In an incredible move the US Supreme Court struck down the "Chevron Deference" which essentially allowed any US agency to create any regulation it felt like by claiming the authorizing statute was ambiguous. As if a state is ambiguous, according to Chevron, all courts should defer to agency interpretation.
    Decision here:

did the US Congress intend the 16th Amendment to tax the hourly pay of the people?
NO, such an intent would subject the people into an unlawful and forced indenture...

It was all lies. And the Republican party went from being opposed ot the income tax in 1913 to full supported once that saw all that revenue and power come in and the few remaining shreds of the Constitution that weren't already shredded were thrown into a dumpster fire outside the back of the Capitol building.

And just after you guys recorded this the court dropped another related case called Corner Post related to Loper Bright.

Corner Post allows people to challenge even old federal regulations say like FBAR rules from the 1970s if they are being harmed today in the present.

The problem with the live chat hypo of “Congress says ‘we want a couch’ and the agency knows how to build the couch” is that it’s a bad starting point for this type of legal reasoning and it also misses the point of the problems people had with Chevron.
Say I grant the premise of the hypothetical. What happens when the agency along with building the couch builds a table and chairs too? Or the agency says they have to knock a wall down in the house to make room for the coach? It’s not obvious that Congress’s desire to have a couch empowers the agency to build other furniture or knock down walls, even if the couch building experts think it’s a good idea.
And in the facts of Loper Bright, the statute didn’t empower the agency to charge the fishermen $700. Was the $700 fee just another bag of screws in the IKEA box? Maybe. But you cannot and should not defer to an agency in this type of situation if there was no statutory authority on point.

Thanks for your thoughtful comment - I am not sure if we took the hypo to that conclusion. What do you think the biggest problems with people had with Chevron?
