    This guy came off as sleezy before he even opened his mouth. He then hands JJ a letter where a client who's an attorney ripped him for being a sleezy person and praised the plaintiff for always doing a good job. He didn't prove defamation because it wasn't defamatory, he proved his client fired him because they want her or nothing.***Just watched to the last clip and what she did, just plain wrong and no man needs to go near her...I still don't like him though.

    Having been a small business owner, I'm not sure I agree with JJ on this one. The plaintiff knew exactly what she was doing by making this statement to the customer. She wanted to undermine his business. Most cleaning customers are emotionally tied to the cleaner, rather than the company. I think JJ should have dug further into the motive behind the plaintiff statement

    • @kylenielsen5341
      @kylenielsen5341 Рік тому +15

      It doesn't matter if she was trying to undermine his business, and it doesn't matter if Minnesota allows him to not pay her overtime. All that matters is whether she made a statement of fact about him that was false. She didn't, so it isn't defamation. She said he was refusing to pay her overtime, and he was in fact refusing to pay her overtime.
      It's not defamation, he has no case against her.

      Doesn't matter if you can speak ill of a company to anyone if it's true or you reasonably believe it to be true.
      Slander is only when they know they are lying (Actual malice) or have reckless disregard for the truth.
      Depending if it's a public or private person respectively, nothing she said approaches either standards.

    I see the defendant's point, it's frustrating that his client attorney, who sounds like a know-it-all, assumes the plaintiff was an "employee" and not a contractor. But the fact of the matter is ,it doesn't matter how educated or uneducated a decision a person makes when they hear the statement, "He wouldn't pay me overtime and I was upset about it." It's not the the same thing as, "He forced me into prostitution during my contract with his company," or some illegal act like that.

      Personally, I don't think that was geniune. Sometimes when people feel like they don't have control in a situation, they ask questions and demand answers in an attempt to keep arguing so that they can claw back control. JJ made it clear, and to me, he came off as just not liking the answer.
