Obviously even if you were cooperative enough to give right of way to up coming vehicle, you first need to detect its presence. If it appears suddenly when you least expected it, it's going to be a problem.
But that's what he did , the car driver , he went extreme left and stopped his car . How was he to know that the truck climbing is so underpowered or overloaded that it will come right on to the right flank of the road .

The problem is because of the golti car driver. In hill roads priority must be given to up coming vehicles ,that is the rule.
