Woman with Multiple Prior Arrests and DUIs gets Arrested Again on Thanksgiving

- Around 3:41 PM on November 23, 2023, Sergeant David Marler with the South Kingstown Police Department was headed eastbound on Main Street, and he observed a black Toyota 4Runner turn erratically from Robinson Street onto Main Street. The vehicle then struck a sign on the double yellow line and drove westbound through empty parking spaces on Main Street. After the driver passed his patrol car, Sergeant Marler made a U-turn and activated his emergency lights to initiate a traffic stop. The driver stopped on Main Street in front of the Paul Masse Chevrolet dealership. The officer made contact with the driver, who was identified as Donna.
Donna told the officer that she was coming from Sunset Farm, but denied consuming any alcohol. He noticed that Donna’s movements appeared sluggish and her eyelids appeared droopy. Donna was unable to provide the officer with a license. Based upon his suspicion of impairment, Donna was asked to perform field sobriety exercises.
Sergeant Marler started with the Horizontal Gaze Nystagmus (HGN) test. The second exercise was the Walk and Turn test. During the Walk and Turn test, Donna did not touch heel-to-toe on each step and took an incorrect number of steps. The third exercise was the One Leg Stand test. During the One Leg Stand test, Donna failed to raise her foot in the proper fashion and put her foot down after approximately 20 seconds. The final field sobriety exercise was a finger-count test.
Sergeant Marler returned to his patrol car and looked through Donna’s information. A search of the system yielded multiple prior arrests including at least 2 prior DUIs in Rhode Island. After checking her information, Sergeant Marler called for another officer to bring the PBT device so that she could take a portable breathalyzer test. Donna was uncooperative and she failed to properly blow into the device.
Based on her erratic driving, the odor of alcohol in the vehicle, her inability to adequately complete the field sobriety exercises, her inability to complete the PBT test, and her history of prior arrests and DUIs, Sergeant Marler placed Donna under arrest for driving under the influence. Donna was secured in the patrol car at 4:11 PM and transported to the South Kingstown Police Department at 4:21 PM for further processing.
At the station, Donna was read the Implied Consent Notice, and at 4:46 PM she refused to submit blood samples for testing. Donna was presented before Justice of the Peace Tom O’Brien and released at 7:10 PM pending her court appearance on December 4, 2023. Sergeant Marler issued Donna the following citations: DUI, refusal to submit to chemical test, manner of turning at intersection, and laned roadway violation

Even before there were computers in cop cars, they called in names and DOB to dispatch who looked them up for records and possible warrants. She might possibly hope that they won't hold her record against her but not even the slowest among us would hope that their records won't show up for police because there's almost no chance they won't.

I honestly worry about possibly being suspected of a dui even though I don’t drink alcohol or do drugs. Due to my health I can’t perform any of these tests they want you to do. I know it’s an irrational fear since like I said I don’t drink but still I’ve seen some cops in ego trips that arrest obviously innocent people. Doesn’t happen often but frequently enough for people to worry!

I can't even tell you how many times I've watched dwi videos and the cop asks "where are you coming from" and the answer they give every single time is "I'm just trying to get home" cause they're so drunk they think that answers the question and they don't want to say they're coming from the bar. That's always right before they admit to drinking but they "only had 2 drinks." Love that people think 2 drinks is the magic number that will get them out of what's about to come.

She was laying the groundwork with medical excuses from the second she got out of that car. According to her, she was a quarter inch away from being paralyzed almost 30 years ago, has asthma, suffers from alopecia and some kind of blood issue that she said would cause her to pass out if she had to have blood taken. I’m just curious on her thought process to how alopecia makes her a target to law-enforcement. Also it kills me how people try to fake the breath test and they will make these over exaggerated faces with puffed cheeks. Then the minute the officer pulls the tube out of their mouth you don’t hear any air coming out but yet the cheeks are still puffed. Who do they think they’re fooling?
And it's not as if she's never taken that test before. This is not her first DUI.
She said the alopecia means she doesn't have eye hair (eyebrows or eyelashes or both?) so her eyes look tired. How the officer saw this and targeted her before he stopped the car I'm not really sure.

I just went back and re-watched a small section of the video and if she has no eyebrow or eyelash hair then I can’t tell. She has her brows penciled on or something like that and smeared black eyeliner all over. With all that going on, I couldn’t tell if she even had actual eyebrow hair or eyelashes.

Our legal system is very flawed as long as you refuse to take any test and stay quiet many times people get out of these charges and never serve any jail time with a good attorney. Most of the time they end up committing more crimes like in her case.

My favorite roadside tests are when they have to start the alphabet at a certain letter and end with a certain letter. And also when they have to count backward from, say, 67 to 34. Those really mess them up & it's fun to watch 🤭

The problem with the slap on the wrists for repeated DUI's is that when they actually kill someone (because they keep driving drunk), they end up gobsmacked that they are going to jail for 20+ years. I don't think any first world country is as easy on drunk drivers than the US.

The ONE seemingly innocent question that cops almost always ask, that no drinker wants to answer: "Where are you coming FROM?" then there's almost always the "deer in the headlights" look and some kind of dumb answer because no one wants to admit they just came straight from the bar or multiple bars.

This is precisely why prosecutors don't like to introduce fsts, but in a case like this what else do they have, but she did pretty well on the fsts, and must have done well on the hgn, because that is used to prove presence of alcohol, but the leo wasn't all that convinced that it was an alcohol dui, a decent dui attorney would love this case.
