I-CAN Issues||01st November 2023 UPSC current issues explained by Santhosh Rao UPSC
Marvellous explanation sir....a great many thanks to your effort!
under article 145 clause 3 substantial question of law relating to interpretation of constitution and
under 143 when president seeks opinion if supreme courts.
and also in case conflicting verdict given smaller bench can be transferred to larger bench called constitutional bench
The other purpose of the 5 judge bench is for hearing the reference made by president under article 143.
Well explained 👍
Other instance where a minimum of 5 judges are required is... President's Advisory jurisdiction of SC under A-143
For hearing any reference made by president and any reference made by parliament
Both 1 and 2
Five judge bench can also be formed under article 143_ reference by president of india
❤
In case of conflicting issue!
No sir.. even in anonymous scheme govt can ask for funding data from SBI and can do discrimination.. so non anonymous scheme won't have any specific discriminatory impact
