My father sold one house and purchased another with the proceeds.It was registered in the name of my mother.Then property was transfered(Inteqal)in the name of my mother. After 2 years my mother died.
My father is staying with my sister who is married with nephew of my father.
I am eldest son and staying alone in the afore mentioned house.
My father is alive and we pray for his long life.
After the death of my mother,logically the owners of this house should be its legal heirs including my father.
The value of the house is 25 lac.
Logically after obtaining succession certicate the proceeds of property if sold shall be divided among its legal heirs as per their share as per law.
Furthermore my father if desires can gift only his share to my sister.
Is my understanding correct as per law or otherwise.
Jis ko tamleek mili hay agar woh property ko sale kar chuka ho phir bhi tamleek cancel ho sakti hay? Jis nay purchase ki hay kia us ko bhi problem ho sakti hay?
sir did father can transfer whole of his property to his single son and exclude others heirs, even if there in no fraud has committerd ,no misrepresentation is evident from the evidence. is even then father can transfer his whole property to his any single son by free consent and without any undue influence and coercion, fraud ,mistake from the donee?
