Dealing with idiotic people on a daily basis and having to explain to absolute imbeciles that they broke this and that law day in day out would drive me crazy at some point too. I may have the juggler beat. I am a professional tuba player in a symphony orchestra. Many years ago while a student I was on the road headed to see my mother. My school was a six-hour drive from my house, and I had just finished Finals for that semester and hit the road that evening. I was five hours into the drive so it was very late, perhaps 2:00 a.m. I had my gym and book bags stuffed with clothes in the passenger seat, and my tuba in a soft "gig bag" in the back seat. I got pulled over because I was speeding to get off the road ASAP as I was starting to fall asleep. (My bad. I know.) The DPS trooper approached with a flashlight in hand, and he interrogated me with the usual questions. Then he checked out my back seat with the light, saw this body-sized bag on the seat, drew his sidearm, jumped back like eight or ten feet, and screamed, "GET OUT OF THE CAR! PUT YOUR FACE ON THE GROUND!" I complied, of course. He called for backup and kept me covered until the other trooper arrived. Once the other trooper arrived they got me up, cuffed me, leaned me against the TXDPS unit's hood, and then started searching my car, with a lot of attention to the gig bag, with one of them questioning me intensely about what it was, why it was there, etc. Then the searching officer cautiously unzipped the bag. They both cracked up when they saw it was a tuba. Then one of them, a former tuba player from his high school days, thought it must have been stolen since every tuba he knew was a school-owned instrument. So we had to go through all the usual "Is this yours?" and "Where did you get it?" rigamarole, along with the rather stupid "Do you have a receipt for that thing on you?" bit. No, of course I don't carry a sales receipt for it. Do you carry a receipt for your car in your wallet? Do you carry a receipt for your underwear and socks? So, finally, to prove that it was mine, I offered to play it. So around 2:00 a.m. on US 281 north of San Antonio, I played a short concert for two Texas State Troopers while standing on the side of the road. They were delighted and were laughing and taking photos with 35mm cameras they both happened to have in their cruisers. Then the trooper who used to be a tuba player asked whether he could try my horn. I had a spare, clean mouthpiece, and I ended up giving a mini-private-lesson on the side of the road. No charges. No warnings. Lots of laughter and photos. One for the books. This happened sometime in 1990 or 1989. I am sure that lots of passing motorists were baffled by me standing there playing that horn. I am sure others were EVEN MORE freaked out seeing a state trooper standing there playing it.

The band? Well we set up in the square by the Statue of Liberty and just started playing like street performers. Then we were supposed to tour the Statue of Liberty, and leave our instruments in a pile on the pavement outside (two teachers stood next to them.) I didn’t have a case with me, and really didn’t want some homeless guy blowing into my (actually school owned) baritone, so I decided to take the mouth piece with me into the statue. That was a mistake because the one security guy thought it was some sort of crack pipe or whatever. I got detained for a couple minutes until another security guard arrived who must have been in band at some point because he knew exactly what it was. They let me into Lady Liberty with my mouth piece, and for a couple hours a rumor that I was a drug addict spread like wildfire in our band. Luckily it wasn’t hard to set the record straight.

Sure, they deserve more respect. However, flipping an officer off is protected under the first amendment. What he did after and searching the car was illegal and also a violation of the individuals 4th amendment. The officer will probably be sued for civil rights violations.

In the video, the guy got detained did not recognize it was a cop car when he flipped the officer off. His inadequate observation skills aside, he did not seem to show any disrespect towards the officer. It was simply not his day when he decided to give a finger to what he thought a stranger tailgating others. He could have minded his own business. The officer could have handled the whole flipping by ignoring it but he felt he had to vent. Both escalated the situation but one was ignorant, and the other lost his temper.

Spence v. Washington (1974) is the specific case of flipping the bird is constitutional and within freedom of speech. City of Houston v. Hill (1987) this is you can curse to the police under 1st amendment. there are multiple other examples those 2 were just to ones off the top of my head. now fighting words are not protected correct, but profanity is protected.
Simple charge of shoplifting turns into a felony at a certain dollar amount (see store for details). Felony means loss of rights, possible prison time.

Sure, they deserve more respect. However, flipping an officer off is protected under the first amendment. What he did after and searching the car was illegal and also a violation of the individuals 4th amendment. The officer will probably be sued for civil rights violations.

In the video, the guy got detained did not recognize it was a cop car when he flipped the officer off. His inadequate observation skills aside, he did not seem to show any disrespect towards the officer. It was simply not his day when he decided to give a finger to what he thought a stranger tailgating others. He could have minded his own business. The officer could have handled the whole flipping by ignoring it but he felt he had to vent. Both escalated the situation but one was ignorant, and the other lost his temper.

Hill (1987) this is you can curse to the police under 1st amendment. there are multiple other examples those 2 were just to ones off the top of my head. now fighting words are not protected correct, but profanity is protected.

Simple charge of shoplifting turns into a felony at a certain dollar amount (see store for details). Felony means loss of rights, possible prison time.
They might be on parole and will go back to jail.
Might have to do with ownership of the car, possible warrants, and if they think police know about previous shoplifting escapades.
Not that the officer is right, but I totally understand his frustration.
