- I'm covering a story today being talked about in the poker world related to a player on GGPoker having $180,000 confiscated from him for being a previous banned player on the network. The story is a bit more complicated than that and I will explain it in detail. Let me know what you think about this situation as many people in the poker community are upset about this.

I think you have to allow sites to confiscate funds, as unfair as it sounds, so that bots and superusers can be stripped of their ill gotten gains and cheated players can be reimbursed... BUT in cases like this where no cheating is alleged the bankroll should be the property of the player. At the very least he should have the right to appeal the decision.
I'm not sure about GG.
Mind you, DNegs praises them to heaven, so they must be good. That's one guy who would never shill for a company that didn't act in the best interests of its players.

Now, what he said may have held within it something approaching a half truth, but what he left out, like stating unambiguously that there would be fewer winners over time and winning players would win less while PS made more money, was his biggest ever mistake.
As for the gambling, that's a different issue you have there mate. Stay away from the slots and all that degen stuff. If you can't, then avoid all poker sites that have them. The house have the edge and degens are seen as the addicts they are, to be exploited. Vicky Coren Mitchell resigned from being a sponsored Poker Stars Pro when they started publicising their casino for that reason. She has principles.

If a player is banned and loses a lot of money, would they kicked him out and return all the losses? Probably not. So they should not confiscate the winnings in that situation. They shouldn't have allowed him to deposit in the first place.
Yep, it's entirely the fault of the site in this case, and they need to accept that, but good luck getting any company associated with gambling to do the right thing lol.

No Terms of Conditions are not the law itself, you cant write whatever you want in there, even tough very big companys do and get away with it often.

Joeys point was, maybe not that everyone needs to throughly research a Poker site and he TOS, but if you are the type of person who is able to make a one time deposit of $50000, than yes, you should be doing your research. Who knows if theyll just ban you and take your $50k right off the bat? He was implying that if you have $50,000 to make a one time deposit on a Poker site than you should probably look into where this money is actually going. And I think that that responsibility decreases with the sum of money deposited and what t means to that person. Getting fucked out of $50 is different than getting fucked out of $50k.
We hear these huge numbers in Poker but $50000 is A LOT of actual USD. So yeah, do a little reasearch when depositing $50k. And I dont think Joey was saying that is was his fault, or that his money should be confiscated, but that you should know where you are depositing $50k.

also yea you have a bit mroe freedom in unregulated markets, however fundamentals still apply. like fundamental law for contracts and consumer protection. even maybe criminal law may apply in this case.
here is the thing,
as a business, a casino in special, youre obliged todo your due dilligence, as a consumer youre defently not.
regardless of the sums involved. realestate laws apply to a 500$ rental as much as to a 500 million property.
so it doesnt matter if he deposit 50k or 50bucks.
the casino screened him twice, beforehand. with the acceptance of the deposit and letting him use it on the site they agreed to the contract which is binding. now ofc if you violate the tos the contract maybe null and void BUT you cant void a contract in hindsight.
nothing that would justify the confiscation happend since the signup and deposit, they claim an incident which happend before the contract was accepted and then voided it in hindsight. let alone that the violatation was with another entity, its really questionable if this could legally even be a reason. but even if this is valid . the casino as a business has their due dilligence.
so either their screening was not valid - which opens another can of worms with regulations, tax buero and even on a federal level (money landouring, anti terror laws and so on) - or it was and they knowingly let him play and only voided the contract because he won and wanna cash out.
this seems like a small incident, but if the right people with motivation go after this could be something really real for that casino.
at least a braod investigation how often cases like this happen and why they let him play. they need to come up with a valid excuse regardless of what they do now. this boat is sailed

I was just agreeing with Joey that you should be aware of who you are doing business with. Buyer beware. GGPoker basically scammed him.
I completely agree that he should be given all the money he won. However, as a responsible consumer, one should do at least a minimal amount of research before doing any sort of business with anyone. Maybe if the person involved had looked into GG more, than they wouldn’t have been in the position to be scammed. I think the WSOP bears responsibility in regards to this as well. I’m sure lots of players had never heard of GGPoker before they held the WSOP Online events. Im sure lots of players saw the WSOP name and assumed they were doing business with the WSOP, clearly now this is not the case.
I completely think he is owed the money, but I think a lawsuit as proposed will be nearly impossible. GG is operating out of Curacao, a Dutch territory. Depending on where the player is located, filing a lawsuit against GG may be very hard if not nearly impossible.
Absolutely, they rightfully owe the player the money. I believe from this point forward the player involved will better research where their money is going. This is something everyone should be doing already, but hopefully this story makes others more aware.

I was just about to sign up to GG… Not anymore! Shady AF! Don’t accept his initial deposit but letting him play and keeping his winnings? Fraud
LOL, GG follow their terms and conditions when they're taking money but not when they need to give it back. It's coming up to a month since an outage (17th July) where they owe me about 1.5k as stated in their terms and conditions but they are now ignoring me so I'm having to take it further. They had another outage on Sunday and I was banned from their discord for posting the relevant terms and conditions regarding refunds so players could see if they didn't know what they were entitled to.

I was looking forward to trying out GG but everything I hear about them is just keeping me away. Sorry to hear about that mate, hope you get the money you're owed eventually, doubtful though, they seem so scummy. Say what you will about Stars, but at least they always reimburse players after their site goes down, or if an MTT overlays they take it on the chin every time unlike some sites *COUGH* Party..
I had this very same experience to an outage on GG (approx 6/8 weeks ago). I was in the money and on an FT at the time of the outage and I got a refund for my entrance fee (not what the T&C states would happen). All I got from GG was a generic reply about how they had not made an error regarding refunds for the MTT in question and that the matter was closed (Even tho I stated that I had multiple screen shots to prove stacks and current standings). I had also been in a couple of other MTT's that started after this one that I had busted in and I received no refunds for these (this is how it should have been). My point being, if you have the data saying that I had busted these MTT's (hence no refund) then you must also have the data on the status of the other MTT which was ITM and on the FT and therefore should pay out as per the T&C.
This is concerning because at worst they are scamming whenever the opportunity arises or they are inept and unprofessional and are unwilling to follow their own T&C's.
To me the argument for banning players because they are winning holds zero weight when you then go and steal from low buy-in fish like me. I only lost a fraction of what Dan did but the experience totally soured it for me and I wanted to add a voice to Dan's so that people do not just brush off his experience.
I guarantee that if Joey went into research mode and asked people to come forward regarding this MTT issue he would find hundreds (if not thousands) of people in the same boat as me and Dan.

The only difference is that I was in a $250 satellites which had X amount of 5k Main event tickets up for grabs. The late registration had finished but we hadn't reached the paid places. If you look on their terms and conditions it says this for my scenario, "If the tournament has started and is in late registration period (that is to say, where the tournament allows a User to register as a player following the fixed registration time) or if the late registration period has finished but the tournament has not reached the paid places, remaining players shall be refunded their Fee and current bounty (if applicable). Regarding the prize pool, (fifty) 50% shall be paid equally to the remaining players at the time of cancellation with the other (fifty) 50% being paid according to the chip to the remaining players at the time of cancellation. If the tournament has a guaranteed prize pool that has not been met or exceeded at the time of cancellation, only the prize pool amount collected via player registrations will be distributed.".
They emailed me back a couple of times saying no refunds were due as per their terms and conditions and just linked me to the page with that on there. When I questioned it further they say they're treating it as closed. They've given me 250 of their T$ and a $100 WSOP ticket as a good will gesture. It initially started as just the $100 ticket and they 'reviewed my account further' which resulted in the extra T$250 but when you're owed about $1.5k in actual cash from the total prize pool that's just not good enough.
Anyway, I'm not sure where you're located, I'm U.K, but I've requested a Subject Access Request for that day which they legally have to provide for me within a month or I can take it even further. What they should have is some info about the games I played, when I was logged in etc so I can take it to the ombudsman. They haven't even acknowledged my request as of yet and it's been just under a fortnight so it might get even worse for them if they fail to comply with that.
Just opened a GGPoker account about two weeks ago due to the WSOP being played on it. I started off not hating it, then it started to feel more like a scam site. Then some weiiiiiird stuff started happening and their customer service sucks. They just didnt give me my last day of my initial deposit bonus. No mas.
yeah I opened a ggpoker account too just like you about 3 weeks ago, and after a while the maked an update in which the gg software is not working on windows 7 anymore. They did not tell me about this huge update before and unfortunately i've registered in big tounament a day ago. The D-day the software is not running because i've windows seven and i lost my registration money without even playing in the tournament :(

Freerolling on player is common Business Pratice. You can basically do whatever you want on almsot all Poker sites as long you dont wanna transfer the money out.
Then they start reviewing. Its feels like they search for reasons not to pay. At least for Europe most Sites wont even verify you up to 10k Deposit until you try to cash out or make a ingame transfer

Gg poker is like the home game version of online poker. Cyber attacks on day 1, skimming funds. Wsop made a horrible move, should have picked one of the more established platforms that are available for play in US. Rather then stamping their seal of approval on a website, they should have at least sampled the software

Great content, wich points out many interesting ( and important ) questions. I totally agree on the fact that a system that fails to operate in a said way ( banning someone and letting him play afterward ) shouldn't take punitive action towards these person. it's all about being professionnal, and this specific line of action clearly isn't. In the end, having someone who points that out is a great thing, so thank you for the work you made on that, and using your platform to make people aware.

One thing I wished you had touched on Joey is how these incidents appear to government regulators considering legalizing online poker. In a nutshell: not good. Players do not have control over their funds when the site is not operating under the auspices of U.S. law. I don't think, unfortunately, they consider this. They just want to play. Exactly the same for players playing by VPN. Sites ignore this for deposits as you're allowed to do so with no ID, but when you come to cash out you have to provide proof of address and would fail if you have done VPN

Typical situation on sites with slots etc , happened to alot of players over the years. Allowed deposit and lose, but when winning they suddenly get banned for playing in the same network
They should not let anyone playing before verifying that is for sure. Huge mistake on their end and they now expect the player make up for it?

I think there is a big difference between banning a player for winning and banning a player for predatory behaviour. Sites love players like LLinus LLove, trueteller and limitless because they will start games and reg battle which is very different from players who only ever play when a whale shows up and instantly sits out the moment they quit

Hey Joey, i’m working for a horse betting company and our terms are not in line with GG. The verification always needs to be accepted before any customer can make a deposit and it’s total bullshit that they let him play and take it afterwards. Happy I never joined the site.. greets from NL

Casinos can ban card counters who have an edge , but they dont confiscate their winnings. Some poker sites consider theirselves above the law, and make up their own laws. This is bad pr move by GG. I expect them to do a full reversal of this to quiet things down.
There's also some spanish players banned just for winning. Looks like Chris Ferguson 2.0
Don't ever keep more than 10% of your bankroll on any site. Some sites actually change the algorythm if you start winning, so you find your average slowly gets better and better, then suddenly your average goes worse than if you have just started playing again!! Very wrong.

If No predatory behavoir is allowed, almost all pros will not be winning

@@cameronfoster8735 yeah i but i bet its skewed, for example i lost 3 deposits then on my 4th i was up for about 3 months then lost it and lost another 2 deposits after that, they could skew it that i was a winning player if they took a sample at the optimal time.

At this point then GG Poker should pay the man his money. If they've already distributed the winnings to other players he played against then eat the cost. It isn't worth the bad publicity. Pay that man his money.
I agree. Anything short of making him whole is THEFT. It could happen to anyone of us. We need to stand together and unite against the big guys so we're all treated fairly.
