has been trying to get S.S.D.I . For 6 years now. This time 2 yrs and 2 months. I'm so scared. I cant get his meds. Please help me to get him some help before its to late. Thanks Joanie Jessup.😢

    because my first dr. would rather argue with my mental health dr. instead of listening to my symptoms, been about 3 years now judge denied, now spine was being squished at c-5 and 6 by the time i cnaged dr.s after a year of arguing this is not because of my age, new dr. got referrals to 3 specialists spine specialist nuologist then nurosurgen, and to have them all three turn around after looking at MRI and say you need surgury NOW or you will be in a chair, you could not see the white of my spinalcord any more, so feb 13 2017 had fision done, now fingers even more numb lost100 plus pounds my muscle,gait,strength, more surguries, nurosurgen say 60 percent lower back may help 5 bulging discks now and scoliosis, degigetitive in spine, muscles in arms cramp after few min of rep movement, now waiting for scpoes and stuff for gastro to ake sure my other problems is not guts or liver and all that, so think by the time i am dine have a case and have not been able to work since 2011 or 12 i suck at time and years, months, told judge that also, now i can not even do the one job they said i could still do,could you please give me some answers? my husband striggles so and i hate not being able to help nd be a burden for 10 years now cause of this fight with disability

    Hi Mr. Ginsburg...My name is Kim.. Im fixing to turn 48 in November. I have a bad back, and everytime I stand, or take a few steps...I HAVE to sit down, or even lay down sometimes. I had an MRI and the MRI showed that I have a herniated disk. It also showed something else, but I don't remember what it was.... When I take a few steps...it feels like my left hip is coming out of socket, and my left leg feels like its going to come out from under me. It hurts me so bad. I gained alot of weight due to my thyroid issue. ALSO....I have BAD peripheral, and diabetic neuropathy real bad in my feet, legs, and my arms. My feet, and legs hurt me very bad all day. Ive had the muscle and nerve test done, and it shows that I have corpal tunnel very bad in both hands, along with the neuropathy, but my orthopedic dr. said that she wasn't going to do surgery on me. I don't know why...maybe because I have the neuropathy so bad that she didn't think it would help. My hands stayed cramped up 24/7, and they feel like they are on fire. Its very painful. I have a court hearing on Oct. 19. I have waited 10 months and I have tried to get help for almost 5 years. Do I have a good chance of getting approved? I have worked just about my whole life. If I could work I would. I love to work!! IM SCARED THE JUDGE IS GOING TO DENY MY DISABILITY :( Thank you. I wish you could have been my lawyer. I have a very good representative helping me!!     Hello. I recently received a letter stating that as of 1/1/18, I was deemed no longer disabled. I plan to appeal within 10 days. I have Cyclothymic Disorder and OCD. I am working 24 hours as a tutor in a quiet, one-on-one environment. My question is should I keep working? I feel they will question the sudden employment drop. Im on Lexapro, welbutrin and clonazazpam.

    what do you do when you have multi chemical sensitivity and can't take a lot of the medications? I have fibromyalgia, ME/CFS and IC along with depression and anxiety and many more smaller things like MCS and can't tolerate anything for pain as it makes me so sick.

      If your chemical sensitivity is well documented that means that you cannot benefit from medications that might reduce your pain and help you function. So you would argue that SSA needs to analyze your impairments without factoring in any improvement typically seen from medications.

    Hi I'm 28 and I'm currently undergoing a hearing which was scheduled tentatively on Nov. 6,2018. They called my case critical. I was involved in a head on collusion back in 2014. I suffered from a head injury, shattered heel bone and broke my knee...I've been trying to get my disability since then. I was denied several times. Tried working odd jobs but couldn't stay on due to my health issues and made matters worse. Not sure how things would go but I'm praying they will approve me. Any advice would be glady appreciate.

    my question is if you in step 5 are determined you have some residule function say light work. but that the work you can do would only be say part time and not sustainable income, example you could work an hour a day and make $50 week thats about it. is that grounds for a denial because it's something not a flat out no

    I have two different issues in both knees multiple issues in my spine and back muscles and nerves high blood pressure even with meds for blood pressure I've still had very high readings that are in the realm of stroke or heart attack numbers a severe learning disability that causes clinical issues of depression and anxiety disorders I've been fighting social security for 14 years now and they have records from my primary doctor 3 pain drs a chiropractor several physical therapy sessions and a mental health facility that provides meds and other treatments for the depression and anxiety disorders and I'm still fighting them I'm in my 4th time going through the process the first time the alj told my lawyer not to speak unless she was specifically called upon the second alj never once talked or asked anything about my medical problems and only asked about the fraternity I belong to the third acknowledged my health problems and severity but still denied my case something needs to change within social security and quickly

    I mostly stress because I've heard all the horror stories about how long it can take just to get a initial decision, which is typically denied, and then about how long I could take before you get another hearing.you can't file unemployment during this time because that would be to assume you're able and available and seeking work.. so you have to have a special somebody taking care of you or living on the street.
    I've had psoriatic arthritis since the age of 21 and does a teenager at 17 had a large weird bone tumor growing out of my shoulder blade into my ribs I had removed.
    My first two to three years I lived with a never-ending huge swollen right knee. The arthritis was in my chest and it moved around to my wrists my fingers, etc... Late twenties I had my first serious back injury.... Lost a job because I spent the entire week not being able to straighten up pasta 90 degree anglethat subsequently led to a suicide attempt in 97, which I would not do now because I got two wonderful grandkids.
    in and out of doctor's constantly this whole time. And I've always worked really hard and have been very driven no matter how much pain I've been in. in fact I don't know what it feels like to actually feel good.
    Only three years ago during a two-month layoffs I went out and got three jobs 7 days a week for that time with one of the jobs lasting over six months. I also developed a baker's cyst during that time fluid forces the synovial lining of the knee down behind the calf muscle making your entire leg swell..... I've had cancer, I've had my gallbladder go almost gangrenous.. I've had carpal tunnel surgery which I need again...chronic tendonitis and found out I also have osteoarthritis and osteoporosis degenerative disc disease bone spurring and just about every joint.... And my primary thinks that one strange condition that I try to convey might be linked mortal fibromyalgia on top of all of this.... Any constant pressure on any muscle from the bottom of my foot to the middle of my back will cause great pain when I go to relieve that pressure and it's intense until I bend everything back into the mid-range and wiggle it out.
    I was sick for 11 months in 2014 with four of those months at least resulting in a fever of 102.... Suggested some kind of early COPD in my lungs ECT...
    most recently in December I got my 4th compression fracture in my lower back and went straight to my knees and elbow and had to be wheelchair into the emergency room.this was after I finally quit my job because of constant back soreness and pain and shoulder problems to work for my sister for 1 year.
    No I'm not working. I can't walk for my car to the house with a bag of groceries without my back legs and hips being so worn out I just want to sit down on the spot. The back pain and soreness just doesn't go awayand now I have numbness running from inside my left shoulder all the way down the inside of my arm to my hand with tingling.. left hand is very chronic in pain and has been for the last three or four years.......
    My medical records were over 2 in thick. As far as working on 54 and I work my ass off all my life. It pisses me off that I am too tired to vacuum or I have to lean on the counter for a minute or two three or four times just to make a simple 20 minute meal.
    and oddly enough it seems like the Social Security office in the fellow I talk with and the lawyer that I contacted right awayseems to discourage me from providing any medical records as they said I will just look at your past 12 months.......and I found that to be ridiculous because I have stuff going back twenty years that are very pertinent to what's happening with me today, not to mentionthe length of time and records keeping that I have of the pain that I've dealt with through my work career..... It verifies periods of depression and even a suicide attempt in thepast. So when the determination board sent me a letter wanting me to detail some my jobs from the past I sent them a pact with my full 2in of records and provided a short letterstating that I wanted them to have this because I thought it was very pertinentand I don't have time to dilly-dally and waste as they otherwise would likelydo their automatic denial the first time through and God knows how long before another hearing after that......it's just ridiculous how long the process is even when people have been dealing with something for 30 years or longer and have extensive records....... Meanwhile I see peoplethat have nothing more than chronic fatigue syndrome who are on disability, and I drive by and see them and they're out washing their car and doing this and that.
    meanwhile I've pretty much done all the work and answered the letters and provided info that the disability office notified me about and have not heard from my lawyer really about anyting yet. It almost seems like they're just going to hang out until I'm needed at a hearingor they accept my case and then they can just take their percentage cut for doing whatever I don't know what but.........
    main thing I'm curious about is why does it seem like they discourage you from worrying about past records beyond the last 12 months?
    Because the last 12 months definitely does not and will not show90% of what I've been through because there's been various different doctors some of which have removed their records because it's been too far back......
    So I sent the determination board my entire pack which was over 2 in thick as I stated and I hope this will be a benefit, I just want to overwhelm them and just make sure that they can see that I've worked my ass off and I'm not the type of person who's ever been out to take advantage of the system. In fact even in severe pain I have driven through it and out worked even younger healthy guys........ I hope the records and my mental condition will show thatyou might as well put a fork in me because I am Done. ......

    My problem is that i do need surgery but can't get it.. one day before my schedule date for surgery i got a phone call from my doctor saying they were gonna have to cancel my surgery for my umbilical hernia that's sticking out from my belly.. (its like the size of a golf ball probably bigger.. looks really bad) doctors told me they can't do surgery on me because i have severe sleep apnea and they can't put me under.. plus i previously had a heart attack few years ago and when they did a random heart check up they said i have heart issues so now they just don't want to touch me. They claim I'm a high risk for surgery because of all my problems combined. I'm currently on my process to get disability help. It's been like 4 months waiting and i just got another appointment for next month on August. I can cook but need to be supervised because last time i just tried putting a frozen pizza in the oven and i fallen alseep and the apartment smoke detector woke me up thank God! Im always falling asleep because of my sleep apnea it sucks.. and i tried ignoring my health issues and still try to get a job but with my large ball looking thing sticking out from my belly no company wants to hire me.. applying for disability was seriously my last option because i rather work.. but now I'm just going to wait and see what happens with my claim. Any advice?

      Forgot to mention i also had high blood pressure for years and got a CCAP breathing machine for my severe sleep apnea but it's really hard using the machine.. i kept telling the doctor's about it until they decided to put me to sleep at their hospital for studying and watch me sleep thru the night connected with computers ect.. i didn't know there was different levels of sleep apnea and after they saw me the nurses and doctors told me i was the worst sleep apnea patient they have seen at their hospital.. I'll admit that got me really down and i just don't even bother using the machine at home anymore.. too depressed and loosing hope

    I just want to thank you so much for these videos this is my eight time trying but i had to start all over again this time start from scratch, can you tell me that now i am starting all over can the social security use my old records that i have put in from the last eight years or do i have to get all that over again? My doctor even wrote a letter for me telling the judge that i am disable and why and he told me yea i know your dr wrote you a letter but i still think you can do these two jobs and he said being a mail sorter and a filing clerk, I say no i can't you have to pass the civil service test which i took and failed years ago and i still have to run around sorting mail and standing for filing and when i sit my legs swell up so bad they hurt i have congesive heart failure. can you please help with these questions thank you so much God bless you!!
